The boundary line adjustment plat for this property was approved on September 18, 2002 and
today, copies of the recorded plats were received. Initially, a subdivision request was presented
by the School Board to enable the construction of "Millbrook Drive". Subsequently, the
applicants and the School Board decided to acquire the necessary right of way through the
"eminent domain"/condemnation process instead of the subdivision application process. The
Certificate of Take is dated August 20, 2002.

SUBDIVISION SPECIFICS: Request to enable a boundary line adjustment with an adjoining
property owner, enabling access to Route 7 (Berryville Pike).
REVIEW EVALUATIONS:
Virginia Dept. of Transportation: The application for subdivision of this property appears
to have significant measurable impact on Berryville Pike (Route 7), the VDOT facilities
which would provide access to the property. This section of street is currently not in the
State's Secondary Road System. However, all entrance design and drainage features must
meet State requirements if the street is to be eligible for acceptance. A complete set of
construction plans will be required for review.
Fire Marshal: No comments at this time.
Sanitation Authority: There are no water and sewer lines shown on this "Preliminary Plat
of Subdivision." Water and sewer are available to the site.

Public Works: We offer no comments.
Department of GIS: The road name of Millbrook Drive is approved for use in the Frederick
County Road Naming System. Millbrook Drive has been reserved and will be incorporated
into the system upon final subdivision. Structure numbers will be assigned as construction
is permitted. NOTE: With all of the other Mill— road names already in the system, it may
be advisable to select another road name that is more distinctive.
Planning and Zoning:
Public Meeting Requirement
The Subdivision Ordinance requires that land divisions in the RP and B2 Zoning Districts,
without an approved master development plan, be presented to the Board of Supervisors for
final approval (§ 144-12-B). This boundary line adjustment will occur without the creation
of any new parcels. A master development plan of the MBC, L.C. property remains a
requirement to create any new parcels or to develop the existing tracts. This boundary line
adjustment contains land zoned RP and B2 and does not have an approved Master
development plan; therefore, Board review and action is necessary.
Staff Review
MBC, L.C., the subject property owner, is requesting approval for a boundary line
adjustment as illustrated on Exhibit "A". The boundary line adjustment is to occur with the
Frederick County School Board property which is situated on the northern side of the subject
property. The area of the boundary line adjustment will separate the MBC, L.C. property
into two portions. The intention of this boundary line adjustment is to enable the Frederick
County School Board property to modify its current shape to enable a dedication of a 60'
wide public right-of-way. This future public right-of-way is to enable a second access to
Millbrook High School.
STAFF CONCLUSIONS FOR 08-07-02 PLANNING COMMISSION MEETING:
Staff is seeking administrative approval authority, therefore a recommendation from the Planning
Commission to the Board of Supervisors regarding the boundary line adjustment request is desired.
Should the Planning Commission forward a favorable recommendation, it would be appropriate to:
► Require the applicant to obtain approval of a master development plan prior to any future
boundary line adjustments, development of existing parcels or subdivision of remaining
property.

THIS DEED, made and dated this 1st day of December, 2000. by and between MILDRED�
F. COLE, hereinafter "Grantor"; and MBC. L,C., a Virginia Limited Liability Company,
hereinafter "Grantee".
WITNESSETH: Grantor desires to convey the property described below to the Grantee
which is controlled by Grantor in accordance with the provisions of the Internal Revenue Code of
1986. This conveyance is exempt from the recording tax in accordance with Virginia Code Section
58.1-811(10). Accordingly, for and inconsideration of the sum of Ten Dollars ($10.00) cash in
hand paid, and other good and valuable consideration, the receipt of which is hereby
acknowledged, the Grantor does grant and convey with General Warranty and Fnglish covenants
of title unto the Grantee, in fee simple, together with all rights, rights of way, privileges and
appurtenances thereto belonging, the following properties, to -wit:
(1� Parcel # : All that certain parcel of land described as containing 8.73 acres fronting
along t e north side of Berryville Pike, Virginia Highway 7, about one mile east of Winchester,
in Stonewall Magisterial District, Frederick County, Virginia, and being the same property
conveyed to Dennis T. Cole and Mildred B. Cole, his wife, as tenants by the entirety, by deed dated
May 6, 1960 from Mary Elizabeth Luttrell, widow, of record in,the Clerk's Office of the Circuit
Court of Frederick County, Virginia, in Deed Book 263, at Page 185. Such Dennis T. Cole died
on April 5, 1992 survived by his wife, Mildred F. Cole.

Pike, in tonewall Magisterial District, Frederick County, Virginia, containing .92 acres: and being
the same property conveyed to Mildred F. Cole by deed dated March 6, 1997 by the BANK OF
CLARKE COUNTY which is of record in the Clerk's Office of the Circuit Court of Frederick
County, Virginia in Deed Book 875, at Page 675.
3. Parcel #3: All those two parcels of land lying and being situate in Stonewall
Magisterial District, Frederick County, Virginia, being described as containing 2.7775 acres and
0.6085 acres on that certain plat prepared by C. J. Rinker, Jr., C.L.S., dated November 1. 1993: and
being the same two parcels of land conveyed to Dennis T. Cole and Mildred F. Cole. his «ife. as
tenants by the entirety, by deed dated June 14, 1977 from Denny's, Inc. which is of record in the
Clerk's Office of the Circuit Court of Frederick County, Virginia in Deed Book 475, at Page 35

of Frederick County, Virginia in Deed Book 266, at Page 165.
Reference is made to the instruments described above and the attachments and references
contained in them for a further and more particular description of the property conveyed by this
deed. This conveyance is made subject to all restrictions, conditions and encumbrances of record
and contained in the deeds and other recorded instruments forming the chain of title to the above -
described property.

This is to certify that $339,000.00 is estimated by The County School
Board_ of Frederick County, Virginia, a body organized and existing under the
provisions of Chapter 5, Title 22, Code of Virginia of 1950, as amended, to be the
value of the fee simple interest, permanent slope and drainage easements, and
temporary construction easement hereinafter described, and the damages to the
remaining property owned by MBC, LC, a Virginia limited liability company,
which the said County School Board of Frederick County, Virginia has directed to
be taken and acquired in connection with the construction, maintenance, and
repairing of a roadway, which sum has been paid to the Clerk of this Court
pursuant to Section 33.1-120, Code of Virginia (1950), as amended, to be there
held for distribution to those entitled thereto pursuant to Order of the Court as
provided by law. The estate, interest or right to be taken lies in Stonewall
Magisterial District, Frederick County, Virginia, and is described as follows:
Fee simple title to the parcel described as the "Proposed R/W Acquisition"
containing a total of 1.681 acres as shown on a plat of P. Duane Brown, L.S.,
dated August 20, 2002, attached hereto and made a part hereof, and
Permanent slope and drainage easements as shown on said plat totaling
.718 acres, including the right to construct, maintain, repair and replace any
improvements placed within said slope and drainage easements; and
Those temporary construction easements totaling 1.441 acres as shown on
said plat; including the right to construct curbing, traffic islands and dividers,
paving and other improvements within the temporary construction easement to
control traffic and water drainage; and
Said interest being over and upon the land of MBC, LC, which property
was acquired by Deed dated December 1, 2000, of record in the Clerk's Office of

1. The road name of Millbrook Drive is approved for use in the Frederick County Road
Naming System. Millbrook Drive has been reserved and will be incorporated into the system
upon final subdivision. Structure numbers will be assigned as construction is permitted.
NOTE: With all of the other Mill- road names already in the system, it may be advisable
to select another road name that is more distinctive.

RE: MBC, L.C. Subdivision - Preliminary Sketch review
Dear Duane:
I have had the opportunity to review the preliminary sketch ofthe MBC, L.C. subdivision. The proposed
subdivision is benefitting from the construction of Millbrook Drive, a road which will serve Millbrook
High School. Please respond to the following review comments:
1. Show all building restriction lines as indicated.
2. Label the structure types on Sheet 2.
3. Depict the individual distances as indicated.
4. Add the word "Proposed" prior to "Millbrook Drive".
5. Label the appropriate zoning on the proposed lots, as well as the adjoining properties.
6. Proposed Lot 4 is encumbered by large areas of utility easements. Please address the
issue regarding the capability to develop this lot.
7. Indicate the ownership status of the area labeled "Old Roadbed".
8. The one-story block/frame building depicted on proposed Lot 2 has a loading entrance
facing proposed Millbrook Drive. There is a concern regarding vehicular access of the
building at this location. A note needs to placed on the preliminary sketch and final plats
stating that the building shall not have vehicular access at this location.
