Following up on our meeting:
1- This subdivision was approved by the Board of Supervisors on March 10, 1999 (subdivision file #04-99) The
approval was contingent upon providing access easements so that only two new entrances would be created
onto Shady Elm Road. The entrance for lots 3, 4, and 5 would align with the Dawson Investments, Inc. property,
PIN 75-A-1A, now owned by Synergy Investments.
2- Deviations from the existing lot configuration will require Board approval. Staff would suggest you seek MDP
approval as it will enable future administrative subdivision approval and flexibility to create lot configurations
reflective of client needs.
3- Ordinance does require that M1 properties be served by public road. A Board waiver of the public road
requirement would be necessary to develop the M1 site with a private road. Such a request would warrant
justification for the waiver.

a 5-acre lot that will house a satellite yard and a 40 x 60 equipment building that is a "lights out" facility. I have attached a

THIS DEED OF EASEMENT, made this Abt' day of
1999, by and between JASBO, INC., a Virginia
Corporation, party of the first part, hereinafter called the Grantor; and THE_CITY
OF WINCHESTER, VIRGINIA, party of the other part, hereinafter called the
Grantee.
WITNESSETH: That for and in consideration of the sum of One Dollar
($1,00), cash in hand paid and other valuable consideration, receipt whereof is
hereby acknowledged, the Grantor does grant and convey, unto the Grantee, a
permanent sanitary water and sewer easement 20 feet in width, together with a
temporary construction easement ten (10) feet in width adjacent thereto, the
permanent easement being as shown on that certain plat of -Charles E. Walls, Jr.,
Land Surveyor, dated August 2, 1999, attached hereto and incorporated herein in
full by this reference, said easements being over and upon the lands of the
Grantor acquired by deed recorded in the Office of the Clerk of the Circuit Court
of Frederick County, Virginia in Deed Book 917, at Page 1294, The permanent
sanitary water and sewer easement herein conveyed grants to the Grantee the
perpetual. right to install, lay and maintain a sanitary water and sewer main,
including the right to go on, over and upon the said permanent easement for the
purpose of installing, laying, maintaining, repairing and replacing the same as
needed, and the said temporary construction easement grants to the Grantee the
right to enter upon it to the extent necessary for and during the original
construction, installation and laying of the said sanitary water and sewer main,

sanitary water and sewer main.
Grantor shall retain the right to use its land which is subject to the
easements acquired herein in any manner which shall not interfere with the use

to cross over and upon the said easements and to use the surface over the
easements in such manner as will neither injure nor interfere with the
construction, operation or maintenance of the said sanitary water and sewer
main, except that no building or other structure shall be erected over said
permanent easement unless by mutual consent of the parties or their successors,
Whenever the enjoyment of its rights hereunder requires Grantee to disturb the
surface of the ground, it shall be the obligation of Grantee to restore the same to
its condition prior to being so disturbed at Grantee's expense.

Enclosed please find a Deed of Easement concerning the industrial
subdivision off of Shady Elm Drive. This is the same subdivision plat that has
previously been put on record, except with regard to this one the water and sewer
easements have been added.
The plat has been executed by everyone, with the exception of you, and
would ask that you review the same and if it meets with your approval, to please
sign it and return it to me for recordation.
I am unsure why the Frederick County Board of Supervisors line is on the
plat and don't believe, probably, that any signature is required with regard to the
Supervisors.

THIS DEED OF DEDICATION AND SUBDIVISION, made this
day of Mny_,Cj--) , 1999, by and between JASBO, INC., a
Virginia Corporation (hereafter "Jasbo"); the COUNTY OF
FREDERICK, VIRGINIA, (hereafter "Frederick County") and the
VIRGINIA DEPARTMENT OF TRANSPORTATION, party of the third part.
WHEREAS, Jasbo is the owner of 45.6727 acres of land
located on the West side of Virginia State Route 651 (Shady Elm
Road) and desires to subdivide the same into five (5) lots, all
as more particularly described by Plat and Survey of Charles E.
Walls, Jr., C.L.S., dated February 5, 1999, which plat is
attached hereto and made a part hereof; and,
WHEREAS, in consideration of the subdivision, Jasbo has
agreed to dedicate a strip of land to Frederick County, Virginia
to be used by the public for the future road widening of
Virginia State Route 651 and has further agreed that the five
(5) lots (Lots 1 through 5) shall be served by only two
entrances that are aligned with roadways on the East side of
Virginia State Route 651.
NOW THEREFORE, Jasbo, by its signature hereto, does:
1. Dedicate to Virginia Department of Transportation that
strip of land designated on said plat attached hereto as 111.6836
Acres To Be Dedicated To The Commonwealth of Virginia For Future
Road Widening" to be used for public use upon the widening of
Virginia State Route 651.
2. Establish a right of way for a shared entrance between
Lot 1 and Lot 2 which right of way is designated on said plat as
"Proposed 50' Ingress -Egress Easement".
3. Establish, or agree to establish, an entrance on Lot 3
Ito align with an entrance now existing on the Eastern side of

The Subdivision Ordinance requires that land divisions in the M1 (Light Industrial) Zoning District,
without an approved master development plan, be presented to the Board of Supervisors for final

approval (§ 144-12-B). The Master Development Plan (MDP) requirement may be waived, and has
been waived for this project, when a development proposal does not include provisions for proposed
roads and/or regional stormwater management facilities. This project contains land zoned M1, and
does not contain an approved MDP; therefore, Board review and action is necessary.
Staff Review
This 45-acre parcel is currently used for agricultural purposes. The adjoining properties consist of
agricultural and industrial uses. Shady Elm Road (State Route 651) and Soldiers Rest Lane provide
the southern and western property lines, respectively. Directly south, across Shady Elm Road, is
Industrial Lane and an industrial park.
The proposed land division would create five lots, each lot approximately eight acres in size with lot
frontage onto Shady Elm Road (Route 651). Based on the Winchester Area Transportation Study
(WATS), Shady Elm Road is slated to be improved to a four -lane divided roadway. Staff is
concerned that additional vehicular access points may result in unsafe conditions. Accordingly, staff
would recommend that access to these lots be restricted as follows:
1. Lots 1 and 2 - Utilize a shared entrance (singular point of access) that would be
aligned with Industrial Lane.
2. Lots 3, 4, and 5 - Utilize a shared entrance (singular point of access) that would be
aligned with the entrance into the Dawson Investments building parking lot. This
parking lot entrance is approximately 480-feet south of Industrial Lane.
The benefits of restricting entrances is two -fold. First, it minimizes the number of entrances on the
future divided roadway, possibly improving traffic safety. Secondly, it increases the possibility for
crossovers once the divided roadway is constructed. Absence ofthe crossovers would greatly restrict
access to the properties. The entrance concerns could be addressed by establishing access easements
on the final plats, in addition to language that addresses the approximate locations for entrances to
the property.
STAFF RECOMMENDATION FOR 03/03/99 PLANNING COMMISSION MEETING:
Staff recommends approval of this subdivision application contingent upon the applicant's satisfying
all review agency comments.

PLANNING COMMISSION SUMMARY AND ACTION OF 03/03/99:
Members of the Commission had questions on the proposed access to the properties. They felt that
aligning entrances with those entrances located across Shady Elm Road, as staff commented, should
be a condition of subdivision approval. The applicant agreed that easements would be established
allowing for limited access from Shady Elm Road, and the alignment of the entrances.
By majority vote, the Planning Commission recommended approval of the subdivision contingent on
the applicant's satisfying all review agency comments.
