Dear Mr. Gyurisin:
I am in receipt of your letter dated December 20, 2001, in which you have requested a waiver to the
County's master development plan requirement for the Redoubt Lane Subdivision residential development
project. Specifically, the project proposes the subdivision of Tax Parcel 53-A-4, zoned RP (Residential
Performance) District and containing 11.112 acres to establish four new tax parcels. Three of the new
tax parcels are for the purpose of new residential building lots, while the fourth tax parcel will contain an
existing residential use.
The Redoubt Lane Subdivision proposes less than ten (10) single-family dwelling units, is not an integral
portion of a property planned for future development, is harmonious with surrounding properties, does
not impact the County's comprehensive transportation plan, nor does it substantially affect the purpose
and intent of the RP (Residential Performance) District. The master development plan waiver request for
this project is consistent with the requirements of Section 165-134 of the Frederick County Zoning
Ordinance; therefore, our department will grant this request.
Please be advised that the waiver of the master development plan for this project does not exempt
Redoubt Lane Subdivision from any site design or site development requirement specified in the Frederick
County Zoning Ordinance, the Frederick County Subdivision Ordinance or any additional requirements
of the Planning Commission and the Board of Supervisors.

It appears all of our earlier review comments have been satisfactorily addressed. Please advise
the owner of our approval. Also please provide seven (7) sets of approved construction
plans with signed seal for VDOT distribution.
The approved plans should incorporate the comments discussed by telephone on
December 18, 2001.
The appropriate land use permit may now be applied for to cover work within the Route 739
right-of-way. The permit is issued by this office and will require a minimum processing fee,
surety bond coverage, and the salary & expenses of a State assigned Inspector.
Once satisfactory application has been made, a permit will normally take approximately thirty
days to process and issue. Should you have any questions, do not hesitate to call.

Exception to the Provisions of the Subdivision Chapter Request
Dear Evan:
Please find enclosed all materials necessary for submission of application for subdivision
of the 11.112 acres zoned Residential Performance (RP) located at 248 Redoubt Lane
(Tax Map number 53-((A))-4 into four (4) lots.
The planned, exclusive subdivision will created four lots with three new homes. There is
a large, existing home that is located on one of the planned lots. Each lot is 100,000
square feet or larger (over two acres each). We believe that this site is best suited for
large, exclusive single family home lots rather than the typical pattern of development that
has a higher density such has town homes or small lots. Our preliminary evaluation of this
site suggests that 30 to 70+ lots of a higher density residential use is permitted and can be
accomplished.
In accordance with our discussions in November, we understand that this plan is eligible
for waiver of the Master Development Plan (MDP). We, therefore, request that you waive
the Master Development Plan (MDP) requirement due to the number of planned lots as
outlined in Section 165 -134 A of the Frederick County Zoning Ordinance. The property
is zoned Residential Performance (RP) contains less than ten lots, is not part of a property
planned for future development, is being developed with single family homes that is
harmonious with surrounding properties and does not affect the intent of the zoning district.
The planned, exclusive, single family home, large lots provide a land use density that has
the least amount of traffic impact upon the surrounding properties. With this in mind we
request a variance or exception to the provision of the Subdivision Ordinance in
accordance with Section 144-5 to allow the existing lane to remain to serve the existing
and planned homes.
We have consulted with the Virginia Department of Transportation (VDOT) and have an
approved design that will provide necessary improvements at the intersection of Fox Drive
and Redoubt Lane.

Thanks for your time yesterday and your help with this subdivision. Due to the holiday,
we have not yet finished our evaluation of all of the lots to assure the Planning
Commission that we can adequately provide private septic systems for each lot. We have
made the adjustments to the plans (plats) and have delivered revised copies to your
office. Should you require any additional or revised plans, please call. You should be
ready to proceed to the Planning Commission once we have final determination for each
lot from the Health Department evaluation.
This property is zoned RP.
We are interested in your opinion or the staffs recommendation regarding our waiver
request of the Master Development Plan and our request for the three additional lots to
be served by the existing lane. Please let me know of any issues that you and your staff
may have as we finish the requirements for the septic systems.

These comments are based on our understanding that this subdivision will be
served by a private road that will not come into the States Secondary System.
The application for subdivision of this property appears to have a measurable
impact on Route 739, the VDOT facility which would provide access to the property.
This section of street is currently not in the State's Secondary Road System.
Currently, a private drive serves at least six existing residences. The addition of
three new lots will add up to thirty additional trips per day to the Route 739
entrance. The current access to Route 739 must be upgraded to meet VDOT's
minimum private subdivision street entrance standards.
All entrance design and drainage features must meet State requirements. A
complete set of construction plans will be required for review.

RE: West Redoubt Lane Subdivision — Request for Waiver
Dear Eric:
As you are aware, Steve Gyurisin of Triad Engineering, Inc. has been working on my behalf to
secure County approval to "subdivide" the 11.11 acres I own at 248 West Redoubt Lane, off of
Fox Drive, in the Stonewall Magisterial District. In addition to my current homesite, I would like
to plat out 3 additional lots 100,000 square feet or more in size. This would allow for the
building of 3 additional upscale high end homes on this RP zoned property. I very much
appreciate your time and efforts on this relatively small project and would like to wrap it up
before the end of the year and clear it off your plate.
It is my understanding that Planning Commission and Board of Supervisors approval is required
to permit the waiver of the VDOT road requirement. I further understand that the project was
reviewed by the Technical Review Committee on October 11, 2001 and received their okay. It
was confirmed at that meeting that the town homes in the vicinity have no access to my private
road, that the existing entrance is excellent (and paved) for this small subdivision and VDOT
gave its approval for the private entrance. As I have stated before, retention of the "country lane
effect" is very important for the privacy and enjoyment of the residents.
Please let me know if there are any loose ends I need to tie up before the Planning Commission
meeting on December 5th or the Board of Supervisors meeting on December 12th. I will of course
plan to attend both meetings and be available to answer any questions that the Commission or
Board may have at that time.

This letter is in response to your request for comments concerning the planning
application for rezoning property located at 248 W, Redoubt Lane, Winchester, VA 22603.
Based on the information provided, it is anticipated that three new residences will yield two new
students. The 2001-2002 projected per pupil cgst is $7,125, of which $3,306 comes from local
revenue.
Residential growth in this portion of Dederick County has resulted in the schools serving
this area having student enrollment near or exceeding their design capacity. The existing RP
zoning does allow for high density housing that could have a great impact on public schools.
The cumulative impact of this project and others of a sunilar nature, coupled with the number of
approved, underdeveloped residential lots in the area, will necessitate the future construction of
new school facilities to accommodate increased student enrollment. The impact of this
subdivision on current and future school needs should be considered during the approval process.

Dear Evan:
Please find enclosed all materials necessary for submission of application for subdivision
of the 11.112 acres zoned Residential Performance (RP) located at 248 Redoubt Lane
(Tax Map number 53-((A))-4 into four (4) lots.
The planned, exclusive subdivision will created four lots with three new homes. There is
a large, existing home that is located on one of the planned lots. Each lot is 100,000
square feet or larger (over two acres each). We believe that this site is best suited for
large, exclusive single family home lots rather than the typical pattern of development that
has a higher density such has town homes or small lots. Our preliminary evaluation of this
site suggests that 30 to 70+ lots of a higher density residential use is permitted and can be
accomplished.
In accordance with our discussions in November, we understand that this plan is eligible
for waiver of the Master Development Plan (MDP). We, therefore, request that you waive
the Master Development Plan (MDP) requirement due to the number of planned lots as
outlined in Section 165 -134 A of the Frederick County Zoning Ordinance. The property
is zoned Residential Performance (RP) contains less than ten lots, is not part of a property
planned for future development, is being developed with single family homes that is
harmonious with surrounding properties and does not affect the intent of the zoning district.
The planned, exclusive, single family home, large lots provide a land use density that has
the least amount of traffic impact upon the surrounding properties. With this in mind we
request a variance or exception to the provision of the Subdivision Ordinance in
accordance with Section 144-5 to allow the existing lane to remain to serve the existing
and planned homes.
We have consulted with the Virginia Department of Transportation (VDOT) and have an
approved design that will provide necessary improvements at the intersection of Fox Drive
and Redoubt Lane.
