Box 278 Edinburg, VA 22824-0278 Dear Bill: The purpose of this letter is to keep the ball moving toward getting the streets in the Pembridge Heights subdivision taken into the secondary road system. Since the developer is unable to acquire the necessary bonding to cause this action to go forward, Frederick County will guarantee an amount up to $30,000.00 to -repair or restore the dedicated state rights -of -way should problems occur as a result of defective materials or workmanship. This guarantee will be good for a period of one year starting from the date of the addition. I appreciate your consideration in bringing this matter to fruition rather than allowing these streets to languish. At the request of property owners in the College Park neighborhood, the applicant has revised the plans to remove a direct road connection between Pembridge Drive and Purdue Drive. The applicant has also reduced the number of lots and increased the lot sizes immediately adjacent to lots in College Park. A connection with Route 781 has been provided with the first phase. We recommend storm sewer be installed around cul-de-sacs with lot frontages of less than 52' so private entrances may be installed to our minimum standards (see attached specification sheet). 6. It is the developer's responsibility to determine the size of private entrance culverts for the entire project. Our minimum requirements are 15" in diameter and 30' in length. As we have discussed on numerous occasions we are still interested in obtaining water and sewer service for eight lots of the subdivision from the City of Winchester. We have discovered that its is feasible to sewer the eight lots at the terminous of Yale Drive through an extension of the Sanitation Authority lines. However, the eight lots on Devon Drive (adjacent to the Holiday Inn) must be served from the City. The Winchester City Council approved the extension of water and sewer lines for eight lots on Yale Drive provided that the Sanitation Authority would debit these services against their capacity at the Opequen Regional Waste Water Treatment Facility. Next week the City Council would like these services on Devon Drive. At the next Sanitation Authority Board meeting (March 20, 1989), I will request that the Sanitation Authority debit the eight services described above. Without your support, it is unlikely that such a proposal will be favorably received. I am hoping that you might attend this meeting. The Pembridge Heights property is encumbered by a drainage easement established at the time the College Park Subdivision was approved. We have provided storm drainage structures, ditches and easements to accommodate all off -site storm water run off. Our storm water drainage system replaces the natural storm drain system depicted on the College Park subdivision plats. The Virginia Department of Transportation and the Sanitation Authority have been advised that the former storm drainage easements will be vacated. Pages 8 - 11 of the final plat includes notes that indicate that these easements are to be vacated. Our legal counsel has advised that it will be necessary to have a Deed of Vacation signed by the appropriate county official to vacate a Mr. John Riley, Jr. Page 2 February 29, 1989 this easement. I have enclosed copies of the final plat and the drainage easement. Since the appropriate county review agencies have signed the plat and the Board of Supervisors has approved the same, I am hoping that formal action by the Board of Supervisors will not be necessary. To be adequate the as -built ditch should be as shown on the enclosed typical section and on a minimum 1 % slope. Therefore, it will need to be deepened and widened before we could consider adding these sections of street to the State's Secondary System. The plans included a 24" C.M.P. culvert under Summerset Drive at approximate Station 14+50 and a 24" C.M.P. under Clarendon Court at approximate Station 10+34. We recommended no changes in the size and/or location of the culverts. 2ND SITE PLAN REVIEW - JANUARY, 1989: Revised site plans were submitted dated January 9, 1989. Most earlier recommendations were addressed. However, several design changes (4ere made including the shifting of the 24" C.M.P. culvert under Summerset Drive to approximate Station 14+25. Also, the 24" culvert under Clarendon Court was downgraded to an 18" size and the location shifted to approximate Station 10+99. We had no objections to the changes in location of either pipe. However, we recommended the 18" culvert under Clarendon Court be upgraded to a 21" size. 3RD SITE PLAN REVIEW - FEBRUARY, 1989: Revised site plans dated February 1, 1989 were submitted with all of our earlier recommendations addressed. The plan was approved by this office on February 9, 1989. In addition to the above, revised plans dated May 4, 1989 were submitted which detailed unrelated drainage revisions to a drainage channel through Parcel "B" and the construction of a swale between Lots No. 5 and No. 6. Section I 201 North 23rd Street Frederick County Purcellville, VA 22132 Dear Mr. Brownell: I am writing in response to your letter of October 1, 1992 which concerned the placement of an 18" C.M.P. culvert across the front of Lots No. 139 and No. 140 which are being developed by Mr. Glen Russell. I have recently spoke by phone and met with Mr. Russell's excavator, Mr. William Morrison to review this situation. Mr. Morrison indicated the primary purpose of the continuous culvert was to enhance the appearance of the two lots by closing up the roadside ditch. While I can appreciate Mr. Russell's motives, I must also keep in mind our future maintenance responsibilities for private entrance pipe. If allowed to remain as is the length of the pipe undoubtedly will cause future maintenance problems. To compound the problem of length, the pipe also has a bend in the middle which will allow for debris to catch on and possibly clog the culvert. I must therefore restate our earlier position that the culvert be removed and the ditch line restored or Mr. Russell provide access breaks in the culvert at a minimum of 50' intervals. Regardless the bend in the culvert will also need to be straightened. Another alternative would be to provide drop inlets at various intervals to relieve roadway drainage and provide access points. In this case a design prepared by a licensed professional engineer would be required for our review. In summary I would like to remind you your approved subdivision site plans indicates all road and drainage work will be in accordance with VDOT requirements, specifications and standards. Furthermore, I have enclosed for your use a copy of Page 19, Section 3.11 of our subdivision street requirements manual and PE-1 design standard which addresses our private entrance requirements. Our position on private entrance culverts are the length can be adjusted as necessary to accommodate the width and radii of the entrance. In this instance we can see no practicable reason why a 130' ± culvert is needed for two (2) 12' entrances. We feel we have offered all we can to you and Mr. Russell to resolve the situation and hope to receive your corporation in meeting our requirements. Bushman SUBJECT: Pembridge Heights Subdivision Phase I - Frederick County We are returning one set of revised plans with our comments as follows: 1. The 18" pipe on Clarendon Court to be increased to a 21" size. 2. The existing 60" X 36" pipe arch will have to be extended due to the radius flare and additional shoulder at the intersection of Pembridge Drive and Route 781. -3. On profile sheet 4 of 10, the grade on Pembridge Drive intersection with Route 781 is to be adjusted as noted to provide a safer design for traffic having to stop as they approach the intersection. ,4. On profile sheet 6 of 10, the vertical curve at station 14 + 75, Etnam Street, to be increased to 300' to obtain a minimum 200' vertical sight distance. 5. The typical section is to be revised to show 12" depth of aggregate base course No. 21-A for Pembridge Drive. This is in accordance with the subdivision pavement design chart and anticipated traffic generated. Since the connection of Purdue Drive with Pembridge Drive has been eliminated, traffic entering or exiting Route 50 from Purdue Drive will be considerably less than previously anticipated. We hereby agree that: (a) Drafts drawn under and in compliance with the terms of this Letter of Credit will be duly honored if presented at oour office on or before December 19, 1989. (b) Funds available under this Letter of Credit may be drawn in such amounts and at such times as determined by the County of Frederick, or his designee, provided that the amount drawn shall not exceed the aggregate amount specified herein. (c) We shall have no right, duty, obligation, or responsibility to evaluate the performance or non-performance of the underlying contract between our customer and the beneficiary of this credit. (d) It is a condition of this Letter of Credit that it will be extended for an additional period of six months from the present or future expiration date hereof, unless ninety days prior to such date we will notify you in writing by registered mail that we elect not to renew this Letter of Credit for such additional period. Standard contracts for the proposed extensions will be forwarded upon receipt of the required confirmations, and upon receipt and approval of detailed engineering plans for the extensions. We are in receipt of the comments from the Fire Marshal and the Sanitation Authority. Our engineers have revised the construction plans accordingly. A letter of credit in the amount of $500,000 from Equitable Federal Savings and Loan to guarantee the completion of public improvements will be transmitted to your office this week. I have not received comments from the Highway Department. I am wondering if these comments have been forwarded directly to your - office. I will be attending the Commission meeting on Wednesday.
