Edward Lizer and Hilda W. Lizer, his wife, of the other part, hereinafter called the Grantees® WITNESSETH: That for and in consideration of the sum of Ten ($10,00) Dollars and other valuable consideration, receipt whereof is hereby acknowledged, the Grantor does hereby grant and convey, with general warranty and English covenants of title, unto the Grantees, as tenants by the entirety, with the right of survivorship, as at common law, together with all rights, privileges and appurtenances thereto belonging, all of that certain lot of land located about 1-1/2 miles West of Cedar Grove in Gainesboro District, Frederick County, 1,7-Irginia, lying and being situate between lots numbered 10 and 11 on the plat of Lake St. Clair, Incorporated, which plat is recorded with a deed of declaration dated January 30, 1959, and of record in the Clerk's Office of the Circuit Court of Frederick County, Virginia, in Deed Book 256, page 127, and which is more particularly described by survey of Richard U. Goode, C.L.S., dated May 1, 1978, and being part of the same property conveyed to the Grantors by deed of John G. Goodwin, et ux, dated January 30, 1959, recorded in said Clerk's Office in Deed Book 256, page 125. This conveyance is made, however, subject to the following restrictions, which are constituted covenants real running with the land: (a) Except for a Deed of Trust or mortgage this lot may not be conveyed nor may any interest in this lot be sold, optioned or assigned, unless the same be offered at an advertised public sale, and the Corporation be notified by registered mail of such public sale, until the Grantor or its successor in title has been given, within the preceding 18 months of the date of proposed conveyance, sale, option or assignment, the right to purchase said lot from the then owner for a sum of money not less \�, 6V6J ��R��� L 4W than the price for which said property or any interest therein shall be proposed to be conveyed, sold, optioned or assigned. Such offer or notice of public sale shall be made in writing and shall be sent to the Grantor or its successor by registered mail posted at some post office within the State of Virginia and addressed to the Grantor or its successor, in care of the Grantor's registered agent. The notice shall be considered as having been received by the Grantor two days after it is posted. The Grantor shall then have thirty days to contract to pay said price or forfeit said right to purchase. (b) Whereas, the Grantor is a non-profit cor- poration, operating as a club for the purpose of maintaining lakes, ponds and other recreational and service facilities for the benefit of the owner of the lots included within the said plat or within any area located within one mile of the attached plat which is purchased by the Grantor or in which the Grantor shall have acquired such rights as he has reserved in the lots hereby conveyed. Now, Therefore, in order to operate and main- tain the said recreational and service facilities, which may be operated by the Grantor for the benefit of its club members, the Grantor retains a lien upon the lot hereby conveyed to secure payment of all dues, rent or other sums of monies which may be levied by the Grantor upon the lot owner. (c) In the event of the death of the owner of any of the lots, or any interest therein, the lot shall pass in accordance with the will of the decedent, or if he dies intestate, in accordance with the laws of intestacy in the State of Virginia, subject, how- ever, to the covenants, agreements, and restrictions herein contained, which covenants, agreements, and restrictions shall be binding upon the heirs, distributees and the personal representatives of such owner. Each of the covenants and agreements herein con- tained are severable and in the event that any one or more of such agreements and covenants shall. be found to be illegal or unenforceable in law, the remaining legal and enforceable covenants shall be binding upon the parties, their successors, hairs, distributees, personal representatives and assigns. By using the word, "assigns" in this Deed, it is not intended to give to the Grantee, or his successor in title, any right to assign, convey, option or sell this lot or any interest therein contrary to the provisions of this agreement or free from any of the restrictive covenants in this agreement. The use of the word "assigns" is to bind any successor in title of the Grantee to the restrictive covenants, agree- ments, options and rights herein contained and reserved to the Grantor.
