VA Dept. of Transportation - No comments are warranted by this office at this
time. When development is anticipated/planned, the appropriate plans must be
submitted for our review.
Sanitation Authority - There is a 20 foot sewer easement across the northwest
corner of Parcel 2.
Health Department - No objection. Central water and sewer utilities are
available.
Planning and Zoning - A portion of the existing parcel is zoned RP, a part
B-2, and a portion M-1. The applicant is requesting to divide the 80+ acre
parcel into four tracts, along the existing zoning boundaries. The RP
portion (Tracts 1 and 2 on the plat) consists of two tracts totaling just
over 40 acres. The B-2 portion (Parcel 3 on the plat) consists of 9 1/2
acres, and the M-1 portion (not labeled) consists of 29 1/2 acres. Given the
varied zoning on the parcel, the division is more or less a formality. The
plat should indicate the acreage of the M-1 portion and show it as Parcel 4
in the division. The total acreage of the parcel indicated on the plat
should also be adjusted to reflect the acreage in the M-1 portion.

1. The Vendor and the Purchaser will enter into and grant to
each other such sub -surface cross easements for sewer,
water, gas and electric for the benefit of thelReal Estate

2. Vendor warrants property is zoned RP with the zoning laws
of Frederick County, Virginia. The'Vendor agreed at the
time of present zoning that on development of subject
property houses having common property lines with the
Airport Road would not have driveways accessing directly
onto the Airport Road. Houses would not front directly on
the Airport Road, and a buffer would be built between the
houses and the Airport Road. ,iPurchaser agrees to abide by
this agreement.
3. .-IPurchaser acknowledges the existence of a Master Plan for
the property, and agrees to abide by said plan, a copy of
which is attached hereto.
4. The pond lies partially on the subject property and
partially on the remaining property of the V ndQr. The
pond shall not be used for recreational purposes, but shall
be available for Purchaser's storm water drainage and
retention Qurposes. The -;Purchaser shall maintain the
pond. The•)Vendor shall give to the'J_Purchaser an easement
to use and maintain the pond.
5. Water and sewer lines shall be designed and built in
accordance with the approved Master Plan, and under the
supervision of G.W. Clifford and Associates.
6. ',Vendor reserves the right to approve the models to be
constructed on the land,'1which approvals shall not be
unreasonably withheld.
7. ?Vendor shall have the right for a period of nine months
following settlement to process and remove top soil
currently stockpiled by Vendor lin the region identified on
plat attached.
In the event Purchaser intends to commence development of
that portion of the Real Estate where such top soil is
stockpiled prior to the expiration of such nine l9� month
period, then within ninety (90) a r after notice -from -
Purchaser, Vendor will either rebate such stockpile to
