REVIEW EVALUATIONS: Frederick County Sanitation Authority: Water and sewer capacity available to this lot. Virginia Dept. of Transportation: See attached letter dated February 6, 1990. Frederick Co. This area has a low water pressure problem. Frederick Co. Fire Marshal: No problem with the development as long as water requirements can be met. This is a major issue in this area. Planning and Zoning: This division of land is appropriate for this industrial park area. The problem that exists on this tract is the required storm water detention basin that will be divided between this parcel and the adjoining parcel (Lot # 28). The construction and maintenance of this basin must be tied down to eliminate any long term conflicts. It is suggested that this basin be constructed by the applicant and that maintenance be assigned to the two lot owners through deed covenants. The state and/or the county will not be responsible for this facility. This basin must also be constructed and functioning to comply with the VDOT requirement as stated in their letter of February 6, 1990 to the applicant. It is clear that further stabilization of the ditch is necessary. As I told you, I plan to meet with our engineers at G. W. Clifford and Associates, Inc. to discuss this matter and have them recommend measures that will stabilize the drainage ditch to deter erosion as much as possible. Gilpin The Lenoir City Company of Virginia P.O. Box 117 Boyce, Virginia 22620 Dear Tom: At the regular meeting of the Frederick County Planning Commission on May 2, 1990 Mr. Douglas O. Grimm and Mr. Al Shirley appeared before the Commission with a complaint that a large amount of silt, straw and other debris was being diverted into Red Bud Run from the Stonewall Industrial Park. They alleged that the stream was being filled with foreign materials to the point of near overflow into the Grimm property (which is being farmed by Mr. Shirley.) After considerable discussion Mr. Kenneth Stiles suggested that all interested principals meet at the site on Thursday,>May;3, 1990 at 9:30 am. Mr. Manuel DeHaven, Mr. Charles Orndoff, Mr. Stiles, Mr. Shirley, Mr. Grimm, Mr. Charlie Hott (Supreme Block) and Mr. Evan Wyatt and myself of the Planning staff met at the intersection of Lenoir Drive and Red Bud Run at the appointed time. We walked the length of Red Bud Run from Lenoir Drive to a point opposite the Supreme Block construction site. I believe the following valid problems were identified: 1. Some clay dirt and straw have infiltrated'Red Bud Run. 2. It appears that the material entering Red Bud Run did so via the first drainage ditch west of Lenoir Drive. 3. This drainage ditch intersects Red Bud Run at a 90 degree angle and a heavy flow would cause excessive opposite stream side erosion and cause migration -to the Grimm property very quickly. 4. This drainage ditch is not properly stabilized and therefore easily eroded. 5. Upstream investigation of this drainage ditch revealed that dirt infiltration is occurring as far as the large mound of soil located behind the American Woodmark facility. The following are actions that should be seriously considered as 9 Court Square - P.O. Box 601 - Winchester, Virginia - 22601 Page -2- T. Gilpin May 8, 1990 corrective measures to eliminate the existing problem and insure no further degradation of the stream. This would also preclude heavy runoff from invading the Grimm property when it might not otherwise happen. 1. Change the direction of subject drainage ditch so that it intercepts Red Bud Run at a more appropriate angle of about 45 degrees. 2. Stabilize the ditch by matting and seeding in accordance with Virginia Erosion and Sedimentation Control Handbook. 3. Place rip -rap at the throat of the ditch where it intersects Red Bud Run to preclude erosion. 4. Reinforce the opposite stream band (on the Grimm property) by increasing the height and stabilizing with rip -rap. 5. Insure proper erosion and sedimentation procedures are being used upstream in the drainage ditch to eliminate further infiltration into Red Bud Run. The County Officials who visited this sight were in agreement that this needs to be taken care of as soon as possible. Your cooperation and action to correct this situation would be greatly appreciated. I will be available most any time to discuss this in further detail so that we insure all the details are covered. I apologize for not having time between the evening and morning meetings to get in touch with you so that you could have possibly been on the scene. The agreement absolves the Department of any maintenance or liability responsibilities of a detention basin within a subdivision. As you know an agreement such as this will be required between�VDOT and Frederick County , +L prior to any additional streets in the Stonewall Industrial Park being added to the State's Secondary Road System. I apologize for any delay in getting back with you on this matter. I was trying to locate a more recent agreement, however, it appears this example is the most recent one used in the Edinburg Residency. Again, please remember this is an example and the wording may be adjusted to fit the particular situation in the Stonewall Industrial Park.
