THIS DEED made and dated this day of November, 1999, by
and between Frank W. Nichols, hereinafter referred to as Grantor, and Steven W.
Smallwood and Robin B. Smallwood, his wife, hereinafter referred to as the
Grantees.
WITNESSETH. That for and _n consideration of the sum of Ten
Dollars ($10.00), cash in hand paid, and other good and valuable consideration, the
receipt of which is hereby acknowledged, the Grantor does hereby grant and convey,
with General Warranty and English Covenants of Title, unto the Grantees, as
tenants by the entirety with the right of survivorship as at common law, the
following described tracts of land located in Frederick County, Virginia (the
"Property"):
All of those certain lots or parcels of land, together
with the improvements thereon and the appurtenances
thereunto belonging, designated and more particularly
described as Lots 1 and 2 on the Final Subdivision Plat on
the Property of Frank W. Nichols, prepared by Charles E.
Walls, Jr., L.S., dated September 8, 1999, attached hereto
and by this reference made a part hereof, and being the
same property conveyed to Frank W. Nichols by deed from
Stanley E. Turben and Johnnie A. Turben, husband and
wife, dated January 11, 1989, of record in the Clerk's
Office of the Circuit Court of Frederick County, Virginia,
in Deed Book 703 at Page 280.
Reference is here made to the aforesaid instruments and the
attachments and the references therein contained for a further and more particular
description of the property hereby conveyed.
This conveyance is made subject to all duly recorded and enforceable
restrictions, easements and rights of way.

SUBDIVISION SPECIFICS: Subdivision of a 29,740 square -foot tract into two lots.
REVIEW AGENCY COMMENTS:
Department of Transportation: No objection to subdivision of this property. Before development,
you will need to contact Mr. Bill Stover, Maintenance Superintendent at our Stephens City Area
headquarters, at (540)-869-1111 to secure the necessary private entrance permits. Entrances will
have to be constructed to VDOT minimum standards to allow for safe egress and ingress of the
property.
Sanitation Authority: This should be a 20-foot private water and sewer easement.
County Engineer: Engineered site plans will need to be submitted for both lots at the time of
building permit application due to drainage issues.
Fire Marshal: Approval recommended. Fire Lane in front of all existing or proposed fire hydrants.

Planning and Zoning:
Public Meeting Requirement
The Subdivision Ordinance requires that land divisions in the RP (Residential Performance) Zoning
District, without an approved master development plan, be presented to the Board of Supervisors for
final approval (§ 144-12-B). The Master Development Plan (MDP) requirement may be waived, and
has been waived for this project, based on the scale of the subdivision proposal. This project contains
land zoned RP and does not contain an approved MDP; therefore, Board review and action is
necessary.
Staff Review
This land parcel is located in between the Fredericktowne and Fredericktowne Estates Subdivisions.
It is a residual parcel around which the above -mentioned residential areas have developed. The
application proposes a two -lot subdivision. The proposed lots comply with the dimensional
requirements of the single family detached urban housing type, in particular, the minimum lot size of
12,000 square feet. Access to both lots is proposed to be directly onto Fairfax Drive. Access to the
parcel identified with PIN 75-A-73 is achieved via Rockbridge Road extended.
With one exception, the subdivision as submitted appears to satisfy the requirements of the
Subdivision Ordinance. Sidewalks are required to be installed in the right-of-way along local streets
in any subdivision containing one (1) or more lots of less than fifteen thousand (15,000) square feet
in size. Due to the fact that the developments surrounding this proposed subdivision do not contain
any sidewalks, and the size of the proposed lots, it may be appropriate to allow an exception to this
requirement in this case. The Board of Supervisors, upon recommendation of the Planning
Commission, may allow variations in or exceptions to the provisions of the Subdivision Ordinance
in cases of unusual situations.
STAFF RECOMMENDATION FOR 10/20/99 PLANNING COMMISSION MEETING:
Staff recommends approval of this subdivision application with an exception to Section 144-18, the
provision of sidewalks, contingent upon the applicant's satisfying all review agency comments.

PLANNING COMMISSION SUMMARY & ACTION FOR THE 10/20/99 MEETING:
There were no citizen comments concerning this subdivision application. No major issues of concern
were raised by members of the Commission. The Planning Commission unanimously recommended
approval of the subdivision application with an exception to Section 144-18, the provision of
sidewalks, contingent upon the applicant satisfying all of the review agency comments.
