The subject property is owned by Mr. Donald C. and Mrs. Myrtle Mort, of the Stonewall Magisterial District. The property is located at the corner of Ross Street and West Virginia Avenue in the Shannon Hills Subdivision. The zoning designation of the property is RP (Residential Performance) District. This subdivision would divide the existing 33,661 square -foot parcel into two pieces. Section 165-134 of the Frederick County Zoning Ordinance grants the Director of Planning and Development the ability to waive the requirement for a master development plan under certain conditions. The proposed subdivision of the Mort property would meet these conditions for a waiver, so long as the new lot sizes are compatible with the lot sizes of the surrounding area, and consistent with the intent of the RP Zoning District. Therefore, it is my belief that a waiver to the requirement for a master development plan would be appropriate in this situation, if each of the two new lots are at least 15,000 square feet in size. This particular size of lot is compatible with the lots in the area and is consistent with the requirements of the RP District for lots without curb, gutter and sidewalks. Please be advised that the waiver of a Master Development Plan does not eliminate any applicable development and design requirements for residential lots of this size in the RP District.
