Final administrative approval will be contingent upon submission of modified plats reflecting the

Winchester Regional Airport, in the southwest corner of Route 728 (Victory Road) and Route

SUBDIVISION SPECIFICS: Subdivision of a 9.6150 acre tract into 4 lots.
DW-Amn nt of Transportation: No overall objections to the subdivision of this property.
Entrances will have to be constructed to VDOT minimum standards to allow for safe
egress and ingress of the properties. Prior to development of the lots we will require a
complete set of construction site plans with detailed entrance designs and drainage features.
Any entrance or other right-of-way construction will need to be covered under a land use
permit. We also request the owner to provide a right-of-way dedication on the southeast
comer of Lot #3, in order to enclose the intersection radius of Route 1000 (Arbor Court) .

Sanitation Authorit: The drawing is a final plat of subdivision; the existing water
easement is correct. The other three lots (2,3, and 4) show no water and sewer services.
Fire Marshal: Will address on site plans for individual lots, as developed.
Inspections Dept: No comment at this time. Shall comment on building use when
individual site plans are submitted.
City of Winchester: No comment.
Count, Engineer: Drainage easements shall be indicated in pertinent locations to
accommodate the existing topographic conditions. A more detailed review will be made
when individual site plans are submitted.
Winchester Regional An port: Require FAR Part 77 Contours be shown (10' intervals)
on the plan or on a supplement plan along with heights of the Federal Express building
comers and the top of the microwave dish.
Planning and Zoning: This application as presented, meets all of the requirements of the
subdivision ordinance. There is no existing master plan for this property and waiver of
this requirement is recommended. The applicant has advised that the presented plats will
be modified to reflect the dedication of a portion of Lot 3 for a right-of-way as requested
by VDOT. Most of the issues raised by the review agencies will be addressed during the
site plan stage for each parcel.
STAFF RECOMMENDATION: Approval with the requirement that plats be modified to reflect
requested VDOT dedication and all other outstanding review agency comments be complied with.
SUMMARY OF 1/17/96 PLANNING COMMISSION ACTION: The Commission had no
questions or concerns with this application and unanimously recommends approval.
(Messrs. Romine, Ours, Marker, and Stone were absent.)

THIS DEED OF DEDICATION made and dated this 30th day
of January, 1996, by and between NORTH FREDERICK REALTY. L.L.C., a
Virginia Limited Liability Company, party of the first part, hereinafter
called the Declarant (Grantor) , and THE COUNTY OF FREDERICK.
VIRGINIA, party of the second part, hereinafter called the
Grantee; and B. ]. TISINGER and JEFFERSON NATIONAL BANK, Sole Acting
Trustee and Beneficiary, respectively, parties of the third
part (Grantors) .
WHEREAS, the Grantor is the owner in fee simple of a
certain tract or parcel of land, lying and being situate in
Shawnee Magisterial District, Frederick County, Virginia,
containing 9.6150 Acres, and more particularly described on
plat of survey drawn by Marsh & Legge Land Surveyors, P.L.C.,
dated December 21, 1995, attached hereto and by this reference
made a part hereof; and being the same land acquired by the
Grantor by deed of record in the Office of the Clerk of the
Circuit Court of Frederick County, Virginia in Deed Book 731
at Page 363, and by Deed of Confirmation dated February 9,
1995, of record in the aforesaid Clerk's Office in Deed Book
838 at Page 526; and,
WHEREAS, the said real estate, as shown on the aforesaid
attached plat, has been subdivided into lots and the attached

land, together with the dimensions of each lot thereof, and
further shows the easements necessary for the installation and
maintenance of water and sewer facilities for said lots, and
further shows that certain land containing 116 square feet

Virginia for a public right of way for the improvement of
Victory Road and Arbor Court; and,
WHEREAS, the land is subject to the liens of deeds of
trust dated March 2, 1992 and December 21, 1994, of record in
the aforesaid Clerk's Office in Deed Book 773 at Page 469 and
Deed Book 832 at Page 740, respectively, in which the Sole
Acting Trustee is one of the Trustees, and the Beneficiary is
the holder of the entire obligations secured thereunder; and,
WHEREAS, the Declarant now desires to subdivide the same
into lots to be known as the AEROCENTER BUSINESS PARK as it
now appears on the aforesaid attached plat and is with the
free consent and in accordance with the desires of the
Declarant, Trustee and Beneficiary, and the parties Hereto
further desire to subdivide the aforesaid real estate in
accordance with the provisions of the "The Virginia Land

of the date of execution of this Deed of Dedication.
NOW, THEREFORE, THIS DEED OF DEDICATION
WITNESSETH: That for and in consideration of the premises
and benefits which will accrue by reason of this Dedication,
the Declarant does hereby subdivide and dedicate in fee simple
all of those certain lots, lying and being situate in Shawnee
Magisterial District, Frederick County, Virginia, containing
9.6123 Acres, in the aggregate, and more particularly shown on
plat of survey drawn by Marsh & Legge Land Surveyors, P.L.C.,
dated December 21, 1995, attached hereto and by this reference
made a part hereof as if set out in full.
The Declarant does hereby grant, convey, and dedicate to
the County of Frederick, Virginia, with general warranty of
title, that certain tract of land, containing 116 square feet
(0.0027 Acre), as shown on the detailed insert on the
aforesaid attached plat and which is by this reference made a
part hereof as if set out in full, and which dedication is for
the improvement of Virginia Secondary Route 728 and Virginia
Secondary Route 1000.

The property dedicated hereby is subject to certain
easements or rights of way designated 20' PERM. WATER ESM'T.
on the aforesaid attached plat, and to a certain 40' INGRESS/
EGRESS EASEMENT along the southern boundary of Lot 4 and along
the common boundary of Lots 1 and 2, as shown on the aforesaid
attached plat.
The Sole Acting Trustee and Beneficiary join herein for
the purpose of releasing the liens thereof insofar as they
relate to the 116 square feet (0.0027 Acre) conveyed hereunder
to the County of Frederick, Virginia, and to consent that this
Subdivision shall not be construed as a default as provided in
said deeds of trust, all of which is with the authority and
consent of the Beneficiary which is attested by the
Beneficiary's signature hereto. This release and consent
shall not otherwise affect the validity of the liens created
by the aforesaid deeds of trust.
The dedication and subdivision of land as shown on the
aforesaid attached plat is with the free consent and in
accordance with the desire of the undersigned Declarant,
Proprietors, Trustee, and Beneficiary of the land being
subdivided and is in conformity with the provisions of "The
Virginia Land Subdivision Act" as are applicable, together

The above referenced property, zoned M-1, is proposed to be subdivided into four
lots as shown on the attached plat. Initial discussions with Evan, indicated that
this project is eligible for a waiver of the Master Development Planning (MDP)
process requirements. Your approval of a waiver for the MDP requirements for
this subdivision is requested.
This project does not add any new streets or change any existing streets or rights -
of -way. Stormwater management is planned to be handled on an individual lot -
by -lot basis. The property is not an integral portion of a future development;
