I have this application all prepared to go to the Planning Commission on February 19, 1992. I need the application fee of $320.00 prior to that time if you can make that arrangement. I do not anticipate any problem with the approval of this request and do not feel it necessary that you personally attend the Commission meeting although we would welcome your presence. I'm sure Bruce Edens or one of his people could adequately represent the application. Following the Planning Commission action I will provide the completed plats to Charlie McCandlish for preparation of the deed of dedication and then recording of the plats unless you instruct otherwise. The Grantor does further grant to the County for the same purposes (1) a thirty foot (301) drainage easement; (2) a ten foot (101) temporary slope easement; and (3) twenty foot (201) drainage and forty foot (401) sewer and drainage easements, all as set forth in detail on that certain plat of H. Bruce Edens, L.S., dated January 13, 1992, revised April 1, 1992, and sealed April 2, 1992, which is attached hereto as Exhibit B and incorporated by reference herein. The Grantor dedicates these easements intending to seek abandonment of the existing drainage easements as depicted on said plat. The Grantor does further grant to the County for the same purposes a thirty foot (301) drainage easement and a seventy foot (701) drainage easement, all as set forth in detail on that SNARR, McCANDLISH &ROCKWOOD certain plat of H. Bruce Edens, L.S., dated March 27, 1992, and ATTORNEYS AT LAW WINCHESTER. VIRGINIA sealed April 2, 1992, which is attached hereto as Exhibit C and / I incorporated by reference herein, which easements shall not be exclusive but shall be used in common with the Grantor and others. The Grantor does further grant to Kraft General Foods, Inc., a Delaware corporation, its successors and assigns, a thirty foot (301) drainage easement and a seventy foot (701) drainage easement, all as set forth in detail on that same Exhibit C hereto, which easement shall serve that certain parcel of land acquired by Kraft General Foods, Inc., by deed dated the 30th day of April, 1991, of record in Deed Book 759 at page 1062. The easements herein granted shall not be exclusive but shall be used in common with the Grantor and others. The foregoing dedication is made with the free consent and in accordance with the desires of the Grantor, and is in conformity with such provisions of the Virginia Land Subdivision Act as are applicable, together with the applicable ordinances and regulations of the governing body of the County of Frederick, Virginia. This dedication is made subject to certain existing easements, which are reflected on the attached plats.
