WHEREAS, the Declarant is the owner in fee simple of the real estate shown on that certain subdivision plat drawn by P. Duane Brown, L.S., dated July 22, 2003, known as Ravenwing Section 4, which final plat is attached hereto and incorporated herein by reference, as if set out in full. This is a portion of the same real estate previously conveyed to the DECLARANT by that certain deed dated July 18, 2003 from Jeni Company, a Virginia Corporation, which deed is recorded in the Office of the Clerk of the Circuit Court of Frederick County, Virginia as Instrument No. 030015860; and, WHEREAS, said real estate as shown on the aforesaid attached final subdivision plat has been subdivided into lots for the construction of single family homes thereon (Lots 192 through 257 inclusive) and the hereinabove final plat shows accurately the metes and bounds of the subdivided land, together with the dimensions of each lot thereon and also shows certain Y surrounding lands in said subdivision to be used as public streets, open space, sanitary sewer easements, utility, ingress/egress, drainage and signage easements, all of which shall constitute a portion of that o Ut development known as Ravenwing Section 4. Those areas that are marked -_j as common areas are to be owned and/or maintained by the Ravenwing Homeowner's Association, Inc., upon the terms and conditions as set forth hereinafter. WHEREAS, the Subdivision of RavenWing, Section 4, as shown on the aforesaid attached Final Subdivision Plat, is with the free consent and in accordance with the desires of the undersigned DECLARANT, and the DECLARANT further desires to subdivide the aforesaid real estate in accordance with the provisions of "The Virginia Land Subdivision Act" as are applicable and in force and effect as of the date of execution of this Deed of Dedication. NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That for and in consideration of the premises and the benefits which will accrue by reason of this Dedication, the DECLARANT does hereby subdivide all of that certain tract or parcel of land designated as RavenWing, Section 4, lying and being situate in the County of Frederick, Virginia, and being more particularly described by that certain Final Subdivision Plat of RavenWing -2- Subdivision, Section 4, by P. Duane Brown, L.S., dated July 22, 2003, (containing Lots 192 through 257, inclusive) which Final Subdivision Plat is 0 attached hereto and incorporated herein as if set out in full. Ln cry FOR AND IN CONSIDERATION AS AFORESAID, the DECLARANT does further dedicate all of the streets in RavenWing, Section 4, to Frederick County, Virginia for public use, which streets dedicated hereby are more particularly described by the hereinabove referenced Final Subdivision Plat of RavenWing, Section 4. PROFFERS: RAVENWING SECTION 4 IS A NON PROFFERED SUBDIVISION. ACTION PURSUANT TO ARTICLE II OF THAT CERTAIN DEED OF DEDICATION DATED MAY 31, 2000 AND RECORDED IN THE AFORESAID CLERK'S OFFICE IN DEED BOOK 971, PAGE 0045 WHEREAS, a Deed of Dedication dated May 31, 2000, recorded in the aforesaid Clerk's Office in Deed Book 971 at page 0045; and, WHEREAS, the aforesaid Deed of Dedication placed or created certain conditions, covenants, restrictions and easements with regard to Lots 1 through 80 of the Ravenwing Subdivision, Section 1; and, WHEREAS, Article II thereof provides for additional land to be annexed and/or added to the Ravenwing Section 1 subdivision; and, -3- WHEREAS, the Declarant desires to annex additional land to the Ravenwing Subdivision Section 1 and extend the scheme of the conditions, 0 covenants, restrictions and easements of the Deed of Dedication, cn J t1© hereinbefore mentioned, to the herein described property. NOW THEREFOR WITNESSETH: That the Declarant does hereby agree to the annexation of and does add as a part of the Ravenwing Subdivision Section 4 consisting of those certain lots 192 through 257 inclusive; and all other lands shown in connection therewith, as set forth on that certain plat of subdivision dated July 22, 2003, by P. Duane Brown, L.S., which plat of subdivision is attached hereto and incorporated by this reference. AND FURTHER, that the Declarant does further agree to the incorporation of the provisions of the aforementioned deed of dedication and does hereby impose upon lots 192 through 257, Ravenwing Section 4, any and all provisions of the Deed of Dedication hereinbefore referenced, as if the same were set forth in full herein; and, The Declarant does further declare that the existing Ravenwing Homeowners Association, with its rights, duties, obligations and responsibilities shall be the proper entity to act in connection with the land annexed herein; and, M PROVIDED HOWEVER, pursuant to Article 2 Section 3 of the Deed of Dedication the Declarant does amend Article 6 Section 3 with regard to the land annexed, to read as follows: Section 3, Basis and Maximum of Annual Assessments Until October 1, 2003, The maximum annual assessment shall be $150.00 per lot for all lots (192 through 257) inclusive in Section 4, Ravenwing Subdivision and further; DOES amend Paragraph 17 of ARTICLE 7: All of the covenants and restrictions shall be binding and remain in full force and effect for a 10 year period, which shall run from the date of the original Deed of Dedication aforementioned. Provide a lot grading plan for the entire subdivision. Provide proposed house elevations, final grades, etc. An as -built plan of the subdivision shall be submitted to our office prior to issuance of any building permits to ensure compliance with the approved plan. Provide benchmarks within the subdivision for the builders once housing construction commences. 2. The proposed stormwater pond outlet structure is not recommended. Long-term maintenance issues (i.e. clogging) will make the proposed pond outlet ineffective. Provide an outlet structure that would eliminate the potential for clogging. Provide post -developed velocities from the outlet structures within the analysis. Also, provide an analysis and as -built conditions of the area downstream of the pond to ensure that an adequate channel exists in accordance with minimum standard 19 based on storm releases from the proposed outlet structure. A drainage easement is recommended since concentrated storm flows are still being released onto the adjacent property. 3. Provide calculations, grading plans and details of all the sediment traps in accordance with VESCH standard 3.13. 4. The stormwater narrative indicates that the existing pond adjacent to lots 188 and 189 will remain. Anytime an existing pond is used within a development, a through review of the pond and the outlet structure is required. Provide a post -developed analysis and as -built survey of the pond. A storm structure may be required to ensure the pond can pass a 10 and 100 year design storm without overtopping or failure. Price You will find enclosed two sets of Subdivision Design Plans, three copies of the Erosion and Sediment Control Narrative with the stormwater calculations, and the Subdivision Checklist for the next 66 lots at RavenWing. Section IV is located on the north side of Dewberry Drive, which is being constructed as part of the RavenWing Section II and III Development. All access to Section IV is from Dewberry. There are no road connections to existing subdivision streets. All proposed roads are 36' FOC to FOC in 54' rights -of -way but for the four cul-de-sacs serving less than 12 lots each. Stormwater from a majority of the site drains to Abrams Creek, an adequate channel. A small portion at the end of Darby Drive drains to an existing storm sewer in Oakdale Crossing, Section II and to Fairway Estates. The storm sewer in Oakdale Crossing was sized to carry the future flows from this development. A small detention pond is provided to mitigate peak flows to the Fairway Estate lots. As part of the Section IMII design, a detailed traffic analysis was completed and pavement designs prepared for a wide range of loading conditions. All of the Section IV roads will carry less than 400 trips per day. The design prepared for those roads in Section H and III is specified in Section IV.
