THIS PLAT (of KENDALL HEIGHTS - SECTION II), made and dated this -IJ day of July, 1998, by Henry F. Harner and Frances E. Harner, his wife, of the first part, hereinafter called the Grantors. WHEREAS, the Grantors were conveyed 93.611 Acres by deed dated June 27, 1997 recorded in the Clerk's Office of the Circuit Court of Frederick County, Virginia in Deed Book 883, at Page 713; and, WHEREAS, the Grantors executed a Deed of Dedication (of Kendall Heights - Section I and Section II) recorded in the aforesaid Clerk's Office in Deed Book 884, at Page 267 for the purpose of placing conditions and restrictions against said 93.611 Acres and placing a plat of record of Lots 1 through 7, containing 35.887 Acres; and, WHEREAS, said Deed of Dedication made reference to the remaining 57.725 Acres, to be platted at a later date as Kendall Heights - Section II, Lots 8 through 10, which lots could be subdivided into additional lots; and, WHEREAS, the Grantors desire to place of record a plat of said 57.725 Acres and to increase the number of lots from Kendall Heights - Section II, Lots 8 through 10 to Lots 8 through 12.
