Dear Ben:
Thanks for the recent package on Thwaite Avenue. I sure want to get
all these streets into the secondary system as soon as possible.
I talked to Bob Childress about this on Tuesday and he said he had
an inspection of this street scheduled and would get me a legal
description soon so I can proceed with the resolution.
I observed the other evening that Adelphia Cable is in the process
of installing underground cable on this street. I suggest you
request a quit claim permit from them also so we don't have any
glitches downstream.
If you have any questions please give me a call.

'I''tis is to acknowledge receipt of your letter dated June 1, 1988 to the above
referenced subdivision. Enclosed please find the performance bond and deed
for the cul-de-sac which I am returning. Listed below are our comments.
For the performance bond it will be necessary to execute in its entirety (all
blanks must be filled in).
As previously stated in my letter to your office, in the deed between Fruit
Hill Orchard, Inc. and the County of Frederick, the cul-de-sac of Thwaite
Avenue must be put to record and recorded in the Clerk's Office along with a
final plat showing the right-of-way.
Please advised if you need additional information.

This is to confirm my telephone conversation with you on Wednesday, April 20,
1988 concerning a Resolution for the above referenced subdivision submitted by
Mr. John R. Riley, Jr. in a letter dated April 14, 1988.
As advised., there are several items which need to be included with this
Resolution.
According to our records and to date, we have not received information showing
the cul-de-sac has been put to record and recorded in the Clerk's Office.
This will have to be included in the Resolution, showing the deed book, page
number and date of recordation.
The Resolution states Thwaite Avenue is 900 from Route 679 to the dead end.
According to our records we now have .2 of a mile or 1,056 feet.
In the last paragraph you indicate there is a fifty (50') feet right-of-way.
According to the approved plans there is a sixty (60') feet right-of-way.
When the above items have been corrected, please resubmit the Resolution. In
the meantime, should you have any questions please do not hesitate to contact
me.

RESOLUTION
BY THE
FREDERICK COUNTY BOARD OF SUPERVISORS
At a regular meeting of the Board of Supervisors of Frederick County,
Virginia, held this 13th day of April, 1988, it was duly moved and seconded
that the following resolution be adopted.
BE IT RESOLVED, That the Virginia Department of Highways and Transportation is
hereby requested to add the following roads to the Secondary System of
Frederick County pursuant to Section 33.1-229 of the Code of Virginia, 1950,
as amended.
1) Thwaite Avenue, Albin Acres, Section II; 900 feet from Rome 679 to the
dead-end, as described in Deed Book 474, Page 482, Dated May 23, 1977.
AND FURTHER BE IT RESOLVED, That the Board does guarantee the Commonwealth of
Virginia an unrestricted right-of-way of 50 feet as described in the above
deed book and referenced page numbers with necessary easements for cuts,
fills, and drainage.

Avenue Extension, along with the original Certificate of
Deposit.
I am also enclosing a copy of the Easement which was

end of Thwaite Avenue.
