THIS DEED OF DEDICATION made and dated this /%'lit day of August,
11962, by James R. Wilkins and Mary B. Wilkins, his wife,
WITNESSETH: That we, the undersigned, being the owners and
proprietors of the land embraced within the subdivision shown on the annexed
plat identified as "Final Plat Section 2, Wilkins' Shenandoah Hills", do
hereby certify, pursuant to the laws of Virginia, and the ordinances of the
I City of Winchester, and of Frederick County, relating to, and governing,
subdivisioas,that the said plat shows accurately the streets, corners, lines
and metes and bounds of the respective lots therein, and that said subdivision
has been made, and the plat thereof is submitted for recordation, with the
full and free consent, and in accordance with the desires, of the undersigned,
and the streets shown thereon are dedicated to the public. It is further
certified that the land embraced in said subdivision is located about one mile
East of Winchester, in Shawnee District, Frederick County, Virginia, and is a
portion of that certain larger tract or parcel of land that was conveyed to
the undersigned by George W. Stump, by deed dated April 16, 1960, and of record
in the Clerk's Office of the Circuit Court of Frederick County, Virginia, in
Deed Book No. 263, page 23.
It is expressly stipulated that each and every lot in said
subdivision is, and shall be conveyed, subject to a reservation of a 10 foot
easement adjacent to any street line bordering thereon for power line, telep
line, water pipe line, gas main or other utilities, and that all other ease-
ments shown on said plat are reserved for the respective purposes set forth.
It is further stipulated that each and every lot in said
subdivision shall hereafter be subject to the following restrictive conditions
which are hereby declared to be covenants real running with the land:
1. No dwelling house shall be constructed on any lot at a cost
of less than $9300.00, nor having a foundation area of less than 960 square
feet, for a single story house (or 1150 square feet including carport or
garage) nor less than 1600 square feet for a two story house.
2. That no dwelling house or other building may be erected on
any lot nearer to an adjoining street line than the respective minimum building
lines shown on said plat, nor dearer than 7 feet to any side or back division
line.

3. No fence more than 4 feet in height may be constructed on
zany lot.
4. All sewage disposal shall be by septic tank and distribution
system approved by the Frederick County Health Department or other governmental
department having such authority.
S. No poultry, livestock or other animals, except household pets,
may be kept or maintained on any lot.
6. No trailer or temporary type dwelling may be constructed or
;maintained on any lot.
7. No Easements or Rights of Way shall be granted across any lot
for extension of streets, water lines or other utilities without the consent
Hof the undersigned, their successors or assigns.

8. The undersigned reserve the right for themselves, their
successors or assigns, or an Architectural Committee appointed by them, their
successors or assigns, to review, and if desired by them, their successors or
;assigns, to reject, any and all plans for houses or other structures proposed
to be constructed on any lot.
9. The undersigned reserve the right to place other restrictions,
supplementing or differing from those herein contained, upon their adjoining
land.

The Accompanying Plat is a PLAT REVISION SURVEY of Lots 35,
37, and 39 - Section 2 - Shenandoah Hills. Lot 35 was conveyed to
Kathryn G. Gladstone by Deed dated 20 September 1976 in Deed Book
464 Page 570. clot 37 was conveyed to Harold M. Smith and Mrs. W. J.
Gladstone by Deed dated 21 July 1977 in Deed Book 495 Page 842.
Lot 39 was conveyed to Harold M. Smith and Patty L. Smith by Deed
dated 18 June 1976 in Deed Book 459 Page 814. The said Land fronts

The Accompanying Plat is a PLAT REVISION SURVEY of Lots 35,
37, and 39 - Section 2 - Shenandoah Hills. Lot 35 was conveyed to
Kathryn G. Gladstone by Deed dated 20 September 1976 in Deed Hook
464 Page 570. Lot 37 was conveyed to Harold M. Smith and Mrs. W. J.
Gladstone by Deed dated 21 July 1977 in Deed Book 495 Page 842.
Lot 39 was conveyed to Harold M. Smith and Patty L. Smith by Deed
dated 18 June 1976 in Deed Book 459 Page 814. The said Land fronts
