THIS CORRECTED DEED OF DEDICATION made and dated this A4a—y of
&fv�1999 by and between FRED L. GLAIZE, III and FRED L. GLAIZE, JR.
RESIDUAL TRUST, parties of the first part, hereinafter called the "Declarant" (even
though more than one), and THE COUNTY OF FREDERICK, VIRGINIA, party of the
second part, hereinafter called the "County".
RECITALS:
By Deed of Dedication dated September 3, 1996, of record in the Clerk's
Office of the Circuit Court of Frederick County, Virginia in Deed Book 865, at Page 5Q0, as
amended by Amended Deed of Dedication and Subdivision dated December 9, 1996, of
record in the aforesaid Clerk's Office in Deed Book 871, at Page 688, the Declarant did
subdivide those certain lots or parcels of land known as "Premier Place" in accordance with
that certain Final Plat of Subdivision - Premier Place dated February 15, 1996, drawn by
Douglas C. Legge, L.S., of record in the aforesaid Clerk's Office in Deed Book 865, at Page
504, et seq.(the "Subdivision Plat") whereby Lots 1, 2, 3 and 4 where created, as more fully
set forth on said plat.
2. The portion of the cover sheet of the Subdivision Plat designated as "Owner's
Consent" was not properly executed by Fred L. Glaize, III or the Trustees of the Fred L.
Glaize, Jr. Residual Trust. Further the derivation of title as set forth in the "Surveyor's
Certificate" on the cover sheet of the Subdivision Plat and as set forth in the Deed of
Dedication was incorrect.
3. It is the intention of the parties to correct the Deed of Dedication and the

Subdivision Plat to correct said errors and/or omissions and to otherwise ratify and affnm all
remaining terms and conditions of the Deed of Dedication.
NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That for
and consideration of the premises and the benefits which will accrue by reason of this
Corrected Dedication, the Declarant does hereby subdivide all of that certain tract or parcel of
land designated as Premier Place, lying and being situate in the County of Frederick,
Virginia, and being more particularly described by that certain Final Plat of Subdivision of
Premier Place, by Douglas C. Legge, Land Surveyor, dated February 15, 1996, (contai*g
Lots 1, 2, 3 and 4, inclusive) which Final Plat of Subdivision is attached hereto and
incorporated herein as if set out in full; and being the same lands in which a 25% interest was
acquired by Fred L. Glaize, III and in which a 25% interest was acquired by the Fred L.
Glaize, Jr. Residual Trust by Deed dated August 16 , 1999, of record in the Clerk's Office
of the Circuit Court of Frederick County, Virginia in Deed Book 9 4 5 , at Page 924 and in
which an additional 50% interest was acquired by the Fred L. Glaize, Jr. Residual Trust by
Deed of Exchange and of Partition dated June 13, 1996, of record in the aforesaid Clerk's
Office in Deed Book 860, at Page 821.
FOR AND IN CONSIDERATION AS AFORESAID, the Declarant does further
dedicate all of the streets in Premier Place to the County, for public use, which streets
dedicated hereby are more particularly described by the hereinabove referenced Subdivision
Plat.
RESERVATION OF EASEMENTS:

A. The Declarant reserves unto itself, its successors or assigns, the right to erect,
maintain, operate and replace underground telephone and electrical conduits, related
equipment, and other facilities, sewer, gas, water and television lines and related equipment,
and any other utility equipment within ten (10) feet of any property line on any lot as
designated on the Subdivision Plat.
B. The Declarant further reserves unto itself, its successors or assigns, a blanket
easement and right on, over, and under the ground within said subdivision, in order to control
drainage of surface water so as to maintain reasonable standards for health, safety and.,
appearances. This reservation shall, once any lot is improved by a building, be refined to
within ten (10) feet of the property lines.
RESERVATION OF FURTHER RESTRICTIVE COVENANTS
AND FURTHER SUBDIVISION:
DECLARANT reserves the right to impose restrictive covenants on any lot which it
owns within the Premier Place Subdivision, said restriction to apply prospectively and shall
not affect any lot previously conveyed and over which the Declarant has no ownership
interest.
DECLARANT further reserves the right to resubdivide Lot 4 and/or to add
additional land to Premier Place or any lot located therein.

Grantors; and KDG, LC, a Virginia Limited Liability Company,

WITNESSETH: That for and in consideration of the sum of
Ten Dollars ($10.00), cash in hand paid, and other good and
valuable consideration, the receipt of which is hereby
acknowledged, the Grantors do hereby grant and convey, with
general warranty of title, unto the Grantee, in fee simple,
all of that certain lot or parcel of land, together with the

Book 945, at Page 924. Reference is made to the aforesaid

constructed and leaves little flexibility in how the property can be divided. Structures
currently exist on lots 1 & 2 - these being model homes that are proposed to be used for
businesses. The odd shape of this property, combined with buffer requirements dictated by
the adjoining MH1 and RP zoning districts, greatly restricts developmental capability. The
street will be required to be brought up to state standards and dedicated for eventual insertion
into the state system. The stormwater management function highlighted by the County

on the referenced development's rights -of -way for eligibility into the
State's Secondary Road System. Based on this inspection the following
concerns will need to be addressed:
1. Provide engineering verification and certification that the existing
pavement and stone base meet VDOT standards.
2. Remove and replace all cracked, damaged and settled CG-6 curb &
gutter.
3. Repair all areas of settlement in pavement.
4. Check condition of and flush out storm sewer.

The above list is based on existing conditions. An unapproved set of site

considered for acceptance into the State's Secondary System if requested
by the Frederick County Board of Supervisors through resolution.

May I suggest you proceed with obtaining and supplying VDOT with three
copies of approved as -built construction plans showing roadway
geometrics, drainage, and drainage easements. Also three copies of the
final plats with date and place of recordation, deed book number, and
page number. We will also need signed quitclaim permits covering all
utilities, publicly or privately owned, to occupy or cross the right-of-way
and quitclaiming any prior rights.
Once the above listed information has been received by this office, we will
then be able to determine the appropriate maintenance fee and surety
amounts to guarantee workmanship.

We have completed our review of the referenced project's site plan dated
October 25, 1988. I am happy to inform you the horizontal and vertical alignment are
satisfactory. The plans basically need to be revised to show existing/ as -built
conditions. Our comments may be found on the enclosed plans marked in red and as
follows:
1. Our proposed reconstruction of the first 225' of the street needs to be incorporated
into the plan. In addition, the improvements to Route 522 through this area need to
be shown. For your use I have enclosed a copy of our plan and profile of the
proposed reconstruction of the Premier Place right-of-way.
2. The substandard parking areas along the street need to be removed from the plan
and the openings closed with Standard CG-6 curb & gutter. The standard CG-9D
entrance gutters recently installed by the contractor will need to be shown. The
entrance locations, widths and other dimensions will need to be included.
3. The original pavement sections shown was adequate. However, the typical sections
needs to be revised to reflect current conditions. I have enclosed a copy of the
pavement core results provided by the contractor. Additionally, an overlay of the
street has been completed.
4. The drainage calculations provided indicate the stormsewer pipes are adequate.
However, the 4' long curb inlets seem to be undersized. Inlet capacity calculations
will need to be provided to support their current size.
5. The plans indicate a drainage easement is to be required for the stormwater outfall.
A recorded copy of this easement document will be required before this roadway is
accepted into the Secondary System.
6. There appears to be a pond shown on the profile sheet at approximate
Station 15 + 75. If so, verification from you that it was properly drained, undercut
and filled during construction will be required.

WHEREAS, the Subdivision of Premier Place as shown on the
aforesaid attached Final Plat of Subdivision, is with the free
consent and in accordance with the desires of the undersigned
DECLARANT, and the DECLARANT further desires to subdivide the
aforesaid real estate in accordance with, -the provisions of "The
Virginia Land Subdivision Act" as are applicable and in force

Dedication, provided that DECLARANT reserves the right to
further subdivide any portion of any lot within the subdivision,

NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That
for and in consideration of the premises and the benefits which
will accrue by reason of this Dedication, the DECLARANT does
hereby subdivide all of that certain tract or parcel of land
designated as Premier Place, lying and being situate -in the
County of Frederick, Virginia, and being more particularly
described by that certain Final Plat of Subdivision of Premier
Place, by Douglas C. Legge, Land Surveyor, dated February 15,
1996, (containing Lots 1, 2, 3 and 4, inclusive) which Final
Plat of Subdivision is attached hereto and incorporated herein
as if set out in full. This is all of the land designated as
Parcel One which was conveyed to Fred L. Glaize, Jr., Residual
Trust, by deed dated June 13, 1996 and recorded in the Office of
the Clerk of the Circuit Court of Frederick County, Virginia in
Deed Book 860, at Page 821.
FOR AND IN CONSIDERATION AS AFORESAID, the DECLARANT does
further dedicate all of the streets in Premier Place to the
COUNTY, for public use, which streets dedicated hereby are more
particularly described by the hereinabove referenced Final Plat
of Subdivision of Premier Place.
RESERVATION OF EASEMENTS
(a) The DECLARANT reserves unto itself, its successors or
assigns, the right to erect, maintain, operate and replace

underground telephone and electrical conduits, related
equipment, and other facilities, sewer, gas, water and
television lines and related equipment, and any other utility
equipment within ten (10) feet of any property line on any lot
as designated on the Final Plat of Subdivision of Premier Place.
(b) The DECLARANT further reserves unto itself, its
successors or assigns, a blanket easement and right on, over,
and under the ground within said subdivision, in order to
control drainage of surface water so as to maintain reasonable
standards for health, safety and appearances. This reservation
shall, once any lot is improved by a building, be refined to
within ten (10) feet of the property lines.
RESERVATION OF FURTHER RESTRICTIVE COVENANTS
AND FURTHER SUBDIVISION
DECLARANT reserves the right to impose restrictive
covenants on any lot which it owns within the Premier Place
Subdivision, said restriction to apply prospectively and shall
not affect any lot previously conveyed and over which the
DECLARANT has no ownership interest.
DECLARANT further reserves the right to resubdivide Lot 4
and/or to add additional land to Premier Place or any lot
located therein.
