W I T N E S S E T H: 1. The platting and dedication of Section Two of Nottoway Subdivision as shown on the plats prepared by Dove & Associates, Certified Land Surveyors, dated August 22, 1986, attached hereto and incorporated herein in full by this reference is with the free consent and in accordance with the desire of the Grantor herein. The platted land lies a short distance East of Stephens City in Opequon Magisterial District of Frederick County, Virginia, just North of Route 277, and is a portion of the property conveyed to the Grantor herein by deed dated December -Z�1986 and recorded in the Office of the Clerk of the Circuit Court of Frederick County, Virginia in the current Deed Book immediately preceding this Deed of Dedication. 2. No building, structure, alteration, addition or improvements of any character, other than interior alterations shall be constructed upon .any unit unless and until a plan of such construction shall have been approved by the Board of Directors of the Nottoway Townhouses Association as to harmony with surrounding structures, the effect of the construction on the outlook from surrounding units and all of the factors which will in their opinion affect the desirability or suitability of the construction. No trees shall be planted nor other digging undertaken without first securing the approval of the local power company and without first being advised as to the location of all underground electrical and telephone wires. 6. No noxious or offensive activities shall be carried on upon any unit, nor shall anything be done thereon which may be or may become an annoyance or nuisance to the neighborhood. 7. No animals, livestock or poultry of any kind shall be raised or kept on any unit, except that dogs, cats and other household pets may be kept provided that they are not kept, bred or maintained for commercial purpose 8. No boats, trailers, campers, trucks or other similar vehicles or equipment, other than automobiles, motorcycles and pickup trucks shall be parked or located on any unit, except for the purpose of delivery or remova for a period not exceeding two (2) calendar days. 9. No baby carriages, bicycles or other articles of personal proper shall be deposited, allowed or permitted to remain.on any unit except in the enclosed rear area. Nottoway Townhouses Association may impound all such articles and make a charge for their return. 10. No unit shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall not be kept except in sanitary containers. All incinerators or other equipment for storage or disposal for such materials shall be kept in a clean and sanitary condition. No refuse or any container for same shall be placed or stored in front of any house, except on the date of garbage pick up. 11. No exterior clothes line, or hanging device shall be allowed upon any unit, except for an umbrella type one with a diameter not exceeding seven (7) feet, provided same is located in the rear of a unit. 13. Each unit owner and his assigns and their guests and licensees shall have the right of ingress and egress from the unit to Buckingham Drive across the other units over the driveway area now existing in front of the buildings. 14. No unit owner shall have the right to park upon another's unit. 15. The Nottoway Townhouses Association shall have the right to :care for the driveway area and the area between the driveway area and Buckingham Drive. 16. In the event a townhouse is destroyed, the owner thereof shall begin construction within a reasonable time or excavate and clear away the remaining portion of the townhouse and maintain the unit in a neat and orderly condition. If the owner fails to perform such clearance or maintenance for a period exceeding sixty (60) days, Nottoway Townhouses Association shall perform the same and the expenses thereof shall be a lien on the particular unit. 17. In the event a townhouse is destroyed, no structure other than a townhouse of the same dimensions and similar architecture shall be constructed in the plat of the original structure. 18. The walls dividing each of the .Units shall be treated as party walls. The cost of reasonable repair and maintenance of a party wall shall be shared by the two (2) adjoining landowners, except to the extent the wall is not of use to one of the owners. If a party wall is destroyed or damaged by fire or other casualty, any owner who has use of the wall may restore it, and if the other owners thereafter make use of the wall, they shall contribute to the cost of the restoration thereof in proportion to such use without prejudice, however, to the right of any such owners to call for a larger contribution from the others under any rule of law regarding liability for HARRISON B JOHNSTON ATT04atrt AT GAW IN negligence or wilful acts or admissions. 'rhe Grantor reserves unto itself and its assigns, the right to erect, maintain, operate and replace underground and above ground telephone and electr c light conduits, related equipment and other facilities, sewer, gas, water and television lines and related equipment and other utility equipment where such utility lines and equipment are now located and on, over and under that strip of land marked on the attached plat for utility easements, the right of ingress and egress thereto and the right to grant easements or rights of way therefor. In addition, each unit owner shall have the right of ingress and egress to his unit over said strip of land marked utility easement. 5. (a) The owner of each unit, upon which construction has started or been completed, as of January 1st of each year beginning January 1, 1987, shall pay to Nottoway Townhouses Association, its successors or assigns, the sum of Fifty Dollars ($50.00) per unit owned by said owner or such other amount. as are determined by Nottoway Townhouses Association, payable during the month of January of each year, beginning January 1, 1987, and to be used solely for the maintenance, repair, improvement and snow removal of the parking, the driveway and the adjoining street side areas of the area known as "Nottoway Townhouses" in Frederick County, Virginia, as more particularly described by plats, now or hereafter prepared and recorded, in the Clerk's Office of the aforesaid County, attached to deeds of dedication of Nottoway Townhouses Subdivision. Said annual payment shall be a charge upon and running with the respective unit. REVIEW EVALUATIONS: VA. Dept. of Highways & Transportation - It is obvious that the streets were not constructed to the approved plans and have not been maintained since construction. Some of the noted deficiences are: 1) a. The road surface is not uniformly 22 feet wide. b. The shoulders need reshaping. c. The.ditchline and culverts need to be cleaned out to function properly. d. The storm drain and standard DI-1 have not been constructed on Nottoway Drive at the intersection of Rt. 277. e. The 29"x18" culvert has not been installed from approximately Station 7 + 50 to Station 10 + 00 on the'south side of the roadway as shown on the plans. When this culvert is installed, it will be necessary to replace the two private entrance culverts just west of this location and in the adjoining subdivision. 2) A drainage easement would be required at approximately Station 7 + 00 as originally planned if pipe is not installed. Department of Inspections - This subdivision shall comply with Use Group R - Section 209.0 of the BOCA Basic Building Code, 1978. Additional Comments will be given at time of plans review. Sanitation Department - Water and sewer service subject to capacity available at the time of connection. Laterals to serve units will have to be extended by developer. Planning and Zoning - For your information, a preliminary plat was submitted in February of 1972 reflecting 165 units with roads and water and sewer, comprising a total development scheme of 17.4 acres. The zoning at the time of submission was R-3 (Residential -General). As you know, R-3 was the multi -family designation until 1976. The zoning is now R-6 (Multi -Family Residential). Page Two Nottoway Sixteen units have already been constructed on Buckingham Drive. Mr. Bowman is now ready to proceed with the remainder of the townhouse project. The proposed plan now calls for the construction of 117 units. This has been substantially reduced from the previous proposal of 165 total units. The staff recommends that this final plat be approved with the understanding that before construction commences, a site plan be submitted showing typical sections on all streets and parking lots. The minimum requirement for parking lot surfaces is prime and double seal. Entrances to all parking lots shall be the same surface as the roadway. The Plans should reflect the drainage from the parking lots and define easements or storm sewers which will serve these areas. The Frederick County Sanitation Authority has approved sanitary water and sewer facilities. The Virginia Department of Highways and Transportation requirements must be met prior to recording, either through bonding or actual construction. Our review of the site yielded the following deficiencies which need to be corrected prior to the consideration for inclusion into the Secondary Road System. BUCKINGHAM DRIVE - 1. Item #3 of Mr. K. D. Walker's letter, dated November 15, 1982. We further recommend that a concrete Olean out.box'be installed Joining the existing eastern entrance pipe to the proposed pipe due to the long length and accumulation of debris which can be presently viewed. 2. Item #2 of Mr. K. D. Walker's letter, dated November 15, 1982. The outlet end of the proposed pipe should be directed towards the inlet end of the existing 29" x 18" culvert. The ditehline carrying the flow to the inlet end of the proposed pipe should be redefined and an earth berm constructed in a manner as to channel flow away from Lot 99. The existing cul- vert shall be removed and'the cavity backfilled with aggregate size 21-A. NOTTOWAY DRIVE FROM INTERSECTION WITH BUCKINMW DRIVE TO CUL-DE-SAC - 1. Item #4 of.Mr. K. D. Walker's letter, dated November 1% 1982. In addition, the entire drainage ditch needs reseeding. 2. Minimum occupancy requirements must be met prior to inclusion into system. 3. In reference to your comment concerning the November 15, 1982 letter, I believe that the same was somewhat amended by a series of letters between the Department and Mr. Bowman's representative at that time, said letters being as follows: 1. Edinburg, 984-4133 Nov. 15, Ref.: Nottoway Subdivision Frederick County VA 22824 1982 This is in response to my telephone conversation with you several days ago, this letter is to point out some problems on the above subdivision which should be resolved before the street can be taken into the Secondary System. 1. A 20' drainage easement is to be provided to the back of Lot (Station 0 4s 00 Profile B) on Nottoway Drive to maintain an outfall ditch for the roadway ditch water. 2. The pipe at Station 7 + 00 was deleted due to the developer not being able to obtain a drainage easement through Lot 99 to Buchannan Drive in adjoining Fredericktowne Sub- division. Complaints have been received from;the property owner, Lot 99, of ditch water along the east side of Buckingham Drive draining across the property. It appears from a field review that a 17"xl3" pipe arch could possibly be installed at approximate Station 7 + 50 to drain this water to the west side of the street; thereby eliminating the problem. 3. It is recommended that the two 29"xl8" entrance pipes be connected right of Station 10 + 00 due to the deep ditch and steep back slope. 4. The drainage ditch between Lots 25 and 26, Station 12 + 00, needs to be regraded due to water ponding within the easement. 5. Concern by Residents in Fredericktowne Subdivision has also been expressed that water diverted along Buckingham Drive, Nottoway Subdivision, may cause flooding at the 72"x44" pipe under Buchannan Drive. -It appears that approximately 3.7 acres is being diverted along the west side of Buckingham Drive which will increase the drainage area and runoff approximately 3% at the 72"x44 " pipe. In our opinion, the additional water would not create any appreciable amount of flooding at this pipe; however, we are recommending that the County require the developer to provide detention facilities for.that section of the development being diverted. First, I want to apologize for the delay but the drainage ditch and easement were not exactly what we had in mind. However, after several attempts the corrections have been made and it now appears to be what we wanted originally and is satis- factory. Our comments are as follows: 1. It is obvious that the streets were not constructed to the approved plans and have not been maintained since construction. Some of the noted deficiences are: a.) The road surface is not uniformly 22 feet wide. b.) The shoulders need reshaping. c.) The ditchline and culverts need to be cleaned out to function properly. d.) The storm drain and standard DI-1 have not been constructed on Nottoway Drive at the intersection of Rt. 277. e.) The 29"xl8" culvert has not been installed from approximately Station 7 + 50 to Station 10 + 00 on the south side of the roadway as shown on the plans. When this culvert is installed, it will be necessary to replace the two private entrance culverts just west of this location and in the adjoining subdivision. 2. A4rainage easement would be required at approximately Station 7 + 00 as originally planned if pipe is not installed. I am signing and returning the final plat.
