REVIEW AGENCY COMMENTS: N/A Public Meeting Requirement The original subdivision where this tract of land is located is known as "Lake Holiday" and does not have an approved Master Development Plan (MDP). The Subdivision Ordinance requires that land divisions in the R-5 (Residential Recreational Community) Zoning District, without an approved master development plan, be presented to the Board of Supervisors for final approval (Chapter I 44-12-B). Subdivision Application #22-05, Lake Holiday, Section 10 January 3, 2006 Page 2 Background This subdivision request is to relocate 14 lots ranging from 10,000 square feet to 13,000 square feet in area, on 3.35 acres along Masters Drive. This 3.35 acre property had been zoned R-5 (Residential Recreational Community) when Frederick County adopted zoning in 1967. This proposed subdivision is located outside the SWSA and UDA as indicated in the 2003 Frederick County Comprehensive Polices The Subdivision Ordinance requires that land divisions within the R-5 (Residential Recreational Community) Zoning District, without an approved master development plan, be presented to the Board of Supervisors for final approval. The Master Development Plan (MDP) requirement may be waived, and has been waived for this project in a letter from staff to the applicant dated February 05, 2004. This relocation of the 14 lots in Section 10 of Lake Holiday will not require any new road construction, while preserving a larger open space. No additional lots are to be created with this exercise; the applicant is relocating 14 lots of record. These lots will be relocated from Palmer Circle to Masters Drive. This proposed subdivision is on land zoned R-5 and does not contain an approved MDP; therefore, Planning Commission and Board of Supervisors review and action is necessary. STAFF RECOMMENDATION FOR 12/07/05 PLANNING COMMISSION MEETING: The proposed subdivision appears to satisfy the requirements of the zoning ordinance and subdivision ordinance. A recommendation to be forwarded to the Board of Supervisors would be appropriate. PLANNING COMMISSION SUMMARY & ACTION OF THE 12/07/05 MEETING: Mr. Mike Perry, Project Manager with Miller and Smith, was representing Lake Holiday, LLC. In answer to the Commission's inquiry on why the lots were being relocated, Mr. Perry replied that the marketability of the proposed lots on Masters Drive would be greater than the original lots platted on Palmer Circle. Mr. Perry said the right-of-way on Palmer Circle will be removed (no road had been built) and the platted lots vacated; he said there will be no increase in the number of lots placed on Masters Drive. There were no public comments. No issues of concern were raised by the Commission. The Planning Commission unanimously recommended approval. This meeting provided me with an overview of the various aspects of your proposals, and enabled us to discuss what development review requirements will be required to obtain necessary County approvals. Based on our discussion, it has been determined that your development proposals could be addressed in two phases. The first phase would involve the re -location of 14 lots within Section 10. The second phase, a much larger undertaking, would involve significant revisions to the Summit's master plan. Development Review Phase 1: Re -location of 14 lots within Section 10. In order to relocate 14 lots from Fairway Circle to Masters Drive, a Subdivision Design Plan (SDP) will be required. This SDP will ultimately require review by the Board of Supervisors. This process would enable Section 10, Lots 594 through 607 to be relocated. As a result of these re -locations, Fairway Circle would not be constructed; the 14 platted lots on Fairway Circle will be abandoned; and as such, the area should be designated open space. The entire boundary limits and features of Section 10 should be illustrated on the SDP. Phase 2: Establishment of a Master Development Plan for the Summit Any revisions to the recorded lot layout, road configuration, open space delineations, etc., will require the establishment of a new Master Development Plan for the entire Summit development. Cooperation and participation by the property owners association and the utility company will be vital elements of a revised master development plan. David E. Lellock, P.E., L.S. The required agency comments will include: Frederick County Sanitation Authority (FCSA), Fire Marshal, School Board, Parks and Recreation, Public Works, Building Inspections, and Planning. It is expected that the Lake Holiday Country Club (property owners association) and the Lake Holiday Estates Utility Company will be involved in the review process. Participation and endorsement from the property owners association and the utility company will be a necessary participation element for the modifications to the Summit.
