HomeMy WebLinkAboutOakdale Subdivision - Backfile (2)HARRISON 6 JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA M26PG0326 HIS AMENDED DEED OF DEDICATION, made and dated this day of , 1994, by and between GLAIZE DEVELOPMENTS, INCORPORATED, a Virginia corporation, of the first part, hereinafter called DECLARANT, and COUNTY OF FREDERICK, VIRGINIA, of the second part, hereinafter called COUNTY. WHEREAS, DECLARANT has previously executed and recorded that certain Deed of Dedication and Declaration of Subdivision of Oakdale Crossing, Shawnee Magisterial District, Frederick County, Virginia, dated November 14, 1990 in the Office of the Clerk of the Circuit Court of Frederick County, Virginia, in Deed Book 753 at Page 314, with plats attached thereto drawn by P. Duane Brown, C.L.S., dated April 12, 1989 (revised December 14, 1989, February 8, 1990 and August 9, 1990), whereby the subdivision designated as Oakdale Crossing was dedicated and certain covenants imposed thereon; and WHEREAS, said Deed of Dedication and Declaration of Subdivision reserved to the DECLARANT the right to amend said Deed of Dedication and Declaration of Subdivision; and WHEREAS, DECLARANT is the owner of record of Lots 27 and 28, Oakdale Crossing, and of land located immediately south of and adjacent to Oakdale Crossing; and WHEREAS, DECLARANT desires to dedicate drainage easements and temporary turn -around easements for the benefit of Oakdale Crossing, as platted aforesaid, and for the benefit of future sections of Oakdale Crossing to be developed. NOW, THEREFORE, WITNESSETH: That for and in consideration of the premises and other benefits which will accrue, DECLARANT does hereby: spa HARRISON & JOHNSTON ATTORNEYS AT LAW WINCHESTER, VIRGINIA BK826PGO321 (1) dedicate, for the benefit of all lots in Oakdale Crossing, as platted aforesaid, and for the benefit of future sections of Oakdale Crossing, those drainage easements as shown on that certain plat showing temporary turn -around easements and drainage easement made by P. Duane Brown, C.L.S., dated February 15, 1990, attached hereto and by .reference made a part hereof; and (2) dedicate, on a temporary basis, for the benefit of all lots in Oakdale Crossing, the right to utilize the temporary turn -around easements as shown on the aforesaid attached plat, said easements to terminate upon the platting of any future development concerning Oakdale Crossing that utilizes the portion of land upon which said easements are located. Except for the amendments set forth above, DECLARANT does hereby ratify and confirm all the remaining terms, covenants and conditions of said Deed of Dedication and Declaration of Subdivision dated November 14, 1990, of record in the aforesaid Clerk's Office in Deed Book 753 at Page 314. We are now preparing, construction drawings for this development and would appreciate your review of our preliminary plan which shows additional information as relating to horizontal alinement of the roadway system. Upon your preliminary approval of this layout we will prepare construction drawings and submit them to you for subdivision approval recommendations to Frederick County.
