RECITALS A. The Declarant is the owner in fee simple of that certain tract of land containing 32.9543 acres, more or less, lying and being situate in Opequon Magisterial District, Frederick County, Virginia (the "Property"), as more particularly described on that certain plat titled "Final Subdivision Plat Old Dominion Greens Phase II", drawn by Jason G. Bly, L.S., dated November 1, 2006 (the "Subdivision Plat"), a copy of which is attached hereto and incorporated herein by reference as if set out in full. B. The Property is a portion of the real estate previously conveyed to the Declarant by that certain Deed dated March 18, 1976, of record in the Office of the Clerk of the Circuit Court of Frederick County, Virginia (the "Clerk's Office"), in Deed Book 456, at Page 32. Tax Map No. 75-A-117 (Parent Tract) C. The Property has been subdivided into Lots 69 through 152 and Lots 182 through 184, inclusive, of Old Dominion Greens, Phase ll, Open Space "A" and Open Space ;B", and certain streets, as set forth on the attached Subdivision Plat. The attached Subdivision Plat accurately shows the metes and bounds of the subdivided lands, together with the dimensions of each Lot thereof. D. The Subdivision Plat also sets forth the location of the building restriction lines, drainage easements, gas easements, electric easements, sanitary sewer easements, water easements, grading easements, private access, utility and bicycle/pedestrian easement, landscape easement, storm sewer easements, storm water management access easement, Shenandoah Gas Co. easements, Potomac Edison Company easements, and other matters, as more fully set forth on the attached Subdivision Plat. E. The Declarant has previously subdivided and dedicated Lots 1 through 68, Michael L. Bryan 9 Court Square 2"d Floor Winchester, VA •- W inclusive, of Old Dominion Greens, Phase I, by the terms of that certain Deed of Dedication dated July 20, 2007, of record in the aforesaid Clerk's Office as Instrument No. 060022304 (the "Existing Deed of Dedication"). As set forth in Article V of the Existing Deed of Dedication, the Declarant reserves the right to add additional phases to the scheme of development established by the Existing Deed of Dedication and to subject additional lands to the provisions of the Existing Deed of Dedication. F. As described herein and as described upon the attached Subdivision Plat, Declarant hereby subjects the land situate in Old Dominion Greens Phase II to the terms, conditions and provisions of the Existing Deed of Dedication, as more fully set forth hereinafter. G. The Declarant now desires to subdivide the Property into lots to be known as Old Dominion Greens, Phase II. The subdivision of the Property, as it appears on the attached Subdivision Plat, is with the free consent and in accordance with the desires of the undersigned Declarant. The Declarant further desires to subdivide the Property in accordance with the provisions of Title 15.2, Chapter 22, Article 6 of the Code of Virginia (1950, as amended) as are applicable and in force and effect as of the date of execution of this Deed of Dedication. NOW, THEREFORE, THIS SUPPLEMENTAL DECLARATION WITNESSETH: That for and in consideration of the premises and the benefits which will accrue by reason of this Supplemental Declaration, the Declarant does hereby subdivide the Property, hereby designated as Old Dominion Greens Phase 11, lying and being situate in Opequon Magisterial District, Frederick County, Virginia, and being more particularly described by that certain plat titled "Final Subdivision Plat Old Dominion Greens Phase II", drawn by IJason G. Bly, L.S., dated November 1, 2006, containing Lots 69 through 152 and Lots 182 through 184, inclusive, Open Space "A" and Open Space "B"and certain streets, easements, and other matters as more particularly set forth thereon, which Subdivision Plat is attached hereto and incorporated herein by reference as if set out in full. 2 Michael L. ARTICLE I DEFINITIONS The following additional Definitions are hereby added to Article I of the Existing Deed of Dedication: Section 3. "Common Area" shall also mean and refer to those certain parcels of land described as Open Space "A" and Open Space `B" on the attached Subdivision Plat (Sheet 30 of 35 and Sheet 34 of 35), and such additions thereto as may hereafter be brought within the jurisdiction of the Association. Section 7. "Lot" shall also mean and refer to any of Lots 69 through 152 and Lots 182 through 184, inclusive, as designated upon the attached Subdivision Plat, and any additional Lots added pursuant to Article V of the Existing Deed of Dedication. Section 9. "Owner" shall also mean and refer to the record owner, whether one or more persons or entities, of a fee simple title to Lots 69 through 152 and Lots 182 through 184, inclusive, in Old Dominion Greens Phase II, as shown on the attached Subdivision Plat, including contract sellers, but excluding those having such interest merely as security for the performance of an obligation. All of the Lots shown on the Final Subdivision Plat attached hereto shall be subject to the restrictions, covenants, and conditions as set forth in the Existing Deed of Dedication of Old Dominion Greens Phase I dated July 20, 2006, of record in the aforesaid Clerk's Office as Instrument No. 060022304, which are incorporated herein by reference as if set out in full, which shall constitute covenants real running with the land and shall be binding upon all parties having any right, title or interest in and to the aforesaid Lots or any part thereof, their 3 Michael L. Significant residential growth in Frederick County has resulted in the schools serving this area having student enrollments exceeding the practical capacity for a school. The cumulative impact of this project and others of similar nature (Village at Artrip Project, Crosspoint, and Canter Estates) coupled with the number of approved, undeveloped residential lots in the area and other projects will necessitate a future construction site of 15 to 20 acres for the purpose of a new elementary school facility to accommodate increased student enrollments. The impact of this project on current and future school needs should be considered during the approval process. Response: The note on Sheet I has been corrected to state there are only 29 pages in the plan set. Comment 9: According to Section 144-17(G)l of'the Frederick County- Subdivision Ordinance. in no case shall the street serve more than thventn� five (25) lots. Lack_ smith Drive has 26+ lots. and Upperville Drive has 28+ lots. Please address this issue. Response: The layout along Ladysmith Drive has been corrected to allow only 25 lots to front onto the road. Lot 88 now has access off of Bridgewater Drive. Lot 102 now has access off of Paris Court. Also. Lot 86 has been modified to have the smaller lot frontage along Upperville Drive. The elimination of these three lots brims the total from 28 to 25 along* the Ladysmith cul-de-sac. These three layout modifications can be seen on Sheet 3 of the plan set. As for Upperville Drive, the overall layout of Phase 2 has been modified to have the Emory Court intersection extend off of Upperville Drive, not Ladysmith Drive, like it originally did in the Phase 3 plans. This modification allows the removal of some of the lots from the cul-de-sac count and thus reduces the total number of lots on the Upperville Drive cul-de-sac from 29 to 23. This is the developer's responsibility. • Any entrances constructed from the referenced street(s) shall meet VDOT minimum standards. This is the developer's responsibility. • Any signs to be installed will be in accordance with attachments. • I suggest any utilities and/or storm sewer placed within the proposed right-of-way be backfilled completely with C.R.
