Eisenfeld Flooding at 1832 Wayland Drive Dear Ms. Gray Baily: This letter is in response to your correspondence received on July 27, 2018, to the Frederick County Planning Director requesting to address flooding on the above - referenced property. I have examined our records with respect to the property. The property is located within a subdivision known as Merriman Estates that was created in 1959. Mrs. Eisenfeld dwelling was built in 1964, and the property has a 30-foot drainage easement in the rear. Furthermore, the property is located within the flood plain A zone and is subject to flooding. The past two (2) months this area has had more than thirty (30) inches of rain, this may have made the flooding worse than past years. Even though the increased filling only impacts the flood elevation by an additional 0.25 feet, it appears that lot seven (7) in Merriman Estates could be adversely affected by the development. Additional topographic information will be required to confirm or refute this concern. In conjunction with evaluating the impact on lot seven (7), I recommend that you contact the Winchester and Western Railroad about upgrading the drainage structure under the railroad. This upgrade would alleviate the periodic flooding that occurs during a more frequent two (2) year storm event. The rubble fill that has been placed on the proposed building lots was not monitored or controlled in an approved engineering manner. Our previous comments emphasized that the lots should be filled in a controlled manner to facilitate the construction of the houses as well as providing stable slope conditions. Because of the existing fill conditions, it will be necessary to over -excavate the rubble fill, at least, ten (10) feet beyond the proposed building lines and replace the void with engineered fill. Even with this approach, I still have grave concerns about the potential for piping of the fine grain soils into the voids of the nested boulders. This potential piping could lead to subsidence which would have an adverse affect on the driveways as well as any utility lines extended to the dwellings. 107 North Kent Street • Winchester, Virginia 22601-5000 Vanderiet Property Page 2 July 12, 1996 The existence of the rubble fill will also prove detrimental to landscape efforts because of the potential for piping as well as problems related to excavating in general. The developer needs to consider these drawbacks before proceeding with the development of these lots. SPECK As consultants to the Federal Insurance Administration (now the Federal Emergency Management Agency - FEMA), our Contract requires us to revise and update Flood Insurance Rate Maps (FIRMs) to reflect conditions not con- sidered at the time of the Flood Insurance Study. For the Merriman Estates Area of Frederick County, the existing Special Flood Hazard Area on Commu- nity -Panel No. 510063, 0115B will be revised when we receive 100-year floodplain computations and as -built plans showing State Route 37 and the floodplain through the subject property. However, due to mapping limitations, it may not be possible to determine the position of certain lots in relation to the Special Flood Hazard Area. Accordingly, I am enclosing a memorandum regarding the "Conditions and Criteria for Letters of Map Amendment" prepared by FEMA. This memorandum outlines in detail the determination procedure for individual structures. As I explained in our telecomof July 2, 1979, structures may be exempted from mandatory flood insurance coverage if certain criteria are met. Specifically, FEMA requires that "the elevation of both the lowest grade adjacent to the structure (or proposed structure) and the lowest floor (including basement) are at or above the base flood elevation" . Please consult the memorandum for more detail and definition of terms. When you have complied with the preconditions of the above document, FEMA will issue a Letter of Map Amendment for structures outside the 100-year flood zone. If you have any questions, please call. About six months ago we hired Benny Butler to check with you on why things weren't moving. He informed us that we had to have a 100 year flood plan. So we hired Chuck Maddox of Clifford Associates and we have gotten the bill and paid for this work. Ebert told us he delivered the plat to you and that you are waiting for a call from the F.I.A. I presume this is the Federal Insurance Act. If you are waiting for a call from the Federal Government, I don't think you will get one. The board of directors of Shenandoah Pools, Inc. don't know what the Federal Government has to do with a subdivision previously approved by the board of supervisors and the health department twice in the past 20 years. The board has asked me to request a time schedule of when we can expect approval of the subdivision. We were under the impression that the highway accepted it into their system already. The people living there now claim that we have to ask that the board of supervisors extend the maintenance to the end of the street. Therefore, this is a formal request that section two of Merriman's Estates be added to the County High- way System. And maintenance and snow removal .,of said streets be added to the Highway Departments' work orders. DEPA_ MENTOF HOUSING AND URBAN D, LOPMENT FEDERAL INSURANCE ADMINISTRATION FIA-78-4 N ®T I C September 21, 1978 TO: FIA Flood Insurance Staff EXPIRES: March 21, 1979 SUBJECT; Conditions and Criteria for Letters of Map Amendment This Notice sets forth Federal Insurance Administration (FIA) Policy concerning requests to FIA for a determination whether or not a structure or a proposed structure is in a Special Flood Hazard Area shown on a Flood Insurance Rate Map (FIRM) or Flood Hazard Boundary Map (FHBM). A Letter of Map Amendment will not be issued solely for unimproved land areas; however, a Conditional Letter of Map Amendment can be issued for unimproved land. In order for FIA to issue a Letter of Map Amendment (under Part 1920 of the National Flood Insurance Program regulations), a property owner or a person having an insurable interest in the property must submit supporting documentation to meet the criteria set forth below. Satisfaction of the criteria will result in the issuance by FIA of a Letter of Map Amendment removing the property from the Special Flood Hazard Area, thus removing the mandatory insurance purchase requirement vis-a-vis the structure in question. Definitions The terms used in this Notice have the 1909.1 of the National Flood Insurance al). The Special Flood Hazard Area is a community subject to a 1-percent or given year." If there is difficulty in determining the base flood elevation because of the quality of the data submitted, FIA will use the base flood elevation which it considers most technically accurate. Floodways Compacted fill may be utilized as a means of elevating the building site and the structure's lowest floor (including basement) out of the Special Flood Hazard Area, except in designated or anticipated floodways. 7he floodway determinination will be based upon the FIA flood insurance study, technical information made available from authoritative sources, FIA flood plain management regulations, and by the engineering judgement of FIA staff when these data are lacking. b. Elevated Structures Buildings which have the lowest floor elevated on posts, piers or walls above the base flood level in the Special Flood Hazard Area will not be removed from the Special Flood Hazard Area, and therefore, fram the flood insurance purchase requirement since a portion of the structure (i.e., posts or piers) is still in the Special Flood Hazard Area. c. Barrier Sand Dunes Structures built on barrier sand dunes will not be removed from the Special Flood Hazard Area and, therefore, fran the insurance purchase requirement since the stability of the sand dune is suspect. d. Coastal High Hazard Areas Letters of Map Amendment will not be issued for property located in a coastal high hazard area, unless the first floor elevation is above the estimated wave height. If the property has been elevated by compacted fill, the property owner must show that the fill was placed before the date of the most recent FHBM or initial FIRM. The coastal high hazard and wave height determination will be based upon the FIA flood insurance study, technical information made available fran authoritative sources, FIA flood plain management regulations, and by the engineering judgements of FIA staff when these data are lacking. Information Required for a Determination In order to obtain a Letter of Map Amendment, the property owner must establish that both the lowest floor elevation (including basement),and the lowest grade adjacent to the structure are at or above the base flood elevation. Generally, FIA experience has indicated that the following documents are required for a prompt determination as to whether a structure is in a Speical Flood Hazard Area sham on a FIRM or FHBM. M -3- 1. Legal description of the property, usually an actual copy of the recorded plat map bearing the seal of the circuit clerk (County Clerk or Recorder of Deeds), indicating official recordation and proper citation (Deed or Plat Book Volume and Page Numbers). 2. A topographical map which shows: ground elevation contours, the total area of the property in question, the location of the structure or structures on the property in question and an indica- tion of the curvilinear line which represents the area subject to inundation by a flood having a 1-percent chance of occurrence in any given year. This curvilinear line must be based upon informa- tion provided by an authoritative source, such as the U. S. Army Corps of Engineers, USGS, SCS, or other Federal agency, the State Department of Water Resources, the County Water Control District, the County or City Engineer, a FIA Flood Insurance Study, or technical data prepared by a registered engineer. FIA may coordinate information submitted by a property owner with any of the above listed sources. 3. A certification by a registered professional engineer or licensed land surveyor stating 1) the type of structure, 2) whether or not it is elevated on posts, piers or walls, 3) whether it is built on a barrier sand dune, 4) the elevation of lowest floor (including basement), and 5) the elevation of the lowest grade adjacent to the structure. Conditional Letter of Map Amendment for Unimproved Land The flood insurance purchase requirement does not apply to unimproved land, since flood insurance is only available -for structures and their contents. However, if a property owner submits data to show that the unimproved land (and the lowest floor, including basement, and lowest adjacent grade of proposed structures if plans have been drawn) is at or above the base flood elevation, FIA will issue a Conditional Letter of Map Amendment. This letter states that a final Letter of Map Amendment will be issued for a proposed structure if the elevation of the lowest floor (including basement) and lowest grade adjacent to the structure are at or above the base flood elevation. The policy for existing structures (outlined above) will be followed when the proposed development involves floodways, coastal high hazard areas, structures on posts, piers or walls, and barrier sand dunes. M -4- FIA experience has indicated that the following information is necessary to determine if a Conditional Letter of Map Amendment can be issued: 1. A topographical map which shows: ground elevation contours, the total area of the property in question, and an indication of the curvilinear line which represents the area subject to inundation by a flood having a 1-percent chance of occurrence in any given year. This curvilinear line must be based upon information provided by an authoritative source, such as the U. S. When a structure is eventually constructed on the land, the property owner must submit the following information about the structure in order to receive a Letter of Map Amendment removing the structure frCM the flood insurance purchase requirement: 1. A legal description of the property, usually an actual copy of the recorded plat map bearing the seal of the circuit clerk (County Clerk or Recorder of Deeds) indicating official recordation and proper citation (Deed or Plat Book Volume and Page Numbers) and indicating the as built location of the structure, or a certification of the location of the finished structure by a registered engineer or licensed surveyor. 2. A certification by a registered engineer or licensed surveyor of the elevation of the lowest floor (including basement) and the elevation of the lowest grade adjacent to the structure. Upon receipt of this information, a Letter of Map Amendment will be granted using the base flood elevation data shown on the FIRM if it is published prior to start of construction. If a FIRM has not yet been published, the Letter of Map Amendment will be granted using the flood data available at the time the Conditional Letter of Map Amendment was issued. c. -5- Signed Statement A copy of the attached statement asserting the accuracy of the information submitted must be signed and submitted by the appellant. Appropriate Address Letters of request and information supporting requests for a Letter of Map Amendment should be sent directly to: Chief, Cartographic and Map Amendments Branch Federal Insurance Administration Department of Housing and Urban Development Ream 5144 451 - 7th Street, S.W. Washington, D. C. 20410 FIA Evaluation and Response Upon receipt and evaluation by FIA of the required data, the property owner will be notified in writing of our findings. In addition, should a review of the evidence indicate a change in FIA Map(s), a Letter of Map Amendment having the effect of amending the FIA Map(s) in question, will be sent to the FIA Servicing Agent, the State Coordinating Agency, and the local community. The time required to review matters of this nature will generally depend upon the quality and completeness of the data submitted. This procedure will normally require about 60 days from the receipt of all supporting data. Refund of Insurance Premium If a property owner is required to purchase flood insurance as a condition of direct Federal or federally related financial assistance for a structure located in designated Special Flood Hazard Area on an official (FIA) map and if, at a later date, it is determined by a Letter of Map Amendment that the structure in question is, in fact, located outside the curvilinear boundary of the area which would be inundated by the base flood, a full refund of the premium paid for the current policy year may be obtained from FIA, through the agent or broker who sold the policy, provided (a) that no claim is pending or has been paid on the policy in question during the same policy year; and (b) that the lending institution which required the purchase of insurance agrees to waive the requirement.
