I received your letter dated September 21, 2009 regarding the density at the Preston Place Development. The density
we discussed at our previous meeting is still accurate and it does not appear that additional density is available on the
site. If you need more detail please call or if you need more detail in writing you need to request a determination letter
from our department ($100 fee).

Thank you for meeting with me several weeks ago and answering my questions regarding the
allowable unit density at Preston Place. I'm writing to propose a scenario for development of
additional units on one or several of the Preston Place parcels. Presumably this would occur
through a new Master Development Plan. I would appreciate an opportunity to speak with you
further regarding the matter. Please email after you've had an opportunity to assess my
interpretation of the permitted use per the County Ordinance.
As I understand it, Preston Place was developed in three phases under a single Master
Development Plan, which originally called for 236 units. The Frederick County Ordinance sets
the maximum allowable land use density for RP zoning based on the size of the individual
parcels according to their subdivision in 1994. With Preston Place, there are three parcels
zoned RP, each with the following allowable gross densities.

By my calculations, if a new Master Development Plan were submitted for the Preston Place
parcels, the maximum allowable unit count would be 249.
Further, a density bonus is permitted for age -restricted housing allowing up to 20 dwelling units
per acre (§165-62-B). It is unclear whether this density bonus applies regardless of the size of
the parcel, but it appears that sub -sections C and D eliminate the density bonus for larger
parcels. If a portion of the Preston Place land were to be developed as age -restricted housing, a
maximum of 324 units would be permitted.
