15 For your REVIEW COMMENTS:
1. The approach grade of Ridgefield Avenue with Route 277 to be revised for a better landing as
noted oft the plans. A minimum 50' flare radius is required at this intersection. Due to the
traffic volume on Route 277, it would be advisable to also consider a turn lane,
2. The vertical curves on Ridgefield Avenue, Woodside Drive and Linwood Court to be lengthened
as noted to improve__the vertical sicht distance.__
3. A temporary turn around is required at the end of Ridgefield Avenue where construction termin-
4. A minimum radius of 35' is required for all cul-de-sac streets.
5. Ali roadway ditches to be protected from erosion by use of sod, jute mat or concrete paved
ditch where the grades dictate the need for this.
6. Standard CD underdrains and erosion control stone to be provided as noted.
7. The 24" pipe at Station 6+40, Ridgefield, to be increased to a 30" size.
$ An additional storm drainave easement is required as noted on the Flans at the end of Glenoak
Court and along the northwe t boy9dary line parallel with the sanitary sewer easement.

1977, by and between Harry F. Stimpson, Jr. and Margaret B.
Stimpson, his wife, and Harry F. Stimpson, III and Doris B.
Stimpson, his wife, hereinafter called Owners.
WITNESSETH: That the platting and dedication of Section
One of "Ridgefield" (including Lots 1 through 49) as shown on
the plats prepared by Walter L. Phillips, Incorporated, Civil
Engineers, Land Surveyors and Planners, dated
1977, attached hereto and incorporated herein in full by this
reference, is with the free consent and in accordance with the
desire of the Owners, the said land being a portion of the same
realty conveyed to Harry F. Stimpson, Jr., Margaret B. Stimpson
and Harry F. Stimpson, III by deed from The Brumback Heirs, Inc.
dated July 16, 1973, and duly recorded in the Office of the Cler
of the Circuit Court of Frederick County, Virginia, in. Deed Book
413, at Page 303, said land lying in Opequon Magisterial District[,
Frederick County, Virginia.
As provided by § 15.1-478, Code of Virginia (1950), as

with the plats attached hereto, shall operate to transfer in fee
simple to the County of Frederick such portion of the premises
platted as is on such plat set apart for public streets which are
hereby dedicated to public use in such manner as to create a

The lots contained in this subdivision are subject to the
following covenants and restrictions which shall be considered
covenants real, running,with the land, for the protection of
the owners of all of the said lots and for their successors
in title and for the protection of the Owners, their heirs,
assigns and successors in title, to -wit:
1. This lot shall be used for residential purposes only.
No building shall be erected, altered, placed or permitted to
remain on this lot other than one (1) detached single family
dwelling and a private garage. No structure of a temporary
character, trailer, basement, tent, shack, barn, garage or other
outbuilding shall be used on this lot at any time as a residence,
either temporarily or permanently. A trailer or model home may
be used temporarily by a contractor during the construction and
sales period.
2. No single story dwelling shall be less than one thous
one hundred (1,100) square feet of finished space on the main
floor. No split foyer bi-level shall have less than nine hundred
thirty-five (935) square feet finished on the first level. No
tri-level shall have less than nine hundred thirty-five (935)
square feet of finished space on the upper two (2) levels. No
two-story shall have less than seven hundred fifty (750) square
feet of finished space on the first floor. This excludes porches
patios, carports, basements and attics. Any garage, carport
or car shelter, pet shelter or dog house shall be attached to
and part of the main structure. An attached closed -in garage
shall count as one-third (1/3) of its finished space in the case
of either a single story or split foyer bi-level.

4. No building shall be erected or located on any lot
nearer to the street than the set back line as indicated on
the plat of that section.-
5. No animals, livestock or poultry of any kind shall.
be kept on any lot except dogs, cats or other household pets,
provided that such excepted animals are not kept for any com-
mercial purposes, and are kept at all times under the control
and supervision of the owner.
6. No signs or billboards shall be erected, maintained
or displayed except for a sign not exceeding five (5) square
feet advertising the property for sale or rent, except in front
of a model home during use as such by a builder or developer.
The developer reserves the right to place a suitable sign at the
entrance of the subdivision at the Northeast corner of Lot No. 1
to identify the subdivision as "Ridgefield" for a period not to
exceed five (5) years.
7. No fence of any type shall be erected nearer to the
front of the lot than the front set back line as indicated on
the plat of that section.
8. No dwelling shall be placed or erected on any lot which
has an exposed exterior construction of concrete block aggregate
or cinder block above the floor level of the first floor.
9. No mobile homes or trailers shall be kept on any lot
except during the course of construction unless properly garaged.
No vehicle without a currently valid Virginia inspection wind-
shield sticker may be parked in excess of ninety (90) days on
any lot or platted street.
10. No exposed pipes or vents may be used on the exterior
of any dwelling in connection with a fireplace without a brick
or other suitable covering.
11. Any building commenced on a lot shall be completed
within eighteen (18) months..
12. Unimproved lots must be kept free of undergrowth, brush,
trash and debris. Grantor reserves the right to remove same
after ten (10) days' notice to the lot owner by registered or

1. January 17, 1979 - Planning Commission Hearing and approval."
2. January 24, 1979 - Board of Supervisors Hearing and approval
with conditions that entrance location be changed to service
road adjacent to site.
3. March, 1979 —Board of Supervisors Hearing — Request from Scully
site plan be allowed to remain as submitted with no entrance
modifications. Request denied.
4. September 1979 - Meeting with Scully, Pangle and Riley on site
plan. Messrs. Pangle and Riley noted Mr. Scully's problem with
S-5 paving and allowed Scully to use double prime and seal
application until all construction work is completed. Scully's
request for entrance off Route 277"discussed: Messrs. Riley
and Pangle advised Mr. Scully that if he desired entrance off
Route 277, he would have to file a modified site plan requesting
the same before the Board of Supervisors.
5. November 1979 - Upon site inspection by Mr. Pangle, it was
discovered that entrance -had been constructed in violation of
approved site plan. Mr. Scully came before the Board of Super-
visors and requested modification of site plan and was denied.
6. December, 1979 —Counsel for Mr. Scully appeared before the Board
to request compromise of Board's decision .until the applicant
could seek a determination from the courts. This request was
denied by the Board of Supervisors.

Dear Mr. Berg:
Transmitted herewith are five sets of the revised plans and
nine prints and one reproducible of the plat for final approval of
reference project. Comments transmitted to us have been incorporated
into these plans with the following exceptions:
1. Along the east property line a wide easement providing
for storm sewer and natural drainage has been provided
in lieu of the 20 foot uniform easement which was
marked on the plat. This office has performed flood -
plain studies and have placed the easement in a
position that the natural drainage of the major water-
way will not be obstructed.
2. The Highway Department indicated roadside ditches
stabilized in the form of concrete, jute mesh, or sod.
We have performed hydraulic calculations which
indicate that sod is sufficient in the areas so marked
on the plans. We are including, for their information,
a copy of these calculations.
We trust that with these revisions speedy approval of the plans
can be obtained.

Larry Ambrogi and I discussed the matter of Ewings Lane. lie agreed
with your conclusion that we would be involved with 'parties unknown". He
also advised me that there is no county power for a "quick take" in this case.
As things stand, the design of Ridgefield Subdivision must go for-
ward without Ewings Lane. This will mean that sixty feet (60') of right--of-
way must be provided to the properties to the South of Ridgefield and the
Meadows.
From ray discussions with Bob north, it would appear that this is
no problem.

I enclose the finish -up of the memo, most of which was hand delivered
to you yesterday. A copy of the entire memorandum is enclosed to Harry
with his copy of this letter.
From the work I have done since you and I talked late Wednesday, I am
now convinced of the tentative conclusion I stated to you then. To try to
deal with Ewings Lane will involve dealing with PARTIES UNKNOWN which will
prolong any procedure unless the Lane is condemned and, unless the County
enjoys the "quick take" power granted the State Highway Commissioner (and
without checking, I think it does not), some delay would be involved anyway.
Therefore, on behalf of the landowners, I seriously request that we be
allowed to proceed with Ridgefield Avenue being entirely within land under
the control of the Stimpsons.

used Ewings Lane but this has since been abandoned in favor of access gained to
the West of the Ritenour place by the service road which runs down the side of
Route 81.
Therefore, in answering the question posed here, I have made the assumption
that there is no granted right of way and that the rights to the Lane were,
therefore, acquired by Racey's predecessor, Mr. Ewing, at some time prior to 1900.
From an examination of Deed Book 113, Page 400, and the plat attached at Deed Book
113, at Page 403, we see that the division line of properties along Ewings Lane
was its Western boundary so that the owner of the property to the East was the
owner of the fee simple interest in Ewings Lane. This being so, as regards the
approximately 1150 feet of Ewings Lane adjacent to The Meadows, a reasonable
construction of the deeds in the chain of title to that property would lead to
the conclusion that the underlying fee simple ownership of Ewings Lane was
conveyed into Lemley Bros. in Deed Book 125, Page 511, but that when Lemley Bros.
conveyed the property out to Stickleys in Deed Book 131, Page 115, only that
portion of the property East of the Lane was conveyed. On this hypothesis, the
Lane now belongs to the heirs, devisees and successors in title to the Lemley Bros.
I have not addressed the question of ownership of the fee simple interest of
Ewings Lane along the Western side (approximately 305 feet) of the 2.421 Acre
tract conveyed by Fake to Fredericktowne in Deed Book 362, Page 553.
WHO ARE THE SUCCESSORS TO THE LEMLEY BROTHERS?
See family tree attached. This is the product of an afternoon's work by two
people in the Clerk's Office and is, as you see, incomplete. I have not pursued
it further because I think you would have to be proceeding against PARTIES UNKNOWN
anyway.
The necessity for joining PARTIES UNKNOWN is that I have traced the title to
the Fake Lot back to the early 1700s in an attempt to determine who is the owner
of the fee underlying that portion of Ewings Lane abutting the Fake lot on the
West, without success.

MEMO TO FILE RE EWINGS LANE:
THE MEADOWS traces back to a 30 Acre tract which was part of No. 6 in 113/400
dated 12/13/94. The plat attached to that partition decree shows Ewings Lane as
existing on and along the Western boundary of that tract. Subsequent conveyances
in the chain are as follows:

FAKE LOT - 2.421 ACRES fronting Route 277. This lot acquired by Fredericktowne
at about the same time the above 30 Acre tract was acquired from Stickley. At no
time in the chain of this lot back to 1914, however, is it said to include Ewings
Lane, the descriptions usually containing language to the effect that it borders
"... along a private lane on the West". The chain is set forth in the handwritten
notes attached to this memo.
WHO HAS THE RIGHT TO USE THE LANE?
Robert W. Racey acquired 136 1/2 Acres in 1942 with no mention of a right of
way. In a conversation with his son on February 10, 1977, the son confirmed (a)
that there was no known granted right of way, (b) that it was his understanding that
it just became an old farm road a long time ago, (c) that his house had been there
he reckoned about 100 years, (d) the only other user of the Lane was Mr. Scothorn
and his son, both of whom reside in residences (one old farmhouse and one new brick
house) on the Scothorn Farm and (e) that years ago the Ritenour Farm beyond Scothorn
used Ewings Lane but this has since been abandoned in favor of access gained to
the West of the"Ritenour place by the service road which runs down the side of
Route 81.
Therefore, in answering the question posed here, I have made the assumption
that there is no granted right of way and that the rights to the Lane were,
therefore, acquired by Racey's predecessor, Mr. Ewing, at some time prior to 1900.
From an examination of Deed Book 113, Page 400, and the plat attached at Deed Book
113, at Page 403, we see that the division line of properties along Ewings Lane
was its Western boundary so that the owner of the property to the East was the
owner of the fee simple interest in Ewings Lane. This being so, as regards the
approximately 1150 feet of Ewings Lane adjacent to The Meadows, a reasonable
construction of the deeds in the chain of title to that property would lead to
the conclusion that the underlying fee simple ownership of Ewings Lane was
conveyed into Lemley Bros. in Deed Book 125, Page 511, but that when Lemley Bros.
conveyed the property out to Stickleys in Deed Book 131, Page 115, only that
portion of the property East of the Lane was conveyed. On this hypothesis, the
Lane now belongs to the heirs, devisees and successors in title to the Lemley Bros.
I have not addressed the question of ownership of the fee simple interest of
Ewings Lane along the Western side (approximately 305 feet) of the 2.421 Acre
tract conveyed by Fake to Fredericktowne in Deed Book 362, Page 553.

, We are returning one copy of the preliminary site plan for Ridgefield
Subdivision which has been reviewed by our District Office.
The layout and horizontal design of the streets appear satisfactory,
however, we have made some comments and recommendations on the plans
concerning drainage easements. Generally a 30' width is required where a
utility such as a sanitary sewer shares the drainage easement. The
drainage easements should follow as nearly as possible the existing flow
to avoid unnecessary ditching.
Additional drainage easements may be required or adjusted after we
have had the opportunity to review the drainage and construction plans
and make a field study.
If there are any questions, please advise.

Dear Bob:
I have"received preliminary approval of subject subdivision from zoning, and the
Virginia Department of Highways and Transportation. The Frederick County Sanitation
Authority has also approved, subject to noted changes on the enclosed plan. I have
not received approval from the Engineering Department due to the questions on the
lane that serves rear properties, and a 100-foot bust in your boundary survey. I
have also not heard from the attorneys on the responsibility for this lane.
The difficulty with the survey, I am sure, can be corrected by the surveyor who
drafts the final plat. I also advise planning to move Ridge Field Avenue to the East
to use the existing right-of-way, and restoration of the 15-foot right-of-way along
the back lots -- 84 and 87-91.
You may consider this letter as approval for the preliminary plan, subject to
the requested changes. If you wish to submit another preliminary, it would be
perfectly acceptable, but not required.

The Chairman called the meeting to order. The first order of business,
corrections and approval of the minutes of the previous two meetings, August 15, 1979
and August 21, 1979. Corrections were as follows:
Page 11 - the to then in third paragraph.
Page 2 - anyone's request should be changed to the owner's request.in second
line.
Page 5 - change assessment in second paragraph to reassessment. (NOTE:
assessment will be used on new properties and anything existing at

ACTION- Approved
Mr. Riley then ccnvented on background information, noting that central water
and sewer service will be available," dependent upon the developer or other installing
lines to serve the lots within the industrial park, with availability of service in late
November of 1979. Mr. Riley also noted that Zoning found difficulty with the Site Plan
showing only a 2.5 acre parcel of the total 5 acre tract. Mr. Riley continued, noting
that a.revision is needed to the Site Plan showing the entire acreage.
Mr. Art Judd then came forward and introduced himself to the Commission, comnenting
that he had brought revised Site Plans with him. Mr. Judd further explained that Bulbs
International functions as importers of products for distribution to automotive and motor-
cycle markets.
In answer to Chairman Gordon's question regarding acreage, Mr. Judd explained that
it is a five acre lot as it stands now, with a purchase agreement with the Gilpins to sell
back 2.5 acres if the Gilpins are allowed to subdivide. Mr. Judd noted that they will

at the rear of the property.

Mr. Berg told the Commission there had been a public hearing held on this
amendment at the meeting of July 6, 1977, however, the Commissioners did not
feel comfortable with the wording. He said he had spoken with someengineers
that specialize in the area of noise and they had suggested the following:

Mr. Berg presented the Ridgefield Subdivision, Section I consisting of 49 lots
and stated that all approvals had been received. He stated that the Planning
Commission recommended approval of this subdivision, with a recreational impact fee
of $111 per lot.
Mr. Harry F. Stimpson, Jr. appeared before the Board in support of his sub-
division and assured the Board that there would be no problem with right-of-way
to the property located behind the subdivision and that the roads would be built
to state secondary roads standards.
Dr. Fish asked why there was an un-numbered lot shown on the plat and Mr.
Stimpson stated that this was obviously a misprint and should be numbered 39.
Upon motion made by Will L. Owings and seconded by Dennis T. Cole,
BE IT RESOLVED, That the Board of Supervisors of the County of Frederick,
Virginia, does herein approve Ridgefield Subdivision, Section I containing 49

appeared before the Board and stated that they could see no problems with

Mr. Koontz asked if this property had been included in the survey con-

Section I is forty-nine (49).lots. Mr. Stimpson stated that the sixty foot (601)
right-of-way would be beside Ewings Lane and the two roads would tie in together
at the rear of the property.

Mr. Berg told the Commission there had been a public hearing held on this
amendment at the meeting of July 6, 1977, however, the Commissioners did not
feel comfortable with the wording. He said he had spoken with some-
engineers
that specialize in the area of noise and they had suggested the following:

RIDGEFIELD, SECTION I = OPEQUON MAGISTERIAL DISTRICT - APPROVED
Mr. Berg presented the Ridgefield Subdivision, Section I consisting of 49 lots
and stated that all approvals had been received. He stated that the Planning
Commission recommended approval of this subdivision, with a recreational impact fee
of $111 per lot.
Mr. Harry F. Stimpson, Jr. appeared before the Board in support of his sub -
,division and assured the Board that there would be no problem with right-of-way
to the property located behind the subdivision and that the roads would be built
to state secondary roads standards.
Dr. Fish asked why there was an un-numbered lot shown on the plat and Mr.
Stimpson stated that this'was obviously a misprint and should be numbered 39.

Mr. John Riley presented the plat of Ridgefield Subdivision, Section
II stating that it included 53 lots in the Opequon Magisterial District
and that all approvals have been received. He advised that he had received
this date some recommendations from the Highway Department setting forth
some erosion control which he felt could be handled administratively through
the staff.
Yr. Harry F. Stimpson, Jr. and his attorney, Mr. William A. Johnston
appeared before the Board and stated°that they could see no problems with

Mr. Koontz asked if this property had been included in the survey con-
ducted by the Sanitation Authority regarding. -::the capacity -,df .the r: lai t and
Mr. Stimpson advised that it had been and he had signed a contract in 1974
for 165 connections; that Section i contained 49 lots and this section will
contain 53 lots.

REQUEST FOR SECONDARY ADDITION
BE IT RESOLVED, That the Board of Supervisors of the County of
Frederick, Virginia, does herein request the Virginia Department of
Highways and Transportation to accept into the secondary road system
the following roads in Ridgefield Subdivision, Section 1 in Opequon
Magisterial District, pursuant to the provisions of .Section 33.1 -
229 of the Code of Virginia, 1950, as amended:
Ridgefield Avenue - from Linwood Ct. to a point approximately 870'
South (.165 miles).
Woodside Drive - from Ridgefield Ave. to cul-de-sac approximately
960' West (.132 miles).
Glen Oak Court - from Woodside Drive to cul-de-sac approximately 330'
South (.063 miles).
BE IT FURTHER RESOLVED, That this Board does guarantee the
Commonwealth of Virginia an unrestricted right-of-way of sixty (60)
feet with necessary easements for cuts, fills and drainage recorded
in Deed Book 482, Page 265, dated October25, 1977 and,
BE IT FURTHER RESOLVED, That this request is contingent upon the
posting of a proper and acceptable bond with the Virginia Department
