THIS DEED, made this (z, day of October, 1998, by
and between CHARLES S. McCANDLISH, Receiver of the property of
Alma B. Rhinehart, herein Grantor, and Frederick County.
Virginia, herein Grantee,
WITNESSETH:
WHEREAS, Charles S. McCandlish, Receiver, was
appointed Receiver of the property of the Alma B. Rhinehart and
Paul E. Rhinehart, Jr., by Order of the Circuit Court of
Frederick County, Virginia, entered September 29, 1992, and
under that and subsequent Orders is empowered to sell such
property to accomplish certain objectives,
NOW THEREFORE, for and in consideration of the sum of
Four Thousand Five Hundred Dollars ($4,500.00), cash in hand
paid to the Grantor, the receipt of which is hereby
acknowledged, and other good and valuable consideration, the
Grantor does grant, bargain, sell and convey, with Special
Warranty of title, unto the Grantee, together with all
improvements and appurtenances thereunto belonging, but subject
to all duly recorded and enforceable restrictions, easements and
rights of way, the following property:
All of that certain lot or parcel of land, with
any improvements thereon and appurtenances thereto
belonging, lying and being situated on Virginia
Secondary Route 809 in Frederick County, Virginia, as
more particularly described as "Parcel B" on that
certain plat and survey drawn by S. W. Marsh, L.S.,
dated June 8, 1998, attached hereto as Exhibit A and
by this reference made a part hereof; and being the
same property conveyed to and being the same property
conveyed to Paul E. Rhinehart, Jr., and Alma B.
Rhinehart, with right of survivorship, by deed dated
September 5, 1973, and recorded in Deed Book 417 at
Page 127, among the land records of Frederick County,
Virginia, and by deed dated October 15, 1973, and
recorded in Deed Book 419 at Page 145, among the same
land records. The said Paul E. Rhinehart, Jr. has

since died, leaving as his sole heir the said Alma B.
Rhinehart, and therefore vesting title in said
properties in her, and therefore in the Receiver, the
Grantor herein.
As part of this instrument the Grantor herein consents
to the boundary line adjustment as set forth in Exhibit A, so as
to create the parcels A and B as reflected thereon.
EXPRESSLY RESERVED from this conveyance for the use of
the Receiver, the said Alma B. Rhinehart, and their successors
and heirs, is an easement fifty feet (501) in width to provide
ingress and egress extending from Virginia Secondary Route 809
to the remaining property of the Grantor, described as Parcel A
on Exhibit A hereto.
