THIS DEED, made and dated this 3 0 day of a v"-%z— , 1992,
by and between JACOB F. MORELAND and_BEVERLEY S. MORELAND, husband and
wife, hereinafter called the Grantors, and JAMES RAY_GOODE,__.S.R.._and PAMELA
GAIL GOODE, husband and wife, hereinafter called the Grantees.
WITNESSETH: That for and in consideration of the sum of Ten Dollars
and other good and valuable consideration, the receipt of which is hereby
acknowledged, the Grantors do hereby grant and convey, with General
Warranty and English covenants of title unto the Grantees, in fee simple,
jointly as tenants by the entirety with right of survivorship as at common
law, it being intended that the part of the one first dying should then
belong to the other, his or her heirs or assigns, the following described
real estate together with the improvements thereon and the appurtenances
thereunto belonging:
All of that certain lot or parcel of land situated.on U.S.
Route 522 in Shawnee Magisterial District, Frederick_County,
Virginia, containing 26,775 sq. ft., by survey, with metes
and bounds as shown on plat of survey made by L. Allen
Ebert, L.S., dated June 4, 1992, and designated thereon as
"Lot 2", a copy of which plat is attached hereto and made a
part of this deed; and being a portion of the property
conveyed to the Grantors herein by deed dated September 12,
1978 from Ernest F. Grimes et ux, of record.in the Clerk's.
Office of the Circuit Court of Frederick County, Virginia in
Deed Book 498 at page 158 et seq.
Reference is hereby made to the aforesaid instruments_ and the
attachments and the references therein contained, for a more particular
description of the property hereby conveyed.
The Grantors hereby reserve an easement for two sheds as shown on said
plat; reserve an easement for water lines serving the said Lot 1; and
reserve a 20' sanitary sewer easement shown on said plat. Said water and
sewer easements shall be for the purpose of installing, repairing,
maintaining, and replacing pipes, lines, and appurtenances necessary for
the use of the said Lot 1.
The Grantors reserve for themselves, their agents, and their
successors the right to enter upon Lot 2 for the purpose of constructing up
to three monitoring wells and a remediation system.
The Grantors and their successors in title shall have full and free
use of said easements and right of entry for the purposes named, including

right of access thereto for inspection and maintenance, and shall have all
other rights and privileges reasonably necessary to the use of the easments
and entry rights including the right to use adjoining land where necessary;
provided, however, that Grantors' right to use adjoining land shall be
exercised only during periods of actual inspection, construction or
maintenance, and further, this right shall not be construed to allow the
erection of any new building or structure on such easements or adjoining
land.
The Grantors agree for themselves and their successors to be solely
responsible to the maintenance of said sheds, pipes, lines, and
appurtenances, and to maintain them so that there will be no damage or
other effect that may cause injury to the servient tract.
This conveyance is further made subject to all easements, rights of
way and restrictions of record affecting the subject property, including
building restriction lines as shown on said plat.

a variance for the temporary building was obtained by the
applicants' son-in-law for this temporary facility.
