Bruce Edens, Land Surveyor, dated November 12, 1990, attached hereto and incorporated by reference herein, said strip of land perhaps being part of the property acquired by the Grantors by deed from Fort Collier Farms, Inc., dated February 9, 1989, and recorded in Deed Book 705, page 433, among the land records of Frederick County, Virginia, which parcel is or may be particularly included within parcel (4) of said deed; and 1 SNARR. McCANDLISH III ROCKWOOD ATTORNEYS AT LAW WINCHESTER, VIRGINIA WHEREAS the Grantors are the owners of a certain strip of land extending from Route 11 to the same railroad, of variable width, more particularly described as parcel C on that same plat and survey aforesaid, which parcel is a portion of that parcel acquired by the Grantors by deed from Aaron Zuckerman and wife dated June 13, 1990, and recorded in Deed Book 746, page 1595, among said land records; and WHEREAS the County is the owner of a certain strip of land lying between and bordered by the two parcels described above, more particularly described as parcel B on that same plat and survey aforesaid, which parcel was acquired by the County by con- demnation for use as a public road as hereinafter described, by order of the Circuit Court of Frederick County, Virginia, re- corded in Law Order Book 90, page 144, and in Deed Book 747, Page 1250; and WHEREAS the County is or may be the owner of said parcel A by virtue of a deed of subdivision executed by I. Fred Stine, et als, dated March 16, 1951, and recorded in Deed Book 218, page 519, among said land records; and WHEREAS the parties hereto have agreed to take all such ac- tions as may be necessary to construct on parcels A, B, and C a public road which will meet the standards of the Virginia Depart- ment of Transportation (hereinafter "VDOT") and ultimately be taken into the state road system, to be maintained and ad- ministered by said Department; NOW THEREFORE, for and in consideration of the premises and of the benefits to accrue to them by reason of this dedication, the Grantors do hereby DEDICATE parcel C and all their right, title and interest in parcel A, both as depicted on said plat, to 2 SNARR, McCANDLISH & ROCKWOOD ATTORNEYS AT LAW WINCHESTER, VIRGINIA the County, for the purpose of including said parcels A and C as part of a public road leading from United States Route 11 to the Winchester and Potomac Railroad; The Grantors further agree to construct on parcels A, B and C an access road which will conform to Virginia Department of Transportation standards, extending from U. S. Route 11 to the Winchester and Potomac Railroad, and to complete said construc- tion with reasonable speed as soon as financing is available; And the County, for and in consideration of the dedication and agreement to construct as set forth above, does hereby accept the Grantors' interest in parcel A (or so much thereof as has not already been dedicated to the public use) and parcel C from the Grantors; does hereby grant to the Grantors, their agents, employees, invitees, heirs and assigns, a temporary easement over combined parcel A, B and C for (1) access to the other properties of the Grantors and (2) constructing and maintaining the road described above, which easement shall terminate upon acceptance of this road by VDOT; and does further agree to apply promptly to VDOT to have the roadway so built taken into the state system, and to dedicate the combined parcel A, B, and C to VDOT when such application is made and accepted. The foregoing dedication is made with the free consent and in accordance with the desires of the Grantors, and is in con- formity with such provisions of the Virginia Land Subdivision Act as are applicable, together with the applicable ordinances and regulations of the governing body of the County of Frederick, Virginia. I offer the following comments; any and/or all that can apply shall apply: • A preconstruction conference be held by the engineer and/or developer with the attendance of the contractor, various County agencies and VDOT shall be conducted prior to initiation of work. • Materials used and method of construction shall apply to current observed VDOT Road and Bridge Specifications applicable during construction of this development. • Our review and comments are general in nature. Should conditions in the field exist such that additional measures are warranted, such measures shall be completed to the satisfaction of the Department prior to inclusion into the Secondary Road System. • Attached is a copy of the minimum requirements and information needed prior to acceptance of subdivision streets into the Secondary System. Our conm)ents may be found on the attached plans marked in red and as follows: Park Center Drive (plan date 03/04/91) A comment concerning the required length and type of the box culvert wing is to be added to the plan as noted, Upon further review in the' field it appears a 18" culvert under the Park Center Drive intersection with Route 11 would be more desirable than the originally approved 15". West Brooke Road (plan date 02/28/91) The existing 15" C.M.P. under the intersection of West Brooke Road with Route 1322 will need to be extended and a standard VDOT stop sign provided as noted. The proposed 42" R.C.P. at approximate Station 28+28 will need to be up sized to 48" and a 20' drainage easement provided to the stream. • Flared end sections (Standard ES-1) will be required on all pipes. • Standard CD-2 underdrain to be added at location noted. • The proposed quadruple 6'x4' box culvert at Station 21+65 is to be constructed to our 1989 Standards.
