Planning and Zoning:
Public Meeting Requirement
The Subdivision Ordinance requires that land divisions in the B2 (Business General) Zoning
District, without an approved master development plan, be presented to the Board of
Supervisors for final approval. This project is zoned B2, and does not contain an approved
MDP; therefore, Board review and action is necessary.
Staff Review
This parcel is adjacent to the Round Hill United Methodist Church, three residences, Pack's
Frozen Custard (zoned B2), and Northwestern Pike (Route 50 west).
The proposed land division would establish two lots: 2.1502 and 0.9263 acres. Road
frontage along Northwestern Pike appears to be adequate to enable a future commercial
entrance satisfying entrance distances as per the Zoning Ordinance. The presented plat
appears to satisfy the Subdivision Ordinance requirements.
Staff Recommendation for 03/18/98: Staff recommends approval of this subdivision application
contingent upon the applicant's satisfying all review agency comments.
Plannine Commission Summary & Action of 03/18/98: There were no public comments
regarding the subdivision. No issues of concern were raised by the Commission. The Commission
unanimously approved the subdivision as presented.

I have reviewed your request for subdivision comments, the included plat by Elliott Ritchie, Jr.
dated August 25, 1997 and the health department file for your property known as Signal Station.
I am listing below the health departments comments pertaining to your request to subdivide the
parcel into lot I -A (9263 acres) & lot 1-B (2.1502 acres).
• With regard to proposed lot 1-B, see the included letter from this office dated December
19, 1996. This letter goes into detail about the evaluation of the existing sewage disposal
system. I will not re -state the facts of this letter, but would refer anyone considering this
sub -division to this particular letter for it lists the details of the health departments findings
for that particular evaluation.
• For lot 1-A, the health department is limited to comments that can be made for this lot
because the sewage disposal system that is presently is use is a PERMANENT PUMP
AND HAUL SYSTEM. Pump and haul systems are controlled under the authority of the
Frederick County Administrator and the Executive Director of the Frederick -Winchester
Service Authority. This office did complete a construction inspection for this system and
found it to meet the health departments construction criteria.

A evaluation of the existing sewage disposal system for the above listed property was completed
on 12-18-96. The distribution box was uncovered. The box appeared to be functional with 6
lines exiting. This office also has on file a copy of the construction permit and inspection for this
system. The permit was originally issued to Edward Andrews for a water usage not to exceed
200 gallons per day.
As I understand your proposal, you would like to sub -divide the existing parcel with 1 lot being
served by the existing drainfield already located on this lot. Considering this information I am
listing below comments which relate to the existing system evaluation;
1. This lot would have to be served by a approved water supply. (Permit required)
2. A building sewer pipe, septic tank, pump tank, pump and controls with alarm and conveyance
line would have to be installed and approved in order to make use of the existing drainfield.
(Permit required)
3. A application along with fees would be required in order to consider a construction permit for
the above listed items. (1 & 2)
4. Any structures would have to be a minimum of 20' (with basement) or 10' (with crawl space)
from all components of the sewage disposal system.

5. Any newly established property lines would have to be a minimum of 5' from all components
of the sewage disposal system.
6. As described on the construction permit issued to Mr. Andrews all water usage must not
exceed 200 gallons per day. Therefore, any construction permits which this office may issue
will be limited to a maximum of 200 gpd.
7. Due to the topography of the property, area for a conventional repair may be non-existent.
The utmost care should be given to the existing drainfield to be sure that it is not damaged
or hydraulically over -loaded.
8. This drainfield has NOT been used since 4-25-95 (Pump & Haul put into service). Therefore,
there is no way that I can confirm that the drainfield will continue to function under normal
use.
"This report is only intended to address the above referenced request. This report is not intended
for use as part of a real estate transfer or any other unauthorized use. There is no implied
guarantee of future septic system performance based on this report. In the event of any sewage
disposal malfunction, the owner will be responsible for any repairs or other actions deemed
necessary to correct the situation".
