Enclosed find a copy of your March 1, 2001 letter to Doug Legge concerning such subdivision, which letter notes that the proposed 1.9280 acre lot fronting on North Kent Street "...not be approved until North Kent Street is accepted into the state secondary road system." As you may be aware, VDOT is presently constructing the extension of North Kent Street. Further, on October 23, 2002, two (2) Deeds were recorded in the Frederick County Circuit Court Clerk's Office for purposes of conveying sufficient land to the Commonwealth of Virginia for the construction of improvements to North Kent Street extended from the City/County line to Brick Kiln Road. One Deed, dated October 8, 2002, represented conveyances from four (4) separate Grantors/Landowners, including Orchard Terrace, for minor strips or parcels of land. The Deed dated October 15, 2002 represented a conveyance by Orchard Terrace, alone, of the approximate 50' wide strip over which Kent Street extended runs. No consideration was paid by the Commonwealth to Orchard Terrace or any of the other Grantors for these conveyances, and these conveyances essentially represent dedications for purposes of public road construction. I understand that VDOT is hopeful of having the new portion of the road constructed and paved by the end of November, 2002. Of course, this is dependent upon weather conditions. I would appreciate your contacting me so that we can discuss what steps are necessary for the approval of the 1.9280 acre lot fronting on North Kent Street Extended in view of the conveyances/dedications to the Commonwealth of Virginia and the status of the road construction. Planning and Zoning: Public Meeting Requirement The Subdivision Ordinance requires that land divisions in the M2 (Industrial General) Zoning District, without an approved master development plan, be presented to the Board of Supervisors for final approval. This project is zoned M2 and does not contain an approved MDP; therefore, Board review and action is necessary. Staff Review This parcel presently contains a residence fronting on Smithfield Avenue, and lumber storage. The lumber storage occupies approximately 13 of the 13.3-acre parcel. The immediately surrounding properties are dominated by manufacturing and industrial uses, although there are residences located adjacent to the Smithfield Avenue frontage. The proposed subdivision would establish three lots: 10.9564 acres, 2.0237 acres, and 0.146 acres. Each lot will be required to have state road frontage. Therefore, the final plat must reflect the location of the required state road frontage for the 2.0237 acre lot as North Kent street is currently not a state road. STAFF CONCLUSIONS FOR 02-21-01 PLANNING COMMISSION MEETING: Staff recommends approval of this subdivision application contingent upon the applicant's satisfying all review agency comments. PLANNING COMMISSION SUMMARY & ACTION OF 02/21/01 MEETING: There were no citizen comments. The Planning Commission believed the proposed division satisfied the requirements of the Subdivision Ordinance, except as noted, and no issues were raised. Edwards RE: Rich Products Corporation & Plumly Flooring Expansions As you were unable to meet today regarding the above subject, I am putting the details of such in this memorandum and request that the accompanying resolution be presented to Council at their scheduled meeting on Tuesday, January 9", 2001 requesting the Commonwealth Transportation Board provide Industrial Access Road funding. Rich Products Corporation and Plumly Flooring have intended expansion plans for equipment during 2001 totaling $3,349,494.,(ses their accompanying letters detailing these plans). As a result, they desire to have Kent Street to Brick Kiln Road paved to provide improved accesY safely to Route 11 by redirecting their traffic from the residential area in that vicinity. Even though the majority of this road lies in the County, the qualifying businesses for such funding are located in the City. VDOT has estimated the cost of this project to be approximately $140,000. Also, VDOT would like to make some improvements to Brick Kiln Road estimated at a cost of 460,000 at the same time using Industrial Access Roads Funds. As you know, Industrial Access Road Funds are available at 10% of the proposed capital investment by a qualifying business. As nearly 1 /3 of the two company's investments, (9936,494.) was accomplished within the last six months, we would like to have the resolution passed now in order to include this amount in the total should it be needed to fund the entire project. Please find enclosed with this memorandum: 1 . Copies of each company's proposed expansion plans. 2. Plat of the property and letter from Bryan & Coleman showing what Plumly Flooring now owns and what the Plumly family retained. 3.
