SUBJECT: Addition of Roads in the Lakeside Estates Subdivision, Section II,
to the VDH$T's Secondary System

DATE: February 25, 1986
Attached is a Resolution by the Frederick County Board of Supervisors authorizing
the Virginia Department of Highways and Transportation to add two streets in the
Lakeside Estates Subdivision, Section II, to the Secondary System. Mr. Kieth D.
Walker, Inspector.:for the Highway Department, and the Planning Staff have checked
these streets and it appears they have been constructed according to the approved
plans and minimum standards.
If you have any questions prior to the Board meeting, please do not hesitate to
call me.

BY THE
FREDERICK COUNTY BOARD OF SUPERVISORS
At a regular meeting of the Board of Supervisors of Frederick County,
Virginia, held this 26th day of February, 1986, it was duly moved and seconded
that the following resolution be adopted.
BE IT RESOLVED, That the Virginia Department of Highways and Transportation is
hereby requested to add the following roads in Lakeside Estates, Section II,
to the Secondary System of Frederick County pursuant to Section 33.1-72.1 of
the Code of Virginia, 1950, as amended.
1) Aspen Drive from White Pine Circle to 40 feet north of Willow Oak Circle,
containing 670 feet; and,
2) Willow Oak Circle from Aspen Drive to the dead-end, containing 700 feet;
AND FURTHER BE IT RESOLVED, That the Board does guarantee the Commonwealth of
Virginia an unrestricted right-of-way of 60 feet with necessary easements for
cuts, fills, and drainage; recorded in Deed Book 407, Page 572, dated April
26, 1973.

FREDERICK COUNTY BOARD OF SUPERVISORS
At a regular meeting of the Board of Supervisors of Frederick County, Virginia
held this day of 1986, it was duly moved and seconded the
following Resolution be adopted:
NOW, THEREFORE, BE IT RESOLVED: In order to provide route numbering
continuity in this area, the Virginia Department of Highways & Transportation
requests and the Frederick County Board of Supervisors do hereby agree to renumber
a section of Route 1039 (Aspen Drive) 0.08 miles section as Route 1080. Also, to
renumber White Pine Circle, presently numbered Route 1039, a length of 0.14 miles
as Route 1081 in accordance with policy set forth by the State Highway Board.

THIS DEED AND DECLARATION OF EASEMENT, made and dated
this 8th day of January, 1985, by and between LAKESIDE
DEVELOPMENT COMPANY, party of tPe first part, hereinafter called

LAKESIDE DEVELOPMENT, and the COUNTY OF FREDERICK, VIRGINIA,
party of the second part, hereinafter called COUNTY, and JOSEPH
A. MASSIE, JR., Sole Acting Trustee under that certain Deed of
Trust, dated October 2, 1984, of record in the Office of the
Clerk of the Circuit Court of Frederick County, Virginia in Deed
Book 583 at Page 285, party of the third part, hereinafter called
TRUSTEE.
WHEREAS, LAKESIDE DEVELOPMENT is the owner of the here-
inafter described lots, all of which are located in Lakeside
Estates Subdivision, Block 3, Section II, and being a portion of
the same land conveyed to LAKESIDE DEVELOPMENT by deed dated
October 2, 1984, from DANAC Real Estate Investment Corp., et al,
a
of record in the aforesaid Clerk's Office in Deed Book 583 at
Page 280; and, 4
WHEREAS, LAKESIDE DEVELOPMENT desires to dedicate
certain drainage easements to the COUNTY to facilitate the
building of roads in Lakeside states Subdivision, Section II.
NOW, THEREFORE, WITNESSETH: That for and in considera-
tion of the mutual benefits to be derived therefrom, LAKESIDE

DEVELOPMENT and the TRUSTEE hereby grant unto the COUNTY certain
drainage easements over Lots 7 and 8, Block 2, Section II,
Lakeside Estates Subdivision, and over Lots 41 and 44, Block 3,
Section II, Lakeside Estates Subdivision, which easements being
designated as "proposed drainage easement" on each of the plats
hereto attached and by this reference made a part hereof as if
set out in full.
The said easements are for the construction, mainte-
finance, operation, and reconstruction of surface drainage water as
(designated on each of said attached plats.
It is understood and agreed between the parties hereto
that no obstructions whatsoever shall be placed upon said perma-
nent rights of way.
The granting of the easements herein shall in no way
release the lien of the deed of trust of record in the aforesaid
Clerk's Office in Deed Book 583 at Page 285.

AFFIDAVIT AND PLAT
WHEREAS, DANAC Real Estate Investment Corporation, a Maryla
Corporation and Virginia Lakeside Sewer and Water Company, a
Virginia Corporation, granted and conveyed a certain tract or
parcel of land by deed dated June 1, 1983, to Kenneth E. Walker
and Hazel B. Walker, his wife, which was recorded with a plat in
the Clerk's Office of the Circuit Court of Frederick County,
Virginia; and
WHEREAS, the plat does not bear the approval of the
Planning Administrator and his signature as required; and
WHEREAS, the plat, in all respects, meets the requirements
of the ordinances of Frederick County, Virginia;
NOW THEREFORE, I, John T. P. Horne, Planning Administrator
for Frederick County, Virginia, do hereby ratify, approve and
confirm said plat as a certain lot containing 1.141 acres,
instead of adjoining individual lots and that the is
