for subsurface septic tank system. This tentative approval is based on soil evaluations
which were conducted according to Health Department policy by digging test holes on each
site to a depth of approximately feet. Each lot will be judged on an individual basis
at the time an aDDli.cant seeks a health permit to install a subsurface drainfield system.

PLAT REVISION
THIS PLAT REVISION, made this day of March, 1979,
by Opequon Estates, Inc., a corporation organized and existing
under the laws of the State of Virginia.
W I T N E S S E T H:
WHEREAS, Opequon Estates, Inc., by plat of record in the
Clerk's Office of the Circuit Court of Frederick County, Virginia
in Deed Book 473 at Page 20, did subdivide certain property in
Frederick County known as Blocks A and B, Section II, Opequon
Estates;
WHEREAS, Opequon Estates, Inc. is the fee simple owner of
Lots-3 and 4, Block B, Section II of Opequon Estates; and
_ .WHEREAS, Opequon Estates, Inc, desires to revise the
aforesaid plat to add to the said Lot 4 all of that portion
previously belonging to Lot 3, Block B, Section II of Opequon
Estates between the two lines "original division line" and the
new -northern boundary of Lot 3-as shown on the plat of H. Bruce
Edens, C.L.S. dated January 30, 1979 which is attached to and
made a part of this plat revision.
NOW THEREFORE, Opequon Estates, Inc. does revise the afore-
mentioned plat of Lots 3 and 4, Block B, Section II of Opequon
Estates, and further states that said revision is with the free
consent and with the accordance of the desire of said corporation
.the fee simple owner of the property included in said plat
revision.

THIS DEED OF EASEMENT made this day of
1987, by and between SHENANDOAH COLLEGE AND
CONSERVATORY OF MUSIC, hereinafter called the Grantor and THE
COUNTY OF FREDERICK, VIRGINIA, hereinafter called the Grantee.
WITNESSETH: That for and in consideration of the mutual
benefits accruing to the parties herein for the provision of
proper drainage for High View Road, the Grantor does hereby
grant and convey unto the Grantee a non-exclusive easement for
the purpose of construction, operation and maintenance of
drainage facilities from High View Road over the following
described lots in Opequon Estates Subdivision located in
Stonewall Magisterial District of Frederick County, Virginia:
A non-exclusive easement, twenty (20) feet in width
running in an easterly direction from High View Road
to Opequon Creek, the northern ten (10) feet of the
easement being a ten (10) foot strip along the
southern boundary of Lot 14, Section 1 of Opequon
Estates and the southern one-half of the easement
being a ten (10) foot strip contiguous to the first
along the northern boundary of Lot 13, Section 1 of
Opequon Estates Subdivision as shown by plat of
record in the Clerk's Office of the Circuit Court of
Frederick County, Virginia, in Deed Book 385 at Page

This is to acknowledge receipt of your letter dated November 1, 1988 with
attached information for addition of the above referenced street into the
State's Secondary System. In review of the date, the following corrections or
information is required pending addition.
- Resolution - The date of recordation for the final plans in Deed Book 473,
Page 19 is May 4, 1977 in lieu of October 12, 1976. Also Deed Book 680,
Page 474, dated May 13, 1988 should be included for the additional
right-of-way easement required for portion of street constructed on private
property. See copy returned marked in red.
- Letter of Credit must be in effect for a period of twelve (12) months from
the date the streets are added to the System. (submitted copies returned)
- As built plans to be revised to include right-of-way easement required for
portion of street constructed on private property on Lot No. 16. (copy
returned)
- Returning maintenance fee checks in the amount of $100.00 each for $200.00
(Check No. 2013 and No. 3183)
- Final plans and right-of-way easement - received one (1) copy of each. Need
(3) copies each from the Clerk's Office showing deed book and page numbers
with date of recordation. (submitted copies returned)
- Quitclaim Permits for utilities placed within the right-of-way must be
submitted in accordance to the Department's Land Use Manual.
- The Potomac Edison Company - received three (3) copies. Sketch shows plan
view location only. No reference to aerial clearance, right-of-way, edge of
pavement, etc. (copies returned)
- C & P Telephone Company - did not receive permits for their utility within
the right-of-way. I was informed their lines were attached to Potomac
Edison's pole line easement and permits were not required. Quitclaim
Permits are needed.

alternative, the developer may construct the streets under direct inspection of the Department of Highways
and Transportation, the cost of which shall be borne by the developer. In those jurisdictions where the county
staff administers a comprehensive subdivision construction inspection program the Department may also
waiver the surety requirement. Surety may be in the form of a performance bond, cash deposit, or other form
mutually acceptable to the Department and the developer. Any surety other than bond or cash deposit must
receive approval from the Secondary Roads Division and the Fiscal Division prior to processing.
B. Maintenance Fees
The Secondary System budgets within the several counties are effective for a fiscal year, running from July 1
through June 30 of the following calendar year. Any streets added subsequent to July 1 of any given year will
not have been accounted for in the budgetary process. Therefore, a maintenance fee in accordance with Table
III will be required for any subdivision street addition which will be effective at any time other than July 1.
Any fraction of a month is to be counted as a whole month. Official acceptance dates cannot be made retro-
active, so when extenuating circumstances prevent official acceptance as of July 1, it will be satisfactory to
request that the effective fee date be retroactive to July 1 and, if approved by the Secondary Roads Division,
no maintenance fee will be required. Keen discretion must be exercised by field engineers in making judg-
ments as to what constitutes an extenuating circumstance. Administrative delays beyond the control of the
developer would be considered an extenuating circumstance. But delays caused by the developer's failing to
comply with certain requirements would not be considered extenuating.
2. Rights of Way
A. Widths
Right of,way widths in accordance with Tables 1 and 1A are required to be dedicated to public use. If
sidewalk is to be provided, additional right of way width will be required to the extendt necessary to
accommodate the sidewalk.
B. Landscaping
All disturbed areas within the dedicated rights of way and easements shall be restored with a vegetation which
is compatible with the surrounding area. No streets shall be accepted for maintenance where there is visual
evidence of siltation unless appropriate protective measures in accordance with the Department's construction
practices have been taken. Any planting of trees and/or shrubs shall be in accordance with the Department's
Environmental Quality Division's "Guide for Tree and Shrub Planting on Virginia's Streets and Highways."
--�- C. Utilities
It is the policy of the Department to require a clear and unencumbered dedication of rights of way on all
additions to the system. Therefore, any easements or other interests within the platted right of way must be
quji ,!aimed of any prior rights therein in exchange for a permit to occupy the space. This permit shall be
processed by the Residency, once the acknowledgment of acceptance of the street has been received, and a
route number has been assigned. No inspection or guarantee fee will be required for the 'issuance of the permit
in this instance. All longitudinal underground utilities shall be located under the shoulder of the road insofar
as is practical.
Commission policy prohibits the open -cutting of paved or surface -treated roads. Therefore, all lateral under-
ground utilities to be installed prior to the acceptance of the street should be installed before the final surface
application.
D. "Spite Strips"
The Department will not approve plans that include reserved or "spite" strips which prohibit the use of streets
by adjacent properties, whether within or outside the development proper.
3. Drainage
Drainage facilities, including off -site facilities when necessary to provide adequate drainage, shall be provided in
accordance with the Department's current "Location and Design Division Drainage Manual."
A. Easements
Drainage easements shall be provided from all drainage outfalls to extend to a watercourse, defined on page
6, or furnish an acceptable agreement from county authorities to save the Department harmless from future
claims.
In instances where developments divert more intensified runoff into existing VDH&T facilities to the extent
that the facilities must be adjusted, such adjustments shall be at the developer's expense, and the developer
will be required to furnish any additional easements thus required.
B. Curb and Gutter
It is not the sense of the Department that curb and gutter be one of its requirements for subdivision streets.
However, when curb and gutter have been selected for one reason or another, widths between faces of curbs

Reference is made to Mr. Lam's letter of August 8, 1988,
approving the road for acceptance into the highway system and
the other documents delivered to you as per our letter of July
28, 1988.
Enclosed are two (2) checks for $125.00 each from the writer
and Mr. Denny Cole which covers the maintenance fee for ten (10)
months (September 1, 1988 - January 1,.1989). Also an Irrevoc-
able Letter of Credit No. SSV-091 from Dominion Bank which covers
the $3,750.00 bonding requirements. As far as I know, this
covers all the paperwork required for the Board of Supervisors
to approve a resolution accepting this road into the highway
system for maintenance.

PRIOR TO ACCEPTANCE INTO STATE SECONDARY SYSTEM
Subdivision streets may be considered eligible for acceptance into the State
Secondary System when:
built according to plans approved by the Department of Transportation,
properly maintained since completion and
rendering a public service (serving three (3) occupied dwellings per
street).
The following are to be furnished to the County Planning Department at least
thirty (30) days prior to adoption of the resolution by the Board of
Supervisors requesting the addition:
One (1) copy of as -built plans showing:
Roadway geometries
Drainage and drainage easements
Three (3) copies of final plat with date & place of recordation, deed
book number and page number
Maintenance fee - check payable to "VA Department of Transportation"
A maintenance fee is required. It is based on the length of the
streets involved from the date of acceptance to the end of the
fiscal year (June 30). No maintenance fee is required if the
addition as effective July 1st. Schedule:
Less than 1/4 mile - at the rate of $300.00 per
year @ $25.00 per month r
1/4 mile to 1/2 mile - at the rate of $600.00 per
year @ $50.00 per month
Over 1/2 mile - at the rate of $1,200.00 per mile
per year prorated monthly

This letter is a follow up to nay me-ating with you and Mr. James Wilkins, Sr. on
February 10, 1988 to the above referer=. Upon completion of my field inspection
to the aforem.ntioned, I offer Urie following comIents and recowv.ndations before
this road will be eligible for addition to the State Secondary System-.
I. The culvert at the end of the intersection of Riverdale Circle has a
heavy accumulation of silt &-id debris and will be required to be
cleaned out. Also the ditch line at this location will need some -
attention at the positive drainage.
2. It- was noted at several locations on the roadway surface that it had
concrete spillage and the roadway surface had numerous impressions
located in the wheel tracks. The concrete shall be moved from the
roadway surface and the impressions patched out prior to resealiry4 the
entire surface area of the street.
3. The cul de sac at the end of the street shall maintain a forty (40)
foot radius pavement with, shoulders and ditches in accordarx--e with the
approved plans. The shoulders and ditches will also have to be
reconstructed on the street and shall be confined within our right-of-way
limits in both cut and fill sections and carried to an improved defined
water route.
4. It was rioted that you have three (3) occupied dwellings and two (2)
presently under construction. Itie private entrance for lot 19 Block A,
Section 2 will not require a ;pipe at this location, however the entrance
shall be installed in accordance with our private entrance requirements,
with a copy I am attaching. Wts number 12 and 15 in Section Number 1
and lots number 16 and 17 in Block A, Section 2 will require a 15" CM
culvert pipe with entrances installed to our minimum requirements.
5. Vegetation must be removed within the right-of-way and all bare spots
hydroseeded back to the property lines.
It is noted on that the approved plans t the paved or rock ditches are
called for at the intersection of Riverdale Circle. Please govern by
the letter sent to Mr. Steven Gyurisin, dated June 18, 1987 from
Mr. K. D. Walker which I am attaching.

7. For you information I am attaching a copy of the data needed for
subdivisions to each prior to acceptance into the State Secondary
System.
8. A standard Virginia Department of Transportation stop sign will be
required at the intersection of Highview Road and Riverdale Circle.
It is, hoped that the contents of this letter will be helpful in getting the
proposed streets in an acceptable condition for addition to the State secondary
System.

VF01ZMATION AND DATA NEEDED FOR SUBDIVISION STREETS PRIOR TO ACCEPTANCE INTO
STATE SECONDARY SYSTEM
Subdivision streets may be considered eligible for acceptance
into the State Secondary System when built according to plans
approved by the Department of Highways and Transportation,
properly maintained since completion and rendering a public
service. (Public service is generally defined as serving three
(3) occupied dwellings.)
The following is to be furnished to the County Subdivision
Administrator at least three (3) days prior to the adoption
of the resolution by the Board of Supervisors requesting
the addition.
One (1) copy of plans showing:
Roadway geometrics.
Drainage and drainage easements.
Date and place of recordation, Deed Book number,
and page number.
Three (3) copies of final plat.
Maintenance fee - check payable to "Treasurer of Virginia".
Maintenace fee 7s required based on the length
of the streets being taken into the system from
the date of acceptance to June 30, (the end of
the fiscal year) . No maintenance fee is required
if the addition is effective July 1st.
Less than 1/4 mile --. at .th:r 'a of $300.00 per
year @ $25.00 per month. 1/4 mile to 1/2 mile -
at the rate of $600.00 per year @ $50.00 per month.
Over 1./2 mile - at the ratge of $1,200.01 per mile
per year prorated monthly.
Bond to guarantee workmanship and materials for one
year from date of acceptance.
Less than 1/4 mile - $3, 750.00
1/4 mile to 1/2 mile - $7, 500.00
Over 1/2 mile - at the rate of $15,000.00 per mile
Signed permits covering all utilities. publicly or privately
owned, to occupy or cross the right of way and quitclaim-
ing any prior rights are in hand to be processed after

Dear Mr. Edens:
We are returning one copy of the plans and contours on the
above referenced subdivision which.has been reviewed by our Staunton
District Office.
The 15" pipe proposed under Highview Road at the intersection
with Riverdale Circle to be increased to 1811 size. Some type of
erosion control such as sod, paved or rock ditch to be provided in
the roadway ditch on grades over approximately three percent or
where erosion is evident.
It appears that the stream running through Block B is well
defined not -requiring an easement. We assume that the proper pipe
sizes and drainage easements have been provided on Riverdale Circle
under Section I.'
This Department wishes to make a review of the proposedpgaved
ditches during construction and again prior to acceptance into the
Highway.System.
