A VDOT review has been completed on the final plat dated October 1, 2004 (received November 30,
2004) for the referenced project. The plat appears to reflect the information shown on the approved
project plans and is therefore approved by this letter.
The application for subdivision of this property appears to have a measurable impact on Route 11,
Martinsburg Pike, the VDOT facility which would provide access to the property. This section of street is
currently not in the State's Secondary Road System. All entrance design and drainage features must meet
State requirements if the street is to be eligible for acceptance. A complete set of construction plans will
be required for review.
We are returning five (5) signed copies of the plat to your office, one copy is being retained for our work
file. Please provide one copy of the plat of dedication fully signed and recorded at the appropriate
County Clerk's Office prior to the issuance of any land use permit from VDOT.

I have had the opportunity to review the Preliminary Subdivision Design Plan (SDP) for The Hiatt Village,
received by our office on July 27, 2004. Please address the following comments:
1. The Master Development Plan (MDP) for this site has not been approved.
2. The MDP for this site calls for single family small lot as the only housing type being used. The SDP
submitted has a mixture of single family small lot and duplexes. Duplexes may only be built on this
site with a revised MDP.
Before this department will review this application further, an application and required fees must be

I have had the opportunity to review the Final Plats for The Hiatt Village, received by our office on October
18, 2004. Please address the following comments:
1. Show the building restriction lines on each lot.
2. Lots 10 and 17 are shown on two different pages; please show the entire lot on at lease one sheet.
3. Provide a description for monuments and markers.
4. On Sheet 5 of 17, under area summary, provide the density of the project.
5. Label the location of the community center on the plats.
The application seeking approval is denied until the issues identified in this letter have been adequately
addressed. Please address the above comments and resubmit. Before the final plats are officially approved by
this office, the approval signatures of the Frederick County Sanitation Authority and the Virginia Department
of Transportation must be obtained. An appropriate guarantee will also be required prior to final plat approval.

1. On Sheet 1 of 29, under zoning notes, it states that accessory structures are allowed. In accordance
with § 165-65F (4) of the Frederick County Zoning Ordinance, detached accessory structures are not
allowed with single family small lot developments.
Once you have revised the plan to reflect this change, please provide us with a minimum of two full sets of
plans, signed by the owner and engineer, for approval and distribution. In addition to the two full sets of plans,
include any additional cover sheets as needed.

This is to acknowledge receipt of your revised plans dated September 20, 2004 for the referenced
project. The plans appear satisfactory and are approved. Please advise the developer
accordingly. Please provide six (6) sets of approved construction plans with signed seal for
VDOT distribution.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with the attendance of
the contractor, various County agencies and VDOT prior to initiation ofwork.
• Materials used and method of construction shall apply to current observed VDOT Road &
Bridge Specifications applicable during construction of this development.
• Our review and comments are general in nature. Should conditions in the field exist such
that additional measures are warranted, such measures shall be completed to the satisfaction
of the Department prior to inclusion into the Secondary Road System.
• Attached is a copy of the minimum requirements and information needed prior to acceptance
of subdivision streets into the Secondary System. This is the responsibility of the developer.
• All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to
a pipe or drainage easement.

this proposed project should be provided for VDOT review prior to issuance of any land use

I have had the opportunity to review the Subdivision Design Plan (SDP) for The Hiatt Village, received by our
office on September 30, 2004. Please address the following comments:
1. A subdivision application and fee must be submitted for this project. The fee for this subdivision is
$6300.
2. Provide the square footage on each lot.
3. A six foot high hedge, fence, wall, berm or mound is required as part of the full 25' residential
separation buffer.
4. For the single family small lot landscaping, all trees must be planted at two inch caliper, not four feet
in height.
5. For the perimeter residential separation buffer landscaping, Bottlebrush Buckeye is not on the
approved list.
6. Provide a statement on the landscape plan to the effect that all plantings shall conform with § 165-36C
of the Frederick County Zoning Ordinance.
7. Label roads as being public and private.
8. Merge the BRL of Lot 9 with the riparian buffer.
9. Provide the required parking lot landscaping for the community center parking lot.
10. Change the side BRL of Lot 10 to 15' to ensure that there will be a 20' separation between buildings.
The application seeking approval is denied until the issues identified in this letter have been adequately
