REVIEW AGENCY COMMENTS:
DEPARTMENT OF TRANSPORTATION: See attached comments dated
09/23/94.
INSPECTIONS: No comment at this time. Shall comment at the
time of building site plan review.
FIRE MARSHAL: Posted fire lanes will be required at all fire
hydrant locations. All previous comments on fire and rescue
issues will still be required on any individual site plan
submittal for review.
COUNTY ENGINEER: Clarify the drainage easement from lot 1B
across lot 1A to the detention pond. Also, indicate the
existing access drive serving lot 1A, it appears that the
drainage easement across lot lA should coincide with the
culvert under the access drive.
LFPDC SOIL AND WATER CONSERVATION: What was submitted to us
does not constitute an E&S Control Plan. However, we do not
see much potential for environmental damage to occur on the
site.
PLANNING AND ZONING: There is no master plan in existence for
this project, so waiver of that requirement is recommended.
This proposal meets all ordinance requirements. The developer
of this project will be responsible for completing a
maintenance agreement between the owner of the property where
the storm water detention facility is located and the County.
This must be accomplished before the street can be taken into
the secondary road system.
STAFF RECOMMENDATION: Approval with the condition that all
review agency comments are adequately addressed.
SUMMARY OF PLANNING COMMISSION ACTION: The Planning Commission
heard this application at their regular meeting on November 2,
1994. There was no discussion and there was no public opposition.
The Commission unanimously recommends approval as presented.

Dear Mr. Negley:
As requested I am enclosing for the referenced project Land Use Permit Application No.
65571 and an irrevocable letter credit surety bond form.
The application will need to be completed in accordance with the enclosed example, surety
in the amount of $10,000 obtained, and returned with three sets of the approved site plan
and check made payable to VDOT in the amount of $40.00. Upon receipt a permit
application of this nature takes approximately thirty to process and issue.
A replacement letter in accordance with the enclosed will also be needed from the
Frederick County Sanitation Authority.

THIS DEED OF DEDICATION, made and dated this 21 st day of December, 1994, by
and between NEGLEY CONSTRUCTION, INC., a Virginia corporation, of the first part,
hereinafter called the DECLARANT, and COUNTY OF FREDERICK, VIRGINIA, of the
second part, hereinafter called COUNTY.
WHEREAS, the DECLARANT is the owner in fee simple of the real estate shown on
that certain FINAL PLAT RESUBDIVISION LOT 1 NEGLEY LAND drawn by David M.
Furstenau, L.S., dated September 12, 1994 and revised November 28, 1994, known as
NEGLEY LAND, which FINAL PLAT is attached hereto and incorporated herein by reference
as if set out in full. This is a portion of the same real estate previously conveyed to the
DECLARANT by that certain Deed dated July 2, 1991, which deed is of record in the Clerk's
Office of the Circuit Court of Frederick County, Virginia, in Deed Book 762, at Page 235; and,
WHEREAS, said real estate, as shown on the aforesaid attached Plat, has been
subdivided into lots for commercial use thereon (Lots IA and 1B), and the hereinabove FINAL
PLAT shows accurately the metes and bounds of the subdivided land, together with the
dimensions of each lot thereof and also shows certain water and sanitary sewer easements,
utility, ingress -egress, and drainage easements and detention pond easements„ all of which
shall constitute a portion of the NEGLEY LAND; and,
WHEREAS, the Subdivision of The NEGLEY LAND as shown on the aforesaid
attached FINAL PLAT, is with the free consent and in accordance with the desires of the
undersigned DECLARANT, and the DECLARANT desires to subdivide the aforesaid real
estate in accordance with the provisions of applicable State and County laws and regulations as
are applicable and in force and effect as of the date of execution of this Deed of Dedication.
NOW THEREFORE, THIS .DEED OF DEDICATION WITNESSETH: That for and
in consideration of the premises and the benefits which will accrue by reason of this
Dedication, the DECLARANT does hereby subdivide all of that certain tract or parcel of land
designated as NEGLEY LAND, lying and being situate in the County of Frederick, Virginia,
and being more particularly described by that certain Final Plat Resubdivision Lot 1 Negley
Land by David M. Furstenau, L.S., dated September 12, 1994, and revised November 28, 1994,
containing Lots I and 1B, Final Plat is attached hereto and incorporated herein as if set out in
full. This is a portion of the same real estate previously conveyed to the DECLARANT by
H832P G 1503
Deed dated July 2, 1991, said deed is of record in the aforesaid Clerk's Office in Deed Book
762, at Page 235.
FOR AND IN CONSIDERATION AS AFORESAID, the DECLARANT does further
dedicate Mercedes Court for public use, which street dedicated hereby is more particularly
described by the hereinabove referenced FINAL PLAT OF NEGLEY LAND.
FOR AND IN CONSIDERATION AS AFORESAID, the DECLARANT does further
dedicate those certain easements or rights of ways designated, or to be designated, as waterline
easements and drainage easement, gas easements and utility easements on the plats of
NEGLEY LAND that have been or will be recorded (including the plat attached hereto). The
DECLARANT does hereby grant and convey unto the County of Frederick, Virginia or other
agency having jurisdiction thereof a perpetual right of way or easement for the maintenance
and repair of the aforesaid easements and any related facility designated on the aforesaid plats
as water easements, sanitary sewer easements, gas easements and utility easement. It is
understood that the owner of the subject property will be responsible for any maintenance and
repair of the storm water and detention pond easements.
The subdivision of this land as shown on the attached plats presently recorded, or to
be recorded, is with the free consent and in accordance with the desire of the undersigned
DECLARANT, and is in the conformity with the provisions of applicable State and County
laws, ordinances and regulations.
The execution of this deed has been duly authorized by the Directors of the
DECLARANT Corporation and nothing in the Corporate Charter or By -Laws reserves the
power unto the stockholders to convey a part of the corporate real property.

No objection to the subdivision of this property. However, prior to development, this office
will require a complete set of construction site plans for review. Entrances will have to
be constructed to VDOT minimum standards to allow for safe egress/ingress of the
properties.
As proposed the division line between Lot 1-A and 1-B on the north side of Mercedes
Court will fall within the limits of an approved entrance location. If constructed, the
entrance will be on two (2) separate lots. Therefore, prior to Mercedes Drive being
added to our Secondary Maintenance System, a joint use agreement/easement will be
required to cover future use and maintenance of the entrance.
