2. Brief discussion about Wilde Acres/ Mt. Falls Park subdivision.
3. Establish goals of the subcommittee and basic timeframe to respond to request.
4. What is the state of existing conditions in Wilde Acres/ Mt. Falls Park?
5. Basic discussion of potential operational costs based on information from Shawneeland road
maintenance budget, current fee structure.
6. Discuss potential right of way issues, property boundaries, ownership of real property.
7. Possible options for management of Sanitary District.
8. Brief discussion about collection of fees at Shawneeland and Lake Holiday and how they would
apply to collection of fees at Wilde Acres/ Mt. Falls Park.

PRELIMINARY COST ESTIMATES FOR ROAD REPAIRS
WILDE ACRES/ MOUNTAIN FALLS PARK
(costs based on current Shawneeland budgetary numbers)
There are approximately 25 miles of improved roads in Wilde Acres.
1. Perform initial work to get roads up to a basic standard with gravel surface with
properly draining culverts and ditches. (Contract equipment and labor)
a. Approx. 20 miles of roads need grading, stone surface and ditches cleaned out
($12,500/ mile) (approx. total $250,000) *some roads have tar and chip surface*
b. Fix/ replace approx. 50 culverts (approx. $5,000 per culvert) (total $250,000)
c. County oversight and management costs (bidding, develop plans and specs.,
procurement, etc. (approx. total $50,000)
Approximate total costs to upgrade current roads to basic standard ($550,000)
2. Approximate total cost to perform management, oversight and maintenance of roads
within Wilde Acres/ Mt. Falls Park
a. Approx. 25 miles of roads needing maintenance (average cost — $14,000/ mile)
Total costs ($350,000) *would attempt to tar and chip some roads if possible*
b. Management/ personnel costs ($250,000)
1. Manager (1/2 cost shared with Shawneeland)
2. Secretarial (1/2 cost shared with Shawneeland)
3. 3 full time equipment operators
4. Possible part time help
Unknown costs at this time:
1. Equipment, trucks, maintenance facility
2. Sanitary district fee collection costs
3. Determination of right of way, property boundaries, surveying support
4. Other county costs for administration

corporation, party of the first part; and Wilde Acres Property
Owners Association, Inc., a Virginia corporation, party of the

WHEREAS, the party of the first part is the owner and i
present developer of the property hereinafter described, located!
in Wilde Acres, also known as Mountain Falls Park, Frederick
County, Virginia; and,
WIiEREAS, the party of the second part is an association
formed by and belonging to lot owners having individual lots at
Wilde Acres, also known as Mountain Falls Park; and,
WHEREAS, by certain deeds of dedication some of the
roadways in Wilde Acres Subdivision were dedicated to Frederick
County which has not acted upon said dedication; and,
WHEREAS, by contract between the parties of the second
part and Wilde Acres, Inc., the party of the second part agreed
to undertake maintenance of certain roads in said subdivision
as set forth in said contract; and,
WHEREAS, subject to whatever right, title and interest)
the County of Frederick, Virginia or the Virginia Department of
Highways may have in said roadways, the party of the first part
in order to facilitate the maintenance of said roadways, desires
to convey the same to the party of the second part.
NOW, THEREFORE, in consideration of the foregoing and !
the sum of One Dollar ($1.00) cash in hand paid, the receipt of
which is hereby acknowledged, the party of the first part does

all of the roadways dedicated and platted in the Clerk's Office
of the County of Frederick by Holiday Development Company,
Wilde Acres, Inc. and Mountain Falls Park, Inc. in the sub-
division known as Wilde Acres and also known as Mountain Falls
Park in Back Creek District, Frederick County, Virginia.
This conveyance is made subject, however, to any right,
title and interest granted and conveyed to the County of
Frederick and the Department of Highways of the Commonwealth of
Virginia by the deeds of dedication of said subdivisions and
further subject to the right of the party of the first part, its
assigns and successors, to use said roadways in its business and
for its business purposes.
It is further understood and agreed that some of the
platted roadways may never be constructed due to the difficulty
of the terrain, or the lack of use or need for the same; however,
the party of the second part does agree to take over and maintair
all roadways now constructed and in use, and to take over and
maintain all other roadways that may be constructed in the
future by the developer or property owners or others.
It is agreed that on the attached plat of said develop-
ment known as Wilde Acres or Mountain Falls Park, the roadways
not now constructed or in use or parts thereof are marked in red.
The said roadways'to be constructed and maintained
shall meet the requirement that there be proper drainage by
culverts and ditches and bridges, and shall be free.of rocks,
trees, brush, bushes and other objects, and that the traveled
portion of said roadways shall be a smooth graded surface
sufficient for the free travel of duly licensed motor vehicles.
The agreement herein shall be for the benefit of each
lot owner and the developer and may -be enforced by either party
hereto and any one or more lot owners.

ORDINANCE to amend certain plats containing lots,
blocks and sections of Wilde Acres Subdivision, otherwise known
as Mountain Falls Park, located in Back Creek Magisterial District,
Frederick County, Virginia.
WHEREAS, discrepancies in the survey of the subdivision
known as Wilde Acres has been discovered in the old plats of the
subdivision, particularly along the boundary with Glynn and at
the intersections of Mountain Falls Boulevard and Winchester
Drive with Fawn Drive; and,
WHEREAS, the plats of said areas affected by said
discrepancies are of record in the Clerk's Office of the Circuit
Court of Frederick County, Virginia; and,
WHEREAS, it is deemed necessary to correct the dis-
crepancies by vacating the plats where the discrepancies exist
and readopting plats in substitution thereof; and,
WHEREAS, the survey and plats have been made by Thomas
C. Glass, Certified Land Surveyor, for Trico Associates, Inc.,
and the surveyed plats for the said area now known as Mountain
Falls Park are dated February 11 , 1974, and attached hereto,
and said plats relocate properly the actual boundary lines of the
subdivision where it adjoins the Glynn property and the lots,
roads and streets located thereon to conform with the physical
location of the lots and streets.
NOW, THEREFORE, BE IT ORDAINED that the Board of
Supervisors of Frederick County, Virginia, hereby vacate the

The chain of title and the description of the property
being subdivided is as follows: A portion of that larger tract
or parcel of land containing approximately 440 acres, more or less
which was conveyed to Mountain Falls Park, Inc. by Richard W.
Ronk and wife by deed dated the 25th 'day of September, 1970, and
of record in the Clerk's Office of the Circuit Court of Frederick
County, Virginia, in Deed Book 369, Page 156, which property was
formerly owned by Wilde Acres, Inc.
The lots set forth herein as shown on the attached thr
plats as comprising Sections E•-19, D-19 and E-18, shall be subjec
to the following restrictions and covenants real running with the
land and shall be binding upon all subsequent owners -for the use
and benefit of all the owners of said lots and may be enforced by
any of the owners and proprietors of said lots and of other lot
owners in the entire subdivision development. Each deed of the
.undersigned owners and proprietors shall contain an incorpora-
tion therein.,of;these restrictions either by reference to this
instrument or by being set forth in said deed or both. Said
restrictions are as follows:
1. Said lots shall be used for residential purposes
only, and no dwelling on said lots shall be less than 600 square
feet in size and no building shall be erected on said lots except
for residential purposes only and for a family car garage or tool
house.
2. Any building constructed of wood exterior must have
at least two coats of paint, varnish or stain unless it has a pre-
fabricated -finish or made of redwood or cedar, and the exterior
of said buildings must be completed within six months from
commencement of construction and the lot cleared up and free of
debris and building materials.
3. If a.family car garage or tool house is built it
must.conform in general appearance to the dwelling house.

4. Only household pets such as dogs.and cats may be
kept on said premises.
5. No house trailers shall be kept on said property for;
human habitation except, however, that campers and camping
trailers may be -kept on said lots.during vacations of the family
and while occupied during said time by the owner or his family.
6. No building may be constructed within twenty-five
feet of the front line of the lots or within six feet of the lot

7. No lot shall be divided into one or more smaller
parcels or any part thereof joined to another lot.
8. No rights of ways or easements shall be granted

9. There is hereby established an easement ten feet in
width along the property lines of lots fronting on roadways for
the purpose of being used for the installation of public
utilities.
10. The foregoing covenants and restrictions may be
amended from time to time by written instrument executed by the
owners of a majority of the lots in any designated block of lots
in which the change is desired.
Mountain Falls Park, Inc., developer of this sub-
division, on behalf of itself and any successors in title, reserves

tions set forth therein, and in Paragraph 9 thereof did provide
that the owners of a majority of the lots in the aforesaid sub-
division could amend from time to time the covenants set forth
therein by written instrument recorded among the land records of
Frederick County, Virginia,
NOW, THEREFORE, THIS INSTRUMENT WITNESSETH: That
pursuant to the authority granted by the undersigned, they do
hereby amend the aforesaid deed of dedication in regard to the
restrictions and covenants set forth therein, and to provide the
following to be the restrictions and covenants to henceforth
run with the land upon the lots in said deed of dedication which
are as follows:
(1) Said lots shall be used for residential purposes
only, and no dwelling on said lots shall be less than twenty (20)
feet by twenty (20) feet in size, or of a comparable square
footage, and no building shall be erected on said lots except for

(2) Any building constructed of wood must have at

Mountain Falls Park, Inc. is in the process of liquidating
its assets. The records show that you own Lot 23, Block S,
Section 6, and that Mountain Falls Park, Inc. owns Lot 22,
Block S Section 6.
Due to the small size of these lots, at least two lots
together are now required for building purposes if wells and
septic tank and drain fields are to be used. The new County
code no longer permits pit privies.
Therefore, I thought it would be.of interest to you to
preserve your investment in Lot 23, Block S, Section 6, by
buying our adjoining lot and thus, having a large enough
area on which to build.
We will hold this lot available for a short time. However,
I might advise you that Mountain Falls Park, Inc. expects to
put on a sales drive very shortly and if this lot is in its
inventory, it will be offered for sale to any other interested
person.

Enclosed you will find a proposed ordinance for the purpose
of vacating and rededicating certain lots and streets in
Mountain Falls Park Subdivision, formerly known as Wilde
Acres, and also a Deed of Vacation and Rededication of
another section of said subdivision.
It is requested that you review this material, and if
possible approve the ordinance and the Deed of Vacation at
your meeting on April 10, 1974.
These changes have come about through the employment of
Trico Associates, Inc. and Mr. Thomas C. Glass, Surveyor and
Professional Engineer of that firm who has been doing work
for Mountain Falls Park, particularly in locating the
boundaries and tying the surveying in with the proper
surveying practices so that in the future any lot owner can
very readily find the boundaries of his lot.
Mr. Glass in his work has found mistakes made by the original
surveyor, and it is now desirable to correct these matters
which will be to the benefit of all the lot owners in
Mountain Falls Park as well as the proper administration of
land assessments, taxes and other related matters.
If you have any questions concerning this matter, please get
in touch with me as soon as possible.
