REVIEW AGENCY COMMENTS: Department of Transportation: No objection to the subdivision of this property. Before development, this office will require a complete set of construction plans for review. Subdivision Page 2 June 3, 1998 Public Meeting Requirement The Subdivision Ordinance requires that land divisions in the B2 (Business General) Zoning District, without an approved master development plan, be presented to the Board of Supervisors for final approval. This project is zoned B2, and does not contain an approved MDP; therefore, Board review and action is necessary. Staff Review This parcel presently contains a shopping plaza: Roma's Restaurant and ServiStar Hardware Store. The site is bordered by Kentucky Fried Chicken, Route 277, Stickley Drive and the Comfort Inn. The proposed division would establish two lots: 0.5732 (PIN 85-A-148) and 5.8362 (PIN 85- A-148D) acres. The 0.5732 acre lot was rezoned to B2 in 1996. At the time of the rezoning, the applicant proffered to utilize the existing entrance onto Route 277. Therefore, an easement will be established enabling this 0.5732 acre parcel to utilize the existing entrance. The presented plat appears to satisfy the Subdivision Ordinance requirements. Staff Recommendation for 5/20/98: Staff recommends approval of this subdivision application contingent upon the applicant's satisfying all review agency comments. Planning Commission Summary & Action of 05/20/98: Members of the Commission had questions on the ingress/egress easement. They also had questions about the possible impacts resulting from the eventual widening of Route 277. Staff noted that VDOT is anticipating the need for a 92-foot right-of-way along Route 277; however, structures should not be impacted as a result of the widening because the plat specifies a 50-foot building restriction line. Commission members pointed out the terrible traffic situation in this area; they believed the I-81/ Rt. 647 intersection was poorly planned, located and configured, and that the widening of I-81 and Route 277 would cause additional traffic problems. In light of this, most members of the Commission felt there was no justifiable reason to deny the request; they believed that approving the subdivision would not make the traffic situation any worse than it already was. By majority vote, the Planning Commission recommended approval of the subdivision contingent on the applicant satisfying all review agency comments. REZONING B-1 TO B-2 Route 277 East -Fairfax Pike Opequon District - Tax Parcel 85-A148 Preliminary Matters Pursuant to Section 15.1 -49.1 et.se ., of the Code of Virginia, 1950, as amended, and the provisions of the Frederick County Zoning Ordinance with respect to conditional zoning, the undersigned applicant hereby proffers that in the event the Board of Supervisors of Frederick County, Virginia, shall approve Rezoning Application # -96 for the rezoning of 25,593 square feet from B-1 Neighborhood Business Zoning District to the B-2 Business General Zoning District, development of the subject property shall be done in conformity with the terms and conditions set forth herein, except to the extent that such terms and conditions may be subsequently amended or revised by the applicant and such be approved by the Frederick County board of Supervisors in accordance with Virginia law. In the event that such rezoning is not granted, then these proffers shall be deemed withdrawn and of no effect whatsoever. The proffers shall be binding upon the applicant and their legal successors or assigns.
