The platting and subdivision of Saratoga Meadows, Lots No. 1 through 42, as shown on the attached plats of survey prepared by Greenway Engineering and Surveying Co., Inc. is done with the free consent and in accordance with the desire of the Owner herein and Shreck. 2. The Owner and Shreck do hereby grant and dedicate to the Grantee herein, in accordance with Section 15.1-478 of the 1950 Code of Virginia, as amended, the drive (Saratoga Drive) and the lane (Steeple Chase Lane) and a perpetual easement for the II maintenance and repair of the twenty (20) foot drainage easements for surface water drainage and the two (2) drainage detention HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA 8K8381'G0752 facilities on the common areas, all as shown on the attached plats. If T Association fails to do so, the Grantee may perform such necessa maintenance and repairs with the cost of same to be the obligati of The Association, with the charge for same to become a lien up the property of each lot owner (other than Lot 1) in the same manner as the annual assessment is a lien under Paragraph 6 B. 3. Each lot in the Subdivision (except to the extent modified by Paragraph 7 herein regarding Lot 1) is subject to the following covenants, restrictions and easements which shall be considered real and running with the land and shall be binding upon and enforceable by the Owner, Shreck and all subsequent owners of the said lots, as well as the Saratoga Meadows Home- owners Association, Inc. (hereinafter called The'Association): (a) No lot shall be used except for single family residential purposes and no apartments, duplexes nor other multi- family building shall be constructed on the property without the approval of the Frederick County Board of Supervisors. (b) No dwelling shall be erected nor maintained on any lot unless the dwelling has at least 1400 Square Feet of living space (exclusive of porches, garages and basement). (c) No signs or advertising of any nature shall be erected or maintained on a lot, except for sale or rental signs for said lot. (d) No motor vehicle which does not have a current II license plate and a current Virginia inspection sticker shall be permitted or allowed on any individual lot nor on any common area. - 2 - HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA BK836PG0753 (e) No trees shall be planted nor other digging under- taken without first securing the approval of the local power company and without first being advised as to the location of all underground electrical and telephone wires. (f) No noxious or offensive activities shall be carrie on upon any lot, nor shall anything be done thereon, which may be or may become an annoyance or nuisance to the neighborhood. (g) No animals, livestock or poultry of any kind shall be raised or kept on any lot, except that dogs, cats and other household pets may be kept provided that they are not kept, bred or maintained for commercial purposes. Any dog house or other structure housing any animal allowed in this paragraph shall be in the rear area of the lot and no such structure shall be allowed to the front of the lot. (h) No boats, trailers, campers, trucks or other similar vehicles or equipment, other than automobiles, motorcycle and pickup trucks shall be parked or located on any lot nor on an common areas except for the purpose of delivery, construction or moving (which shall not exceeding two (2) calendar days). (i) No baby carriages, bicycles or other articles of personal property shall be deposited, allowed or permitted to remain on any lot except in the enclosed rear area. Saratoga Meadows Homeowners Association may impound all such articles and make a charge for their return. (j) No lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall not be kept except in sanitary containers. All incinerators or other equipment for storage or disposal for such materials shall be II in a clean and sanitary condition. This restriction shall terminate and become void on January 1, 2002. (1) The Association has been created by the Owner for the purpose of maintaining the common areas of the Subdivision (which are described on the attached plats as SWM Parcel A and SWM Parce B), and of maintaining the tree screen along Senseny Road as required by the County of Frederick, and each person or entity wh is a record owner of a fee or undivided fee interest in any lot shown on the attached plats shall be a member of The Association and shall be subject to the conditions and requirements set forth herein, especially under Paragraph 5. (m) Invalidation of any one of these covenants or restri- ctions by judgment or Court Order shall in nowise affect any of the other provisions which shall remain in full force and effect. 4. The Owner reserves unto itself and its assigns, the righ to erect, maintain, operate and replace underground and above ground telephone and electric light conduits, related equipment and other facilities, sewer, gas, water and television lines and related equipment and other utility equipment where such utility lines and equipment are now located and on, over and under that portion of each lot which lies within twenty (20) feet of any of the roads shown on the attached plats and the right to grant II easements or rights of way therefor. The Association shall be operated subject to the following conditions: (a) Every person or entity who is a record owner of a fee or undivided fee interest in any lot shown on the attached plats shall be a member of The Association. The foregoing is not intended to include persons or entities who hold an interest merely as security for the performance of an obligation. Membership shall be appurtenant to and may not be separated from ownership of any lot. Ownership of such lot shall be the sole an continuing qualification of membership. (b) Each member shall have one (1) vote for each such lot owned by that member. If a member has less than a full interest in a lot, his vote shall be reduced accordingly. The total number of votes shall equal the total number of lots in sai Subdivision. (c) The members of The Association shall hold their annual meeting on the second Monday in January of each year or on such other date as is set forth in the By-laws of The Association The members shall elect the Board of Directors of The Association at that meeting, which Board shall initially consist of three (3) members, all of whom must be lot owners. The number of Directors on the Board may be changed by the membership at their annual meeting. At this meeting The Association shall elect by a majority vote a Chairman and a Treasurer. The Chairman shall hav the authority to call special meetings of The Association for any purpose by giving at least ten (10) days written notice to each member. The Treasurer shall be bonded to the extent required by the Frederick County Ordinance and shall hold all funds in an interest bearing account. The owner of each lot, by acceptance of a deed thereto, is deemed to covenant and agree to pay to The Association the following: (a) An annual assessment beginning in 1996 made by The Association for its purposes set forth herein, being primarily th maintenance of the common areas of the Subdivision and the maintenance of the tree screen along Senseny Road. Maintenance shall include, but not be limited to, mowing, tree care, replanting grass, replacing trees and maintenance and repair of the drainage easements and the drainage detention facilities. In addition, the annual assessment shall include the payment of real estate taxes, insurance and legal, accounting and other operating expenses determined necessary by the Board of Directors in operating The Association or in enforcing these covenants. (b) The annual assessment for 1996 shall be Sixty Dollars ($60.00) per lot. The amount of each subsequent annual assessment a the time at which it shall be payable shall be determined by The Association at its annual meeting. The amount of the annual assessment shall be set at an amount intended to accomplish the purposes noted above, including the creation of a reserve for anticipated expenditures and emergencies. The Association shall notify each lot owner in writing at least thirty (30) days prior to the assessment being due. The Association shall be governed a majority vote of the lot owners. The assessments made by The Association shall be - 6 - HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA BK836PG0757 personal obligations of the lot owners and failure to pay an assessment within thirty (30) days after the mailing of the notice of the assessment shall result in the incurring of interest by the lot owner of twelve per cent (12%), per annum, with the lot owner being subject to cost of collection, including reasonable attorney's fees, in the event the lot owner fails to make timely payments. All written notices of assessments shall be to the last address given in writing to the Treasurer by the lot owner. Said annual and special assessments shall be a charge and lien upon the property herein subdivided, it being expressly understood that said lien is inferior and subordinate to the lien of any deed of trust hereafter recorded in the Office of the Clerk of the Circuit Court of Frederick County, Virginia encumbering the lots subdivided herein, unless record notice to the contrary is given prior to the recordation of such deed of trust. If the owner of any lot is in default in the payment of any assessments, in addition to any other means of collection, The Association may bring an action at law against the owner personally obligated to pay same and may also sell the lot involved at public auction after advertisement once a week for two (2) successive weeks, in some convenient newspaper, having general jurisdiction in this County, and after thirty (30) days written notice mailed to the last known address of said owner. Cost of sale shall be paid from the proceeds of sale before payment of amount involved. In exchange for the Owner maintaining the common areas during 1995, the Owner shall not be obligated to pay any annual or special assessments on any lots owned by it. 7. (k) of the covenants and restrictions shall not apply to Lot 1 until such time as the house now located on Lot 1 is removed. 8. The costs of maintaining such sign shall be paid out of the secondary system maintenance allocation to the affected county; and WHEREAS, Saratoga Drive (Route 1277), Steeplechase Lane (Route 1278), and Stirrup Cup Circle (Route 1279), are located in a residential area and are within the secondary road system and are a viable candidate for "Watch for Children" signs; and BE IT THEREFORE RESOLVED, the Frederick County Board of Supervisors does hereby request that the Department of Transportation install "Watch for Children" signs specifically at Saratoga Drive (Route 1277), from 0.23 miles southeast Route 657 to Route 657; Steeplechase Lane (Route 1278), from 0.13 miles south Route 1277 to Route 1277; and Stirrup Cup Circle (Route 1279), from Route 1277 to 0.05 Miles northeast Route 1277. The signs should be placed in accordance with the provisions of Section 33.1-210.2 of the Code of Virginia. COUNTY ENGINEER: See attached comments dated December 2, 1994 PLANNING AND ZONING: Project History - The two parcels that comprise the proposed Saratoga Meadows Subdivision were originally zoned RA, Rural Areas District. An application was filed by the Frederick Mall Land Trust Corporation for the purpose of rezoning these parcels from RA to RP, Residential Performance District. The Board of Supervisors approved the rezoning of the two parcels on December 14, 1994. The approved rezoning included proffers which offered $4,148 per building lot which would be payable when the building permit was issued. This money was offered to offset the capital costs associated with public school, regional parks, and emergency services. A Master Development Plan was subsequently approved for the Saratoga Meadows Subdivision on December 15, 1994. This plan was approved for 42 single family detached traditional lots with minimum lot sizes of 15,000 square feet. This plan addressed the entrance concerns through the alignment with County Park Drive (Route 1243), and the storm water management concerns through the creation of two on -site storm water management facilities that would be designed per the County Engineer's specifications. Subdivision Plan Comments - This proposed subdivision meets all zoning and subdivision ordinance requirements, and is in conformance with the approved master plan. There are several platted lots in this subdivision that will have long and narrow or very restrictive building footprints available. More specifically, these would include lots 10, 11, 24 and 27. This is caused by the shape and location of the lots. Although we cannot prevent the platting of these lots, it is important to point out this deficiency because these lots usually become a problem and beg for variances. Staff concurs with the County Engineer proposed restrictions and requirements pertaining to basement restrictions and fill recommendations. Also, a drainage easement plat across the Riggleman property will be required prior to final administrative approval of this development. You indicated this was incorrect and would resubmit revised plans. When receiving your second submittal on Monday, October 2nd I found the internal street pavement design has been accurately revised. However, the approved design within the Route 657 right-of-way has also been changed. In addition the invert elevations I originally asked for have not been provided. It is my understanding from Mr. Mike Perry of Perry Engineering Company, Inc. he intends to start paving operations in the project this Thursday, October 5th. For the salve C ilieeting their paving schedule we will approve the 2" of SM-2A Asphalt Concrete on the internal streets with the understanding you will revise the plans to accurately reflect the previously approved pavement design within the Route 657 right-of-way. Also a prime coat with the following application rate will be required: CRS-2 at 0.35 gal./s.y. with No. 78 Cover Aggregate at 25 lbs./s.y. Also the invert out elevation shown on Sheet No. 3 (drainage profile "C") is 683.45, but the bottom of the S.W.M. basin appears to be 682.0. A minimum 30' vertical curve is needed at the sag of Saratoga Drive at Station 00+38+. 5. A ditch with 20' straight drainage easement is needed through the Riggleman Lot. The 18" pipe under Route 656 may need to be upgraded depending on pre and post - development flows to this pipe. The stormwater management calculations discuss a 17.95 acre pre and post -drainage area. It appears however areas such as Lots 30 through 33 are being diverted to Stormwater Management Basin "B" and then to the 18" pipe. Therefore, calculations need to discuss these smaller subareas. Additional information will need to be shown on the plans and discussed in the drainage calculations. We recommend ditch "B" be eliminated if possible to reduce the amount of acres diverted. 6. Ditch "B" and "G" and ditch "A" and "E" should be adjusted and additional easements provided to ease the transitions. 7. We suggest you explore eliminating ditch "A" and keep drainage flowing through Lot 12 and merge with ditch "C" at Lot 24/25. As shown, ditch "A" reroutes water around the back of Lots 25 through 27 and results in a flat bottom ditch with future houses down slope from the ditch. Also, additional detail will need to be provided on the berm designs. 9. To remain consistent, all storm sewer and cross pipes within the development will need to be reinforced concrete. 10. Additional information is needed for Structure #F-1 and its downstream pipe. 11. Toe ditches with details are needed around Stirrup Cup Circle. 12. A 10' drainage easement is needed along Lot 1. 13. The existing shoulder and ditch along the south side of Route 657 from Saratoga Drive to the east end of the subdivision (SWM Basin "A") will need to be reconstructed. A minimum 8' shoulder and minimum 4' ditch will be required. As shown, the 18" pipe under Saratoga Drive has insufficient cover. The pipe and outfall ditch need to be lowered. A typical section of the proposed shoulder and ditch tieing into the existing Route 657 pavement edge needs to be shown. Also, a detail is needed of the two pipes in relation to the right-of-way line at the outfall of basin "A". 14. The typical section ditch slope will need to be revised to 3:1. 15. Underdrains will need to be provided at all sags in grade. 16. The pavement design for all internal streets will need to be a minimum 8" 21-B Aggregate with a prime and double seal surface treatment. The pavement design of the Route 657 right turn lane and taper and Saratoga Drive connection to approximate Station 0+70 should match the existing Route 657 pavement design with a minimum 8" of 21-B Aggregate and 2" of Type SM-2A Asphalt Concrete provided. A typical section of the proposed right turn lane and taper will be required. 17. Access to Lots 38 and 42 will be required from internal streets rather than directly from Route 657. Also, the entrance serving the existing dwelling on Lot 1 will need to be upgraded to Standard PE-1 Specifications or an entrance provided onto Saratoga Drive. 18. Additional detail of the proposed waterline crossing within the Route 657 right-of-way will need to be provided. 19. Standard VDOT stop signs will be required at all appropriate locations. Private entrances will be installed in accordance with our Standard PE-1 Specifications. This is the developer's responsibility. Any signs to be installed will be in accordance with attachments. I suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled completely with C.R. Type 21-A Stone.
