Dear Bill:
This letter is to confirm that the final plats for the Oakdale Crossing II Subdivision were administratively
approved on October 18, 1999. The Subdivision Design Plans were approved on the same date. This
office has received recorded copies of the final plats and deed of dedication. Therefore, no additional
action is required on the part of the developer at this time.
The approval of this subdivision allows for the development of fifty-three (53) single family detached
traditional residential lots with a minimum lot size of 15,000 square feet. Frederick County currently
holds a bond in the amount of $450,000.00 for'the completion of the improvements associated with the
Oakdale Crossing II Subdivision. This is primarily for the completion of the roads internal to this
subdivision.

THIS DEED OF DEDICATION and DECLARATION OF SUBDIVISION, made this
day of ��-t�tr= 1999, by and between GLAIZE
DEVELOPMENTS, INC., a Virginia Corporation, of the one part, hereinafter called
the DECLARANT, and the COUNTY OF FREDERICK, VIRGINIA, of the other part,
hereinafter called the COUNTY.
WHEREAS, the Declarant is the owner in fee simple of a certain tract of land
situate in Frederick County, Virginia, to -wit: all of that certain tract or parcel of
land together with the improvements thereon and the appurtenances thereunto
belonging, containing 25.6784 acres, lying in Shawnee Magisterial District of
Frederick County, Virginia and more particularly described as Oakdale Crossing II
on that certain plat and survey by P. Duane Brown, C.L.S., dated
1999, attached hereto and by this reference made a part hereof and being a portion
of the same property which was conveyed to the Declarant by deed from Bowman
Trucking Company, Inc., a Virginia Corporation, dated January 25, 1990, and
recorded in the Office of the Clerk of the Circuit Court of Frederick County, Virginia
in Deed Book 738, at Page 426; and Deeds of Boundary Line Adjustment
Agreements, both dated September 20, 1999 between the Declarant and Jeni
Company, a Virginia Corporation, which deeds are recorded in Deed Book 949, at
page 582 and Deed Book 949, at page 586, respectively, in the aforesaid Clerk's
Office; and,
WHEREAS, the Declarant now desires to subdivide the same into lots to be
known as Oakdale Crossing II, and to evidence that the above and foregoing
subdivision of the above described property as it appears on the aforesaid attached
plat is with the free consent and in accordance with the desires of the Declarant,

and the Declarant does further desire to subdivide the aforesaid property in
accordance with the provisions of the Virginia Land Subdivision Act as are
applicable and the applicable ordinances of the County of Frederick, Virginia, and
further to dedicate the streets and easements and other amenities as shown on said
plat to the County of Frederick, Virginia.
NOW THEREFORE, THIS DEED OF DEDICATION WITNESSETH: That for and
in consideration of the promises and the benefits which will accrue by
reason of this dedication, the Declarant does hereby subdivide all that portion of the
land designated as Oakdale Crossing II, located in Shawnee Magisterial District,
Frederick County, Virginia as more particularly described by the aforesaid
referenced plat attached hereto and made a part hereof and does hereby dedicate
those portions of land set apart for streets or other public use, as designated, and
do hereby create a public right of possession in the same, all of said land being the
same as described hereinabove.
RESTRICTIVE COVENANTS AND CONDITIONS
The lots in said subdivision shall be subject to the following restrictive
covenants and conditions, except as stated otherwise, which shall be considered
covenants real and running with the land, and shall be binding upon and
enforceable by the Declarant and all subsequent owners of said lots.
1. All Lots shall be used for single-family residential
purposes only. No detached garage or carport shall be
permitted on any Lot. Any utility or other out building on
any Lot shall be of the same material and construction as
the main structure on such Lot.
2. No signs or advertising of any nature shall be erected or
maintained on any Lot except "For Sale" signs for said

Lot which signs shall not exceed five (5) square feet in
area, or signs used by the DECLARANT to advertise the
property during construction and sale. No "For Rent"
signs shall be allowed on any Lot.
3. No power boats, mobile homes, motor homes, campers,
commercial buses, trailers of any type, tractors, trucks
or other motor vehicles (other than automobiles,
motorcycles, pickup trucks of 3/4 ton (or less) or
passenger vans) shall be permitted on any Lot except
during the course of construction. No motor vehicle or
material portion thereof, which does not have a current
license and current Virginia inspection sticker shall be
permitted on any Lot.
No commercial or business vehicle, of any type, unless
excepted herein as to size, shall be allowed to park on
any lot in said subdivision at any time, after the
construction of a dwelling house has been completed.
4. No animals of any kind (including livestock, poultry or
birds) shall be permitted on any Lot, except that dogs,
cats and other usual household pets may be kept,
provided that they are not kept, bred or maintained for
commercial or charitable purposes or in unusual
numbers. No shelter, outside the dwelling unit, shall be
erected for any dog, cat or other household pet allowed
by this paragraph.
5. No fence or hedge shall be constructed or planted in the
front nor along the side of any residence. Rear fencing
and hedges shall not exceed six feet (6') in height. All
fencing shall be constructed of wood, masonry, iron or
PVC material. No chain link fencing shall be allowed.
On corner lots no fence or hedge shall be constructed or
planted in the front nor along the sides of any dwelling
unit nor within twenty-five feet (25') of any public street.
6. No noxious or offensive activities shall be carried on
upon any Lot nor shall anything be done thereon which
may be, or may become, an annoyance or nuisance to
the neighborhood.

7. Only in -ground swimming pools shall be permitted with
a structure to house equipment to be constructed of
wood, stone, stucco, or brick or a combination thereof.
Fencing shall be allowed around the pool area provided,
however, that the fence shall be constructed of either
wood, stone, stucco, brick or PVC, or a combination
thereof. Use of chain link fencing is expressly prohibited
from any fencing around the pool area. Any gate in the
fence around the pool area may be of iron material.
8. In the event that a dwelling is destroyed, the owner of
the dwelling, within thirty (30) days from said
destruction, shall clear away the remaining portion of the
dwelling unit and maintain the Lot in a neat and orderly
condition.
9. In the event a dwelling unit is damaged, or has materially
deteriorated, the owner of the unit shall immediately
repair the damage or deterioration.
10. No Lot shall be used or maintained as a dumping ground
for rubbish. Trash, garbage or other waste (refuse) shall
be kept in sanitary containers and screened. No refuse
or any container for same shall be placed or stored in
front of any house, except on the date of refuse pickup.
11. Each lot shall be kept mowed and maintained in a neat
and orderly condition at all times.
12. No exterior clothes lines, or hanging device, shall be
permitted on any Lot, except for an umbrella -type with
a diameter not to exceed seven (7) feet; provided,
however, that the same may only be used in
the rear of any building constructed on said Lot and the
clothes line is stored within a utility building or the
equivalent when the clothes line is not in use. No
exterior antenna of any type, including television
satellite dishes for the reception or transmission of radio
or television communications, shall be erected, used or
maintained on any structure, on any lot, at any time
except for satellite dishes 24" or less in diameter. No
solar panels or solar heat collecting device shall be
allowed.
13. Every owner shall provide his Lot with off-street parking
space of at least 450 square feet, which may

include all area in any driveway located on the Lot
itself, to be used by the inhabitants of the dwelling
house located on said Lot. Parking on the street shall be
prohibited and it is the intent of this restriction that
parking space for at least (2) vehicles be provided. All
driveways are to be constructed of concrete and shall be
installed per the specifications of the Virginia Department
of Highways.
14. All Lots are subject to such ten foot (10') Slope and
Drainage Easement along all rights of way, and a ten
foot (10') Utility and Drainage Easement along all
property lines, except the front property lines shall be
subject to such easements in the width of twenty-five
feet (25'). In addition all lots are subject to whatever
easements appear on any individual lot as shown on the
plat attached hereto and made a part hereof.
15. There shall be no planting, structures, fences, shrubbery
or other obstruction to obstruct vision planted or
maintained on any corner Lot which rises more than
three feet (3') above ground level within twenty-five feet
(25') of the intersection of any street lines.
16. No dwelling shall be erected, placed or permitted to
remain on any lot which has less than 2,400 square feet
of living space above ground, exclusive of open porches,
carports, garages and basements. House plan review is
required by Declarant or its designate (see number 18,
infra.)
The foundation of all houses shall have a brick veneer or
finished masonry other than poured molded cement or
pargeted block from the house plate to the ground
surface, which brick veneer shall be on the side of the
house facing the street and on the two sides of the
house facing the side lines. No brick veneer is required
on the side of the house facing the rear property line.
17. All Lots are required to observe any setback lines, and/or
side lines and/or rear yard lines as shown on the plat
attached hereto in addition to those applicable
requirements of any Frederick County Ordinance.
18. No building, structure, addition or exterior alteration
(including basketball backboards, rims and nets) or

improvements of any character, shall be constructed on
any Lot or dwelling located thereon, unless the "plan" of
construction, including quality of workmanship, design,
colors and materials, including siding specifications, shall
have been approved in writing by the DECLARANT, or its
designate, as being in harmony with the whole single
family section and especially the adjoining single family
residential properties.
19. No lot shall at any time be subdivided, conveyed or sold
except as a whole unless said sale or conveyance results
in a lot(s) larger than the lot size as shown on the plats
attached hereto and made a part hereof. This provision
shall not prohibit Boundary Line Adjustments of a minor
nature.
20. All of the covenants and restrictions herein shall be
binding and remain in full force and effect for a period of
fifteen (15) years from the date of this instrument and
shall be renewed automatically for additional successive
ten (10) year periods, unless changed by written
instrument agreed to by the lot owners comprising at
least seventy-five percent (75%) of the lots in the
subdivision.
21. The invalidation of any one of the covenants or
restrictions contained herein by judgment or Court Order
shall in no wise affect any of the other provisions which
shall remain in full force and effect. The failure of the
Lot Owners or the DECLARANT herein to enforce any
covenants or restrictions shall not be deemed to be a
waiver of the right to do so thereafter as to a default
occurring prior or subsequent thereto.
22. Each lot owner shall be responsible for maintaining and
keeping in good repair all drainage easements located on
the lot owner's lot. No drainage easement shall be
changed or relocated in any regard except with the
approval of Frederick County.
23. In the event that any lot owner does not maintain the
drainage easements over his lot(s) then the developer
and/or Frederick County may come upon said property
and make necessary repairs and perform whatever
maintenance is necessary, with the cost of the same to

be borne by said lot owner and in the event that said lot
owner does not pay for said repairs and/or maintenance
when billed then said charge shall become a lien on the
individual lot owner's lot. If requested, the lot owner, by
the acceptance of a deed, agrees to enter into any
agreement absolving Frederick County of any and all
liability with regard to said drainage areas.
SPECIAL RESERVATION OF DECLARANT
The Declarant reserves the right to waive, alter, add, amend or delete any of
the covenants and restrictions, alter any and all easements or other matters set
forth herein, at any time, provided that Restriction numbered 1 shall be exempt
from this provision.

1) Please provide all of the dimensional requirements for the proposed housing type. The size of the

THIS BOUNDARY LINE ADJUSTMENT AGREEMENT made and dated this
day of , 1999, by and between JENI COMPANY, a
Virginia corporation, of the one part, hereinafter referred to as JENI, and GLAIZE
DEVELOPMENTS, INC., A Virginia Corporation, of the other part, hereinafter
referred to as GLAIZE.
WHEREAS, Glaize is the owner of that certain parcel of land located in
Shawnee Magisterial District, Frederick County, Virginia, containing 5.5675 acres,
as shown on the Plat Showing Boundary Line Adjustment made by P. Duane
Brown, Land Surveyor, dated September 7, 1999 attached hereto and
incorporated herein, being a portion of the same property acquired by Glaize, by
deed recorded in the aforesaid Clerk's Office in Deed Book 738, at Page 426;
and,
WHEREAS, Jeni is the owner of that certain parcel of land located in
Shawnee Magisterial District, Frederick County, Virginia, containing 111.0855
acres, as shown on the Plat Showing Boundary Line Adjustment made by P.
Duane Brown, Land Surveyor, dated September 7, 1999 attached hereto and
incorporated herein, being a portion of the same property acquired by Jeni by
deeds recorded in the aforesaid Clerk's Office in Deed Book 926, at Pages 843
and 929 and Deed Book 946, at Pages 388 and 394; and,
WHEREAS, the parties hereto desire to adjust their respective boundary
lines, as more particularly set forth hereafter.
NOW, THEREFORE, WITNESSETH: That for and in considerationof the
premises and the benefits which will accrue by reason of this agreement, the
parties hereto do make the following boundary line adjustments:
1. That certain 0.0917 acre parcel of land owned by Jeni, more

by reference made a part hereof, shall be merged with and become a part of the
5.5675 acre parcel, which will result in Glaize's parcel of land containing 5.6592
acres, and the Jeni parcel of land containing 110.9938 acres.
2. That the boundary lines, as adjusted, and shown on the aforesaid
attached plat, shall constitute true and correct boundary lines of the parties
hereto, and Jeni, does hereby remise, remit and convey unto Glaize all of its right,
title and interest in and to the 0.0917 acre portion merged with the Glaize land.

This is to acknowledge receipt of your revised plans dated May 6, 1999 for the referenced
project. The plans appear satisfactory and are approved. Please advise the developer
accordingly. Please provide seven (7) sets of approved construction plans with
signed seal for VDOT distribution.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.
• Materials used and method of construction shall apply to current observed VDOT Road
& Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to the
satisfaction of the Department prior to inclusion into the Secondary Road System.
• Attached is a copy of the minimum requirements and information needed prior to
acceptance of subdivision streets into the Secondary System. This is the responsibility
of the developer.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the
street to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.

• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
• If mailboxes are to be placed along the roadway fronting lots, a minimum of 4' shall be
between the edge of pavement and the front of mailbox as shown on the RFD-1 or
appropriate substitute.
• Private entrances will be installed in accordance with modified entrance gutter. This is
the developer's responsibility.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibility.
• Any signs to be installed will be in accordance with attachments.
• 1 suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility
of any pavement settlement.
• A copy of any/all plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior
to issuance of any land use permit. Dedication should be made to the Commonwealth
of Virginia.
• A copy of any/all plats of dedication to public use (the County of Frederick) for drainage
easements or additional right-of-way required for implementation of this proposed
project should be provided for VDOT review prior to issuance of any land use permit.

Subdivision streets may be considered eligible for acceptance into the State Secondary System
when:
• Built according to plans approved by the Department of Transportation,
properly maintained since completion and
• Rendering a public service [serving three (3) occupied dwellings or three (3)
businesses per street].
THE FOLLOWING WILL BE REQUIRED TO BE FURNISHED TO THE COUNTY
PLANNING; DEPARTMENT AT LEAST THIRTY (30) DAYS PRIOR TO ADOPTION OF
THE RESOLUTION BY THE BOARD OF SUPERVISORS REQUESTING THE ADDITION:

This is to acknowledge receipt of your revised plans dated May 6, 1999 for the referenced
project. The plans appear satisfactory and are approved. Please advise the developer
accordingly. Please provide seven (7) sets of approved construction plans with
signed seal for VDOT distribution.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the
attendance of the contractor, various County agencies and VDOT prior to initiation of
work.
• Materials used and method of construction shall apply to current observed VDOT Road
& Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist
such that additional measures are warranted, such measures shall be completed to the
satisfaction of the Department prior to inclusion into the Secondary Road System.
• Attached is a copy of the minimum requirements and information needed prior to
acceptance of subdivision streets into the Secondary System. This is the responsibility
of the developer.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the
street to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.

• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
• If mailboxes are to be placed along the roadway fronting lots, a minimum of 4' shall be
between the edge of pavement and the front of mailbox as shown on the RFD-1 or
appropriate substitute.
• Private entrances will be installed in accordance with modified entrance gutter. This is
the developer's responsibility.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This is the developer's responsibility.
• Any signs to be installed will be in accordance with attachments.
• 1 suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility
of any pavement settlement.
• A copy of any/all plats of dedication for drainage easements or additional right-of-way
required for implementation of this proposed project should be provided to VDOT prior
to issuance of any land use permit. Dedication should be made to the Commonwealth
of Virginia.
• A copy of any/all plats of dedication to public use (the County of Frederick) for drainage
easements or additional right-of-way required for implementation of this proposed
project should be provided for VDOT review prior to issuance of any land use permit.

INFORMATION NEEDED PRIOR TO ACCEPTANCE OF
SUBDIVISION STREETS INTO STATE SECONDARY SYSTEM
Subdivision streets may be considered eligible for acceptance into the State Secondary System
when:
• Built according to plans approved by the Department of Transportation,
properly maintained since completion and
• Rendering a public service [serving three (3) occupied dwellings or three (3)
businesses per street].
THE FOLLOWING WILL BE REQUIRED TO BE FURNISHED TO THE COUNTY
PLANNING DEPARTMENT AT LEAST THIRTY (30) DAYS PRIOR TO ADOPTION OF
THE RESOLUTION BY THE BOARD OF SUPERVISORS REQUESTING THE ADDITION:
Three (3) copies of as -built construction plans showing:
• Roadway Geometrics
• Drainage & Drainage Easements
Three (3) copies of the final plat with date & place of recordation, deed
book number and page number.
3. Signed permits covering all utilities, publicly or privately owned, to
occupy or cross the right-of-way and quitclaiming any prior rights.
4. Bond to guarantee workmanship and performance of material for one year from
date of acceptance. (See reverse side for schedule.)
5. Maintenance Fee - check payable to the "Virginia Department of
Transportation". This fee is based on the length of the streets involved from the
date of acceptance to the end of the fiscal year (June 3(r). No maintenance fee
