Box 601 Winchester, Virginia - 22601 s Ir RESOLUTION BY THE FREDERICK COUNTY BOARD OF SUPERVISORS At a regular meeting of the Board of Supervisors of Frederick County, Virginia, held this 24th day of August, 1988, it was duly moved and seconded that the following resolution be adopted: BE IT RESOLVED, That the Virginia Department of Transportation is hereby requested to add the following road to the Secondary System of Frederick County pursuant to Section 33.1-229 of the Code of Virginia, 1950, as amended: Highview Road, Opequon Estates, Sections I b II, Block A, 1,124 feet (.21 of a mile) from the intersection of 1330 Riverdale Circle to 1,124 feet+ or .21 mile northwest to the cul-de-sac, as described in Deed Book 473, Page 19, dated October 12, 1976. AND FURTHER BE IT RESOLVED, That the Board does guarantee the Commonwealth of Virginia an unrestricted right-of-way of 60 feet as described in the above deed book and referenced page numbers with necessary easements for cuts, fills, and drainage. BUSHMAN ( 703 ) 984-4133 RESIDENT ENGINEER June 18, 1987 Ref: Opequon Estates Subdivision Off Route 1330 Frederick County This is in response to your memorandum dated June 9, 1987 pertaining to the above referenced subdivision. After making a field review, we have the following comments. Highview Road does not have public service to qualify for addition as there is only one house which is now under construction. We are concerned that the road has not been maintained since construction as the ditch lines are not open properly. It is noted drainage is relieved from the roadway at several places without drainage easements. Also it is noted on the approved plans paved or rock ditches are called for; in lieu of this it is possible the developer may want to install Enkamat or Miramat. At the intersection of Riverdale Circle the radii have not been constructed according to the approved plans. On Mt. View Drive there are two occupied dwellings and two under construction. This street would be eligible when it meets the minimum of three occupied dwellings. It is noted this street has not been properly maintained since completion as the surface water is relieved at several locations without adequate drainage easements nor have the protective coverings been placed in the ditch line as indicated previously. Again, Enkamat or Miramat is acceptable. There are several trees on this street which must be cut. At the end of the cul-de-sac there is a basketball goal which must be removed from the right-of-way before we could add this street. Also there is an aerial power line which is below the minimum 18' clearance which would have to be removed or raised. Both streets would require resealing surface treatment. Reference is made to our conversation this morning concerning the High- way Department taking over maintenance of Mountainview Drive in Section 1 of Opequon Estates Sub -Division, which was approved by the Board of Super- visors and Highway Department on October 12, 1976. This road was built to state highway specifications and was inspected under the supervision of Mr. King, who represented the State Highway Depart- ment at that time. Opequon Estates posted a $10,000.00 cash bond with Dom- inion Bank to cover construction and maintenance of Mountainview Drive and Highview Drive (each of these roads is approximately 1,000 feet long) until such time as we constructed three houses on each street. The Highway Depart- ment informed us at the time, through Mr. King, that when we had three houses on each road they would take over the side streets for maintenance. Mr. King approved the method and type of construction. They accepted the main street a long time ago. We have maintained the roads in good condition and know of no reason why the Highway Department should not take over Mountainview Drive as we have three houses built and two more are under construction. We have a $10,000.00 cash bond at Dominion Bank to insure construction and maintenance of these two streets in favor of the Frederick County Board of Supervisors. We now kindly request that the Highway Department accept Mountainview Drive maintenance and release $5,000.00 of the bond at Dominion Bank. Riley, Jr., Frederick County Administrator, has passed along your request for June 3, 1987 for the release of the bond for the above referenced street. I have forwarded your request for review to the Virginia Department of Transportation and would expect a response in the very near future. As I am sure you are aware, Frederick County cannot release any bonded funds for this road until the Department of Transportation is satisfied that the road has been constructed to their standards. Once the Department of Transportation is satisfied, a resolution can be drawn up for Board of Supervisors approval and release of funds can be expedited. Again, Mr. William H. Bushman, of the Department of Transportation, has been informed of this matter and will be getting back in touch with the County in the very near future.
