THIS BOUNDARY LINE ADJUSTMENT AGREEMENT made and dated
this 304day of November, 1993, by and between JASBO, INC., a
Virginia corporation, and FRED L. GLAIZE, III, of the one
part, hereinafter referred to as Declarants, and COUNTY OF
FREDERICK, VIRGINIA, of the other part, hereinafter referred
to as County.
WHEREAS, Declarants are the owners of Lots 8 and 9, Block
E, Senseny Heights Subdivision, Shawnee Magisterial District,
Frederick County, Virginia, having acquired the same by deeds
dated October 2, 1992 and September 10, 1993, and recorded in
the Office of the Clerk of the Circuit Court of Frederick
County, Virginia, in Deed Book 785 at Page 594 and Deed Book
804 at Page 466, respectively; and
WHEREAS, Declarants are the owners of certain property
located north of and adjacent to Lot 9, Block E, Senseny
Heights Subdivision, having acquired the same by deed dated
March 10, 1988, and recorded in the aforesaid Clerk's Office
in Deed Book 674 at Page 109; and
WHEREAS, the property mentioned in the immediately
preceding paragraph is planned as a subdivision to be known as
Abrams Pointe; and
WHEREAS, County vacated the sixty (60) foot parcel of
land (marked by hash marks and noted as "Areas to be dedicated
to County of Frederick, Virginia" on the hereinafter described
plat) by resolution of the Frederick County Board of
Supervisors; and
WHEREAS, Declarants and the County are desirous of
creating and assuring access from the proposed Abrams Pointe
to Williamson Road by the future re -dedication of the vacated
parcel for public use.

NOW, THEREFORE, WITNESSETH: That for and in
consideration of the premises and the benefits which will
accrue by reason of this agreement, the parties hereto do make
the following boundary line adjustments:
1. Lots 8 and 9, Block E, Senseny Heights Subdivision,
as shown on that certain boundary line adjustment made by
Douglas C. Legge, C.L.S., dated September 23, 1993, attached
hereto and by reference made a part hereof, shall constitute
the new boundaries of said lots and revert basically to the
former configuration as the same appeared on that certain plat
and Deed of Dedication for Senseny Heights Subdivision, which
plat is recorded in the aforesaid Clerk's Office in Deed Book
399 at Page 98.
2. The portions of land designated as containing 6,124
square feet and 2,214 square feet on the plat attached hereto
are hereby merged with and shall become a part of that
property acquired by the Declarants by deed dated March 10,
1988 and recorded in the aforesaid Clerk's Office in Deed Book
674 at Page 109.
Declarants shall dedicate the land mentioned in Paragraph
2 above for public use and create a public right of possession
to the same upon the platting and development of Abrams
Pointe.
The County, by its signature hereto, joins in to evidence
its consent to these boundary line adjustments.

This is to acknowledge receipt of your revised plans dated November 21, 1990
to the above referenced location. The plans appear satisfactory and are
approved. Please advise the developer accordingly.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with
the attendance of the contractor, various County agencies and VDOT shall be
conducted prior to initiation of work.
• Materials used and method of construction shall apply to current observed
VDOT Road and Bridge.Specifications applicable during construction of this
development.
• Our review and comments are general in nature. Should conditions in the
field exist such that additional measures are warranted, such measures shall
be completed to the satisfaction of the Department prior to inclusion into
the Secondary Road System.
• Attached is a copy of the minimum requirements and information needed prior
to acceptance of subdivision streets into the Secondary System. This is the
responsibility of the developer.
• All drainage is to be carried within the right-of-way in ditch lines or
gutters along the street to a pipe or drainage easement.
• The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require (forty-eight) 48 hours
notice for inspections.
The appropriate land use permits shall be obtained before any work is
performed on the State's right-of-way.
• If mailboxes are to be placed along the roadway fronting lots, a minimum of
four (4') feet shall be between the edge of pavement and the front of
mailbox.

Private entrances will be installed in accordance to the attached sketch.
This is the developer's responsibility.
• Any signs to be installed will be in accordance with attachments.
• I suggest any utilities and/or storm sewer placed within the proposed
right-of-way be backfilled completely with C.R. Type 21-A Stone. This will
greatly reduce the possibility of any pavement settlement.
• The proposed quadruple 10'x8'. box culvert at approximate Station 14+75,
Hunter Run Road is to be constructed to our 1987 Standards. A sub -surface
investigation by a private firm will be required of the area prior to
construction. Said investigation may be coordinated with our District
Materials Section in Staunton. We suggest the investigation be completed as
soon as possible so construction delays may be avoided. The developer will
be responsible for paying the full salary and.expenses of a State assigned
Inspector during construction of this box culvert.

RE: Revision to Abrams Pointe Master Development Plan
Attached is a revised Abrams Point MDP. The Preliminary MDP was
approved by the Board on September 20, 1989 and since that time,
the road connection to Frederick Heights through Milam Drive has
been eliminated and a right-of-way provided to the eastern edge of
the property to accommodate a future connection to Greenwood Road.
These changes were made at the request of the Planning Commission
and Board of Supervisors.
The staff recommendation was for approval of the revision and the
Planning Commission recommended approval at their 6/6/90 meeting.

Attached is a revised agenda sheet for the June 6th meeting which
has, as an additional item, Phase 1 of the Abrams Point Subdivision
and approval of the revised MDP.
Also included are copies of the revised MDP and the subdivision
layout. The Preliminary MDP was approved by the commission on
September 6, 1989 and since that time, the road connection to

PROPOSED USE & IMPROVEMENTS: Single-family cluster and urban

REVIEW EVALUATIONS:
Va. Dept. of Transportation: See attachment.
Parks & Recreation: 90% of open space is in steep slopes and
wetlands. Walking trail looks fine. No further comments.
Health Dept.: No objection - project to be served by central
water and sewer utilities.
Inspections Dept.: This request for subdivision approval
shall comply to Use Group "R" Residential Section 304.0 of the
BOCA National Building Code 111987".
Fire Marshal: The hydrant at lots 25 and 26 needs to moved
to the intersection at lot 30. This would permit coverage of
more area and make easier hookups. Fire lanes will need to
be marked before occupancy of property.
Sanitation Authority: 46 items, correct and resubmit.
Planning and Zoning: The subdivision is in substantial
conformance with the master development plan. Review agency
comments that have not been addressed will be required actions
that must be completed.
STAFF RECOMMENDATIONS FOR JUNE 6, 1990 P/C MTG.: Recommend
subdivision approval contingent upon Board approval of the master
development plan.

1. The extension of Hunter Run Road which connects with Route 659 through the
existing Brcokland Heights Townhouse Development and Brookland Link Road which
will eventually tie-in with Route 656 will carry anticipated traffic volumes of
over 2500 VPD. These streets should be designed with a minimum 8" of
C.R. Type 21-B Base Aggregate, 3.5" of Asphalt Concrete Type BM-2 and 165 pounds
per square yard (1.5" of Asphalt Concrete Type SM-2A).
2. The cul-de-sac pavement and right-of-way radii are to be increased to 45' and 55'
respectively. The profile should also be revised to reflect this increase. The
temporary cul-de-sac radii at the end of the Brookland Link roadway should be a
minimum 40'.
3. Street intersection radii should be increased to 50' except on short cul-de-sac
streets where 40' will be acceptable.
4. Erosion Protection Standards EC-1, EC-2 and EC-3 will be required at the
locations noted on the plans. The legend on the revised plans showing where the
EC-2 and EC-3 are to be used should be easily distinguishable.
S. Standard CD-2 Underdrains will be required at locations noted.
6. The proposed guardrail at Abram's Creek will need to be reviewed at the time of
construction to determine the length and terminal treatment.
7. Standard VDOT stop signs will be required at all intersections.
8. Additional drainage easements will be required at locations noted.
9. It is the developer's responsibility to determine the size of private entrance
culverts for this project. Our minimum requirements are 15" or 13"x17" in
diameter and 30' in length. At this time I will require a listing of culvert
sizes for my files. A standard private entrance detail should also be
incorporated into the plans in accordance with the enclosed private entrance
specification sheet.

10. The enclosed specification sheets should be incorporated into the plans.
11. Please be advised of the existing Potomac Edison electric transmission line
through the subdivision which appears to cross proposed streets in several
locations. It will be the developer's responsibility to have the power company
quitclaim any rights they may know have to this property. This will be required
before the streets may be added to the State's Secondary Road System.
12. A. The proposed 15'x10' box culvert over Abram's Creek is non-standard.
Therefore, we recommend a standard quadruple 12'x10' size.
B. It appears the box is too short to retain 2:1 fills at the "tight corners" on
each side of the road. Therefore, the -ends are to be skewed and the box
lengthened as noted.
C. It appears a side hill cut will need to be made to install the box. While we
are not familiar with sub -surface conditions this could lead to an unequal
type foundation, namely a yielding situation in the stream bed and a
non -yielding situation in the cut section. In order to determine sub -surface
conditions an investigation will be required. This may be coordinated
through cur District Materials Section.
D. Due to the structure's size we feel precast box sections cannot be allowed.
E. The developer will be responsible for paying the full salary and expenses of
a State assigned Inspector during construction of the structure.
Please revise the plans and resubmit three (3) copies for further review. Should any
changed be deemed necessary, please design them to meet or exceed the above
recommendations.

We have reviewed the above referenced plans as
submitted and offer the following comments:
ACCESS
1. It appears that access to this project is to be on
Hunter Run Road from the north across the box
culvert bridge which will cross Abrams Creek.
The proper stabilization of these culverts will be
important. Maintaining the integrity of the creek
during construction will be required. Controlled
backfill procedures will need to be applied in the
construction of this crossing.
2. The extension of Brookland Link to Route 6516 needy
to be coordinated with Coventry Courts (Larrick
Property Development).
3. The temporary cul-de-sac at the end of Brookland
Link needs to be a standard cul-de-sac with
temporary easement.
4. Streets need to be designed based on projected
traffic flows. These should be projected and
indicated on the map.
DRAINAGE ISSUES
1. Drainage computations and a drainage divide map has

Project Description
This project involved is being developed by Fred L. Glaize III and James Bowman.
The type of construction is 104 single family detached residences. This is the first phase of
a development having 230 single family units at full build out. The project will also involve
installation of roads, sewer, water and utilities. The total developed area is 103.22 acres.
The first phase consists of 45.72 acres.
Existing Site Conditions
Prior to construction, the site was characterized by rolling terrain,
predominately open with some undergrowth, all typical of undeveloped areas in the Upper
Shenandoah Valley. The site is in the Wiekert-Berks-Blairton Soil Association. This area is
characterized by gently sloping, moderately deep, somewhat poorly draining soils that have
medium to fine textured subsoil; formed in material weathered from shale.
Adiacent Areas
Most of the areas surrounding the development are residential in nature. The
Brookland Town Homes are to the north of the site, while the existing Fredrick Heights
Subdivision lies to the south. Abrams Creek runs just north of the site. A tributary of
Abrams Creek runs east of the site.
Soils
For purposes of design run off conditions, antecedent moisture condition II
(normal consideration for the mid -Atlantic region) is assumed. The soil is considered to
have a moderate rate of water transmission, therefore, CSC Soil Class "B" is adopted. Soils
are of the Series, for the most part of the Berk (1 B) or Wiekert (41 E) Series. A copy of
the respective soil map is enclosed.
Permanent Stabilization
Seeding for permanent stabilization is specified in the V.E.S.C. Handbook. Any
area denuded in which work is not proceeding for a period of 30 days or more will be
stabilized by a temporary seeding in accordance with State guidelines and procedures. All
areas to be seeded will receive seed application by hydroseed methods immediately upon
obtaining grades.
Storm Water Management Consideration
Site Plans have been attached.
The first phase of construction will employ roadside ditch design. There are but a
few culverts required, each of these have been size per VDOT requirements. All the ditches
have also been sized to meet state requirements. Grass linings have been used for two year
storm velocities less than 3 fps, EC-2 called for where velocities are from 3 to 5 fps, and
EC-3 where velocities exceed 5 fps. In no case do velocities for the two year storm exceed 8
fps.
All drainage from the site is carried either to Abrams Creek or its tributary
mentioned earlier. Both of these streams are considered adequate to carry the post
development 10 year storm without degradation or exceed a within banks condition.
Maintenance
All soil erosion control structures shall be checked weekly by the contractor
during this construction period and after construction is completed until grass cover is
established. Sediment retained by these structures shall be continuously removed and placed
in an area of the site specified, damage to soil erosion control structures shall immediately
be repaired when identified by the contractor. The contractor shall cooperate with all agents
of the County, the Engineer and others who may identify needed facilities or work in order to
protect the environment within the subject of this report.

regarding the above referenced development. In comparing your site plans with
a recently submitted preliminary master development plan for the adjoining
Larrick Property, there appears to be some discrepancy over the exact
alignment of the proposed Brookland Link roadway to Route 656. The proposed
development on the Larrick Property called Coventry Courts details the
location of the proposed roadway approximately 150' to the north east of your
proposed location making proper alignment almost impossible. Therefore, until
such time the exact alignment of the proposed Brookland Link can be worked out
between the two property owners and the Frederick County Planning Department,
your site plans will be filed at my office.

This is to acknowledge receipt of your memorandum dated January 31, 1990
regarding the above referenced development. In comparing your site plans with
a recently submitted preliminary master development plan for the adjoining
Larrick Property, there appears to be some discrepancy over the exact
alignment of the proposed Brookland Link roadway to Route 656. The proposed
development on the Larrick Property called Coventry Courts details the
location of the proposed roadway approximately 150' to the north east of your
proposed location making proper alignment almost impossible. Therefore, until
such time the exact alignment of the proposed Brookland Link can be worked out
between the two property owners and the Frederick County Planning Department,
your site plans will be filed at my office.
