As a result of this meeting the following items will need to be addressed prior to accepting construction of these streets: Shepherds Court ► Replace cracked curb & gutter adjacent to the drop inlet fronting Lot 101. Suffolk Circle P. Remove pipe stub within the curb fronting Lot 110. ► Remove excess concrete inside drop inlet #10 fronting Lot 117. Coopworth Court ► Replace cracked curb & gutter fronting Lot 144. General Notes ► Add topsoil, seed and mulch behind curb & gutter as needed throughout site. ► Remove vegetation between pavement and curb & gutter as needed. As you are aware they can be added if so requested by the Frederick County Board of Supervisors through resolution. Term. The affairs of the Association shall be managed by a Board of not less than three (3), but no more than nine (9) directors, who must be members of the Association.! Our design engineers do not recommend the method proposed whereby a performed elastomeric joint filler would be used along the gutter line. This method does not provide the normal service life which would be expected of our standard concrete curb and gutter entrance design. Also, there is no load transfer device between the gutter and the concrete slab entrance. We suggest two alternatives. One method would be to totally remove by saw cutting the curb and gutter and repouring the entrance to match our standard design. The second alternative would be to saw cut and remove the curbing as you have suggested. However, the entrance slab would have to be tied to the gutter pan with 5/8 dowel bars on 1' centers extending 6" into the existing and new concrete. We anticipate the developer would choose the second alternative and hope this is mutually agreeable with him. However, if you would have any other suggestions we would be happy to consider such. Also, please understand alternative #2 should in no way be considered a standard for any additional work in subsequent phases of Albin Village or other developments within Frederick County. We understand the inability, at your level of review, to modify VDOT standard designs and of course understand your desire to reduce maintenance cost in the future. We however, feel that extenuating circumstances exist in the case of Albin Village which justifies the approach recommended in our letter of November 2. I am filing this letter to respectfully request an appeal of decision to the District Administrator in accordance with VDOT standard policies and guidelines. First, let me say that the Albin Village subdivision was the first master planned community in Frederick County and the first approved. It is a clustered development which provides for minor collector roadways with no lot frontage and cul-de-sac "pods" around which the houses are clustered. It worked well in concept, with the exception of drainage. It was determined by the owner that the 8000 and 10,000 sq. ft. lots would be better served with curb and gutter than with road side ditches and, as a result, the concept was retrofitted with curb and gutter for phase 3 of the project. Since this was the first major subdivision in Frederick County to be provided with curb and gutter streets and, since the vast majority of other road construction in the county was road side ditch, the details of curb and gutter design were debated during the review process for this project. Concurrent with our proposal for curb and gutter, came the revised state subdivision regulations which allowed CG-7 as well as a half moon valley gutter curb as an alternative in subdivision planning. We discussed using the "roll top" with VDOT staff members who generally felt it inadvisable for use in our area. We selected the CG-7 design as a "mountable curb" in order to construct all curb and gutter without the need to decide on entrance locations. Since th subdivision is a custom home style development each house is i makes the entrance location very difficult to decide on in advanc pp JAN i We designed the subdivision, had the plans approved by your office and completely constructed the subdivision under your inspection pursuant to the above conditions. We then constructed houses on certain lots and constructed the driveways to the back face of the CG-7 using this as mountable curb. After this had been in place for some time, your office advised, through field personnel, that the installation was unsatisfactory. We then began the process of attempting to retrofit a reasonable alternative to the situation we have. We continue to feel that complete removal of the curb and gutter, since finished pavement has been constructed on the site, will produce a damaging effect to the surface of the bituminous causing patches on the newly constructed road and often cause damage to the driveways themselves. We continue to feel as follows: 1) The joint between the two concrete surfaces can be sealed adequately to prevent future problems. 2) The very light amount of drainage produced by the tertiary street design concept will have no effect on gutter flow capabilities. 3) The streets on which the entrances exist are strictly residential, can not be extended under any conditions and will be low traffic volume and require minimal maintenance. 4) The proposed design will not be considered as a standard for any additional work in subsequent phases at Albin or other projects; it is simply a retrofit to an existing condition that occurred as a part of the transition between road side ditches and curb and gutter in Frederick County. It will not set a prededent in that regard. We realize that variances from existing standards are and should not be easily granted, however, in this case we plead for the appeal officer's positive recommendation. If allowed this would undoubtedly cause uneven settlement between the pan and the driveway, thus causing this Department maintenance problems for years to come. As we have previously advised, we realize slip forming the development's curb and gutter was probably more economical for your client since his contractor did not have to consider private entrance locations at the time of installation. Also, we -can certainly understand your concern over the possible disruption to the existing bituminous roadway surface should the gutter pan be removed. However, we do not feel"\ these factors are justification to allow for substandard installation which would ultimately cause us problems. In order to maintain the integrity of the pavement structure we would suggest a straight edge be fastened to the roadway prior to the removal of the gutter pan. We have discussed this at some length at various times and based on our analysis, at this point, we still need to reach an agreement on driveway installation.. In order to implement a new curb and gutter system, as VDOT has suggested, the gutter pan needs to be removed to the limits of existing pavement. As you know, the existing pavement is the final surface course and is finished. It looks good. By pulling the gutter pan away from the we undoubtedly will disturb the stone base structure underneath the edge causing cracking and settlement. The resulting patch of the bituminous surface will not be smooth and, as ' you know, will settle and leak rather quickly. This would be unfortunate since it would looks good now. I understand that your problem with the way the first batch of houses were treated (per attached detail) is the possibility of moisture leaking into the cold joint created at the face of the cut. We propose here to use a Preformed Elastomeric Joint (PEJ) with a bituminous cap in the gutter/driveway joint. I have modified the detail to indicate this approach. We request that this detail be used for all driveways placed in existing curb and gutter sections, which would be all of Albin Village Phase III. I believe you may have received a copy of the fax when we sent it. The detailed difference between a roll top and mountable curb seems essentially insignificant in looking at the detail. Since the existing contract with the owner has been established based on using the CG-7 curb and gutter detail it would certainly be advantageous to continue that design throughout this phase of the work. We have, nevertheless, requested the contractor to proceed with the roll top alternative and if your office reconsiders please advise me immediately. Another issue has arisen two months into the construction process regarding the pavement design for the side streets versus the main street. Specifically, the contractor has been advised by the V DOT inspector that the additional thickness of bituminous concrete and base stone is required on each minor street connection to the curb return point where the pavement can be transitioned to the lighter sections. This will result in a five figure increase in cost to the owner, over and above the agreed upon contract price. The contractor has estimated the project for thickened pavement only from the outside edge of pavement of the heavier road section. After close review of this situation we see no justification for the additional cost and additional pavement thickness. We consider the pavement thickness to be a function of wheel loading both in number of occurrences and gross weight. It seems to us that the actual loading of the transition pavement under discussion will be only the same loading that occurs on the road itself. The question as to why thickening this pavement and much additional cost in view of that criteria must be asked.
