Dear Donald and Myrtle:
On August 6, 2003, our department received a request for a waiver to the requirement for a master development
plan for the subdivision of the above -referenced parcel of land. The subject property is owned by Mr. Donald
C. and Mrs. Myrtle Mort, of the Stonewall Magisterial District. The property is located at the corner of Ross
Street and West Virginia Avenue in the Shannon Hills Subdivision. The zoning designation of the property is
RP (Residential Performance) District. This subdivision would divide the existing 33,661 square -foot parcel into
two pieces.
Section 165-134 of the Frederick County Zoning Ordinance grants the Director of Planning and Development
the ability to waive the requirement for a master development plan under certain conditions. The proposed
subdivision of the Mort property would meet these conditions for a waiver, so long as the new lot sizes are
compatible with the lot sizes of the surrounding area, and consistent with the intent of the RP Zoning District.
Therefore, it is my belief that a waiver to the requirement for a master development plan would be appropriate
in this situation, if each of the two new lots are at least 15,000 square feet in size. This particular size of lot is
compatible with the lots in the area and is consistent with the requirements of the RP District for lots without
curb, gutter and sidewalks. Please be advised that the waiver of a Master Development Plan does not eliminate
any applicable development and design requirements for residential lots of this size in the RP District.
Please keep this letter as evidence of the Planning Department's position regarding this subdivision proposal.

The Accompanying Plat represents a BOUNDARY LINE ADJUSTMENT
SURVEY of Lot 37, Lot 38, Lot 39 and Lot 40, Shannon Hills Addition
(A Matter of Record in Deed Book 153, Page 540). Lot 37 is the
Land conveyed to Delia M. Wilson by Deed dated 7 December 1983
in Deed Book 570, Page 193; Lot 38, Lot 39 and Lot 40 are Portions
of the Land conveyed to Milton Shoemaker by Deed dated 26 June 1939
in Deed Book 182, Page 85. The said Land fronts the Northern
Boundary Line of West Virginia Avenue, and lies in Stonewall
District, Frederick County, Virginia:
