PROPOSED USE AND IMPROVEMENTS: Townhouses and Day Care Facility
with Conditional Use Permit
REVIEW EVALUATIONS:
Va. Dept. of Transportation - No overall objection to Master
Development Plan for this development. Before making final
comments my office will require a complete set of construction
plans, drainage calculations and traffic flow data from the
ITE Manual, 4th edition for review. Any work performed on the
State's right-of-way will be covered under a land use permit.
Sanitation Authority - Water and sewer capacity is available.
Five (5) comments on drawing must be addressed and
resubmitted.
Frederick County Fire Marshal - Hydrant needs to be placed
just off Chinkapin Drive to meet 300 feet distance for rear
of townhouses and day care center. Check the size of the 4
inch water main.
Parks and Recreation - The space identified as the recreation
area does not appear to be large enough to accommodate the
equipment included in the project summary. Notice to
applicant regarding area standards attached.
Inspections - This request for Master Development Plan
approval, for RP zone shall comply to Use Group "R"
Residential Section 309.0 of the BOCA National Building Code
"1987". Day Care Use Group will be determined at the time of
plans review.
Frederick -Winchester Health Dept. - No objection. Area
served by central water and sewer.
Planning and Zoning - The proposed townhouses are a by -right
use in the RP zone, day care facilities are allowed with a
conditional use permit which in this case has been granted by
the Board of Supervisors.
With 23 units proposed the density on the 3.4 acres designated
for townhouses is 6.76 units per acre, and 5.52 units per acre
using the entire 4.16 acres making up the tract. Both figures
are within the maximum density allowed. Thirty percent open
space is required or 1.25 acres, the plan shows 1.27 acres.
One recreational unit is required, and is indicated on the
plan. No environmental features as defined by the ordinance
are present on the site.
ADDITIONS/CHANGES
1) In light of plans for future improvements to route 642,
sufficient right-of-way should be dedicated to allow for
widening.
2) Details of the proposed road efficiency buffers should be
shown on the plan.
3) Some provision should be made for screening between the
rear of the townhouse units and the day care facility.
4) The scale of the plan needs to be indicated.
Staff Recommendation - 12/19/88 Approval, with review agency
and staff comments being addressed.

a. Drainage easement of 30' is noted although measured
distance is only 201.
b. If the existing lake is adequate, than on site SWM may
not be needed.
c. If required, the detention pond should be designed as a
minimum for a two year storm, with the ability to pass
the 100 hundred year storm with appropriate spillway.

Marshall and the F.C.S.A.
3. GENERAL
a. Open space area should be delineated; it appears to be
less than 1.37 acres.
b. Day care facility rear yard adjacent to RP district is
less than the 30' minimum required. Is this part of the
conditional use Permit?
c. Roadway efficiency buffer (501) encroaches the property
line of one townhouse by 51, will this have a negative
impact on the ability to provide full landscaping with
the 10 foot landscape easement? Also, will this prohibit
.the lot owner from placing a privacy fence within this
buffer area?
