Dear Mr. Dooley:
This is to acknowledge receipt of your revised plans signed and sealed 5/06/09 for the
referenced project.'' The plans appear satisfactory and are approved. Please advise the
developer accordingly. please provide 5 sets of approved construction plans with
signed seal for VDOT distribution.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance
of the contractor, various County agencies and VDOT prior to initiation of work.
• Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such
that additional 'measures are warranted, such measures shall be completed to the
satisfaction of the Department prior to inclusion into the Secondary Road System.
• Attached is a :copy of the minimum requirements and information needed prior to
acceptance of subdivision streets into the Secondary System. This is the responsibility of
the developer.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street
to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any undetermined
length of time. VDOT will also require 48 hours notice for inspections.

• The appropriate land use permits shall be obtained before any work is performed on the
State's right-of-way. The permit is issued by this office and will require a minimum
processing fee, surety bond coverage, and the salary & expenses of a State assigned
Inspector.
• If mailboxes are to be placed along the roadway fronting lots, a minimum of 6" shall be
between the face of curb and the front of mailbox as shown on the RFD-1.
• Private entrances will be installed in accordance with the CG-913 detail. This is the
developer's responsibility.
• Any entrances constructed from the referenced street(s) shall meet VDOT minimum
standards. This' is the developer's responsibility.
• Any signs to be installed will be in accordance with the Manual on Uniform Traffic Control
Devices, 2003 Edition, and the approved plans.
• I suggest any utilities and/or storm sewer placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-B Stone. This will greatly reduce the possibility of
any pavement settlement.
• A copy of any/all recorded plats of dedication for drainage easements or additional right-of-
way required for implementation of this proposed project should be provided to VDOT prior
to issuance of any land use permit. Dedication should be made to the Commonwealth of
Virginia.
• A copy of any/all RECORDED PLATS of dedication to public use (the County of Frederick)
for drainage easements or additional right-of-way required for implementation of this
proposed project should be provided for VDOT review prior to issuance of any land use
permit.

on a couple of things before approval is met. Also, approval cannot be met until staff receives
all review agencies having no additional comments.

Dear Mr. Jerussi:
Upon review of the site plan dated January 18, 2008, we offer the following comments:
I. Cut and fill slopes shall be adequately stabilized. Fill slopes greater than 3:1 will require a slope
stability analysis and maintenance plan.
2. Provide adequate stabilization for on -site channels and outlets - no concentrated flow shall be
unstabilized.
3. Provide adequate drainage or other protection whenever water seeps from a slope face.
4. Provide calculations for outlet protection for pipes and channels.
5. Provide measures to minimize channel damage when conducting in -stream construction.
6. All applicable federal, state and local regulations pertaining to working in or crossing live
watercourses shall be met - all applicable permits shall be submitted with application (§79-
3.A.2 Frederick County Code).
7. Provide a note stating that the bed and banks of a watercourse shall be stabilized immediately
after work in the watercourse is completed.
8. Demonstrate that two (2)-year runoff from the site does not overtop banks of natural channels
and does not cause erosion.
9. Provide an analysis of the existing and ultimate characteristics of the watershed.
10. Provide responsible party and maintenance plan for the proposed detention facilities.

12. E & S Narrative Requirements - Critical areas — Provide a description of areas on the site which
have potentially serious erosion problems. Include slopes which are steeper than 3:1 as critical
areas.
13. E & S Narrative Requirements - Stormwater runoff considerations - Will the development site
cause an increase in peak runoff rates? Will it cause flooding? Describe the strategy to control
Stormwater runoff.
14. Label areas with potentially serious erosion problems.
15. Provide the Responsible Land Disturber signature block on the plans.
16. Ensure that the backwater condition for the post -developed 100-year storm does not impact
adjacent properties .
17. Include the standard MS-19 E&S notes. Please contact Michael Newlin of the Frederick County
Public Works Department for a copy of these notes.
18. The site specific seeding schedule shown on the E&S notes and details sheets reference the
Piedmont area. The site is located in the Mountain area of the state.
19. All slopes that are steeper than three horizontal feet to one vertical foot will require a slope
stability analysis performed by a qualified geotechnical engineer. Please note that the slope
stability analysis will be required prior to land disturbance permit approval. Should grading
changes be required in order to achieve slope stability after site plan approval, a revised site plan
will be required prior to granting a land disturbance permit.
20. The proposed grading plan shows filling in the 100-year floodplain of Opequon Creek. An
approved flood plain study will be required prior to the issuance of a land disturbance permit. In
addition to this, all fill in flood plain areas will require special annorment to prevent erosion
from flood waters. This design shall be certified by a professional engineer.
21. Provide storm water management calculations for the site.

upstream from the culverts, the backwater condition for the 100-year storm shall not reach the
downstream toe of the dam.
23. Per the approved proffer statement, provide Water Quality BMPs for the site according to Table
2-3 of the Virginia Stormwater Management Regulations.
24. Indicate the location of wetlands on the plan sheets.
25. Basins shall maintain structural integrity during 100-year, 24 hour storm event. (79-3.A.1

26. Install temporary stream crossings of non -erodible material.
27. On Sheet 13, remove unreinforced detail, as all silt fence shall be wire reinforced.
28. The installation of the proposed triple box culverts appears to be disturbing more than 300-linear
feet of stream bed. A copy of the wetlands permit from the USACE will be required prior to
issuance of a land disturbance permit.
29. On sheet 3, provide silt fence at the northern side of the stream at the location of the proposed
triple box culverts.
30. On sheet 3, the drainage area just west of Sediment Basin D is too large to be controlled by silt
fence.
31. On sheet 7, the silt fence coming down the hill toward the construction entrance will likely
channel water toward the bottom of the Swale. Provide super silt fence near the downstream side
of the stream crossing to provide additional support where the water will collect.
Once these comments have been addressed, submit one (1) copy of the plan for further
review.

Planning Staff has reviewed the above -referenced subdivision design plan to determine if
administrative approval can be granted. At this time, administrative approval cannot be granted.
This site plan is denied until the issues in this letter, as well as all issues of the other review
agencies, have been adequately addressed. Please review Staff s comments listed below and then
prepare a revised site plan which adequately addresses each concern.
1) Proffers. Provide a proffer page within the Subdivision Design Plan.
2) Master Development Plan. Provide a sheet showing the complete layout of the property
as determined by the Haggerty MDP.
3) Setbacks. Provide the required setbacks and maximum heights for each lot and housing

RE: Opequon Crossing Phase I
Dear Mark:
I have had the opportunity to review the Subdivision Plans for Opequon Crossing Phase I,
submitted to this office on November 24, 2008. The Planning Department needs clarification
on a couple of things before approval is met. Also, approval cannot be met until staff receives
all review agencies having no additional comments.
1. Note what the open space acreage is between lots 271 and 272..
2. Should there be a berm put in place in front of lots 209, 208, 207, 206, 308, 309? If
so, annotate a detail.
3. Along the limits of clearing and grading, please show how the natural pond will be
protected. If a fence is what is being used to protect; please provide detail (see sheet
14).
Please address the above comments and resubmit. I have enclosed a marked copy of the
plans to assist with the revisions. If you have any questions, please feel free to call, 540-665-
