REVIEW EVALUATIONS: Virginia Dept. of Highways and Transportation - No objection; subject to final review of drainage calculations City of Winchester - The Winchester Planning Commission has approved the road layout. Water and sewer service is available in accordance with the City's January 13, 1976, Sewer Extension Policy. The owner of any of the numbered parcels or the COUNTY OF FREDERICK# VIRGINIA may seek redress at law or in equity to enforce compliance with any of the foregoing covenants and stipulations, and all costs of any proceedings, including attorneys fees, shall be paid by the lot owner or owners held to have violated any one or more of the covenants and stipula- tions. 11. Bruce Edens, C.L.S., dated February 21, 1983, said real estate being subdivided into five (5) parcels, shown on said plat as Parcel 1, Parcel 2, Parcel 3, Parcel 4 and Parcel 5, and being the same real estate conveyed to OLD DOMINION SAVINGS AND LOAN ASSOCIATION by Deed of UCM Corp., a California corporation dated March 8, 1979, of record in the Office of the Clerk of the Circuit Court of Frederick County, Virginia in Deed Book 506, at Page 141. The party of the first Part and the party of the second part do hereby dedicate to the COUNTY OF FREDERICK, VIRGINIA all of the streets shown on the plat of said property. All parties, including corporations, who now own or shall hereafter acquire any right, title or interest in any land in said subdivision shall be taken as held to agree with the owners of the aforedescribed land and with their successors and assigns to conform to and observe the following covenants and stipulations to run with the land and to relate to the entire subdivision: 1. INTERSTATE PROPERTIES LIMITED PARTNERSHIP shall construct a retention basin, a thirty inch concrete pipe leading from a curb inlet across Parcel 4 to the retention basin and a spillway twenty feet in width as shown on the attached final plat, the purpose of such basin and spillway being to provide a collecting and runoff area for surface water from the roads and other areas within the INTERSTATE PROPERTIES SUBDIVISION. All the above facilities shall be constructed to the specifica- tions shown on the attached final plat and/or Virginia Department of Highways and Transportation specifications. 2. The cost of maintenance of the retention basin, the thirty inch concrete pipe and the twenty foot spillway, as shown on the attached final plat, shall be borne by the owners of each numbered parcel, pro rata, based upon the ratio of the IWM 11 area of each such numbered parcel to the total area of all of the numbered parcels. 3. INTERSTATE PROPERTIES LIMITED PARTNERSHIP shall also construct a surface water drainage system, comprising manholes, curb inlets and concrete pipes as shown on the attached final plat. The responsibility for and cost of maintenance of those portions of the system (with the exception of the portion referred to in Paragraph 2 above) not within the borders of roads accepted for maintenance by the Virginia Department of Highways and Transportation located in the subdivision shall be borne by the owner of the numbered parcel wherein such portion of the surface water drainage system is located. 4. The owners of the numbered parcels shall have the right of ingress and egress to and from Parcel 4 for the purpose of inspecting, repairing, maintaining and replacing the retention basin, the thirty inch concrete pipe and the twenty foot spillway referred to in Paragraph 2, above. They shall also have an easement or right of way comprising an area ten feet on either side of the centerline of said pipe, the area of the retention basin and an area of a uniform width of twenty feet around it as well as the area of the spillway and an area twenty feet on either side of it for the purpose of performing such functions. 5. The COUNTY OF FREDERICK, VIRGINIA is hereby granted a perpetual easement ten (10) feet on either side of the centerline of the pipes, manholes and curb inlets shown on the attached plat and is further granted a perpetual easement comprising the area of the retention basin and an additional area having a uniform width of twenty (20) feet around it as well as the area of the spillway and an area twenty (20) feet in width on either side of it, with a perpetual easement and the right to erect, construct, install and lay and thereafter use, inspect, repair, maintain, replace and remove the surface water drainage system or any part thereof, together with the right of ingress and egress over the real estate shown on said plat for the purposes of said easement. 6. In the event of failure on the part of the responsi- ble property owner or owners referred to in Paragraphs 2 and 3 hereinabove to properly maintain the surface water drainage system within ten (10) days of receipt of a written request by a duly designated agent of the COUNTY OF FREDERICK, VIRGINIA, the COUNTY OF FREDERICK, VIRGINIA shall have the right to perform such maintenance or cause such maintenance to be performed, and the responsible property owner or owners shall be liable to the COUNTY OF FREDERICK, VIRGINIA for the cost of such maintenance. Any determination by the duly authorized agent of the COUNTY OF FREDERICK, VIRGINIA as to what maintenance is necessary shall be final and binding on the responsible landowner or landowners. 7. The owners of the numbered parcels shall indemnify and hold harmless the Commonwealth of Virginia, the Commonwealth of Virginia Department of Highways and Transportation and the COUNTY OF FREDERICK, VIRGINIA from any and all claim or claims for taking and/or damaging pursuant to the provisions of Article I, Section 11 of the Revised Constitution of Virginia of property of any and all landowners who might be adversely affected by drainage which exits the boundaries of INTERSTATE PROPERTIES SUBDIVISION such indemnification to be made by the owners of each numbered parcel, pro rata, based upon the ratio -4- of the area of each numbered parcel to the total area of all of the numbered parcels. 8. The owners of the numbered parcels shall indemnify and hold harmless the Commonwealth of Virginia, the Virginia Department of Highways and Transportation and the COUNTY OF FREDERICK, VIRGINIA from -any and all costs or expenses incurred as a result of the denial, settlement and/or litigation of such claims for taking and/or damages from drainage from INTERSTATE PROPERTIES SUBDIVISION, such indemnification to be made by the owners of each numbered parcel, pro rata, based upon the ratio of the area of each such numbered parcel to the total area of all of the numbered parcels. 9. The owners of the numbered parcels shall reimburse the Virginia Department of Highways and Transportation and the COUNTY OF FREDERICK, VIRGINIA for repairs to roadways damaged as a result of lack of proper maintenance of the surface water drainage system, such indemnification to be made by the owners of each numbered parcel, pro rata, based upon the ratio of the area of each numbered parcel to the total area of all of the numbered parcels. 10. The owner of any of the numbered parcels or the COUNTY OF FREDERICK, VIRGINIA may seek redress at law or in equity to enforce compliance with any of the foregoing covenants and stipulations, and all costs of any proceedings, including attorney's fees, shall be paid by the lot owner or owners held to have violated any one or more of the covenants and stipula- tions. 11. Invalidation of any one of these covenants and stipulations by judgment or court order shall in no way invalidate any other covenants, stipulations and provisions -5- herein and such other covenants, stipulations and provisions herein shall remain in full force and effect. We concur with your proposal to use a storm sewer to the inlet end of the culvert under Rte. 81. However, we are concerned --about erosion in the berm and on the cut slopes of Rte. 81 due to the concentrated flow from the 18 inch pipe out of the detention basin. Another area of concern is the proposal to leave the basin and it's outlet pipe in place until some unknown time when the -basin will be filled in and developed. During this period of time, erosion would be anticipated where flow turns 900 into the berm ditch and also where the flow goes down the 10% grade in the berm ditch. Erosion will not be from large volumes of flow but from concentrated flow over a relatively long flow times due to the basin. In view of the aforementioned concerns, the Department has the following comments: 1. Erosion within the right of way is anticipated. 2. The streets within the development cannot be accepted into the Secondary System until an adequate outfall is provided. 3. We advised Mr. Kinter several weeks ago that due to design problems, the concrete paved ditch would not drain into the previously installed inlets. It was agreed at that time to change to curb and gutter, which would allow proper drainage. Work began on 9-17-83 with a face of curb street width of 26 feet. A meeting with Mr. William Bushman of the Edinburg Residency on September 20, 1983, revealed that the face of curb width must be increased to 30 feet to meet Virginia Depart- ment of Highways and Transportation standards. Also, pavement requirements were discussed but no decision was made regarding a proposal by Mr. Chuck Maddox for 7" of 21A, 3" of B-3, and 1-1/2" of S-5. Therefore, we are awaiting instructions before final grading can begin on those areas to be taken over by Virginia Department of Highways and Transportation. Following the meeting with Mr. Bushman, Mr. John Kinter and Mr. Dave Hight met on the site and considered the width require- ment by the Highway Department. It was agreed to proceed by widening the streets adjacent to Aikens property on the east and north sides. This presents no problems with drainage structures in place, but necessitates removal of 40 lineal feet of curb and gutter poured on 9-17-83. An attempt to move this curb and gutter laterally will be made. An additional 30' entrance will be installed for the Aikens property, per their request. This entrance was approved by Mr. Bushman and Mr. Horne at today's meeting. Additional costs for this entrance to be paid for by Aikens. 0 Interstate Properties September 21, 1983 c/o Gibson & Kinter Page 2 of 2 Mr. Kinter directed that the proposed street west and south of the Bigg's property only be graded and lightly surfaced with stone until further notice. All work on existing Virginia Department of Highways and Transportation RIW is to be completed - as planned. Also, the proposed DI-7 inlet in the northeast corner of the Travelodge parking area is to be changed to a DI-2 and drainage swales shaped to better flow to this point. This is necessary since site plans for Aikens property differ from those prepared earlier. The costs of above changes will be reflected in the contract by a Change Order utilizing the add/deduct schedule previously submitted. The peak in the curb at the deflection angle at the end of the entrance road off of Route 522 is acceptable to V.D.H. & T. because of the small deflection in the road. 2. A specially designed DI-1 inlet will be installed at the northeast corner of the existing intersection. 3. It was agreed that Interstate Properties would submit a sketch showing how the existing storm drainage system would handle the southbound runoff from the west half of the north -south road. Perry Engineering, however, has agreed to install an inlet similar to the one described in Item £2 above at this location. 4. The twenty-six foot roadway formed by the radius at the south side of the entrance road off of Route 522 and the west curb of the north -south road will be changed to thirty feet by removal of two sections of the existing curb and creation of a compound curve. 5. The added entrance to Lot No. 1 is to be built as staked; that is, sloping gently from the road to the parking area. We have learned from Chuck Maddox that your determination of required pavement depth, made since our Monday meeting, is as follows: a. That portion of the road from Route 522 to the west curb of the north -south road shall be 12" of stone', 3.5" of B-3 and 1.5" of I-2. b. The north -south portion of the road shall be 8" of stone, 3.5" of B-3 and 1.5" of I-2.
