The platted land lies a short distance East of Winchester in Shawnee Magisterial j j District of Frederick County, Virginia, just North of Senseny i Road (Route 657) and is a portion of the property conveyed to Homeland Development Corporation by Haven M. Wolfe, widower, by deeds dated June 21, 1971 and recorded in the Office of the Clerk! of the Circuit Court of Frederick County, Virginia, in Deed Book 389, at Pages 441, 444 and 447 and is a portion of the property I conveyed to James L. Longerbeam, et ux, by Haven M. Wolfe, widowe#, by deed dated June 21, 1971 and recorded in the aforesaid Clerk's! G3/ RECEIVED AIM o 5 1975 August 4, 1975 Mr. Richard Mason 644 Williamson Road Winchester, Virginia Re: Section I -A, Heritage Hills Dear Mr. Mason: The City of Winchester is required to approve all su5division plats in Frederick County within a three mile radius of the City, which would include the Heritage Hills Subdivision. Mr. Ron Berg provided us copies of a preliminary and final plot of Section 1-A, which was reviewed at our July Staff meeting. it was determined at that time that there was not sufficient information available to submit the plat to Plannin3 Oommission for their approval. Before this plat could be considered by the planning Commission, an preliminary plat showing topography, plans and profiles for water and sewer lines and drainage areas, and typical sections and profiles for the street would be needed. It was noted - in our Staff meeting that lots 099, #100, and #101 would be virtually useless because of the location of the twenty foot sewer easement. It was also noted that the prel- iminary plat dated June 3, 1974 and revised January 21, 1975 shows locations for water and sewer lines that differ from ::one casements shown on your final plat. Final approval of this plat by City Council could not take place until the Board of SupervLsiors has given approval for the extension of City water and sewer lines in this area. Many of the houses are financed by Farmers Home Ad- ministration (FmHA), and their owners are complaining of State Building Code violations and numerous other in- conveniences caused by what they call "poor workmanship." The group plans to attend the Frederick County Board of Supervisors meeting tonight to make its complaints to that body. Among the homeowners' prime con- cerns tonight will be the manner in which building inspections are performed in the county. Many of the homeowners said their houses, occupied for two years or more, have never received a final in- spectior, or certificate of occupancy, which is required by law before an owner can move into a house. The homeowners are complaining of building code violations along with poor work by the developer of Heritage Hills, L- D-E Corp. TONIGHT will not be the first time the supervisors have heard of complaints from Heritage Hills homeowners. Wade Ferguson appeared before the board on two separate occasions in the latter part of 1976 to complain that his house had never received a final building inspection and code violations exist. In its Dec. 10, 1976 edition The Star published a story about Wade and Barbara Ferguson and their house. The problems were there and reported in the story, Frederick County Building Inspector ,William Rodgers was asked about the tFergusons' situation and said he believed all the required inspections had been performed on the house, although he couldn't prove it. He added that he was aware of the problems with the house saying that he was working to get them all corrected so the house could pass final inspection. Rodgers said he couldn't prove the previous inspection had been performed because the records in his office were incomplete at that time. Blair Webber was the building inspector at that time and since his resignation, several accusations have been made to the effect that he was lax in enforcing the building code. AFTER Ferguson talked to The Star, Shawnee Supervisor Thomas Malcolm, County Administrator J. 0. Renalds and Rodgers went to Ferguson's house to see the problems. Rodgers pointed out some things that had to be corrected and some were. On March 18, Rodgers' assistant, Carroll Brown, gave the house a final building inspection and a certificate of occupancy was issued. Ferguson contends today, that Brown's look at the house was not thorough and there are still major problems with his home. Malcolm confirmed this morning that he did go to Ferguson's and that there were some problems and Rodgers later worked with builder Richard Mason of L-D-E Corp. to get the problems fixed. MALCOLM said he's heard of other homeowners in Heritage Hills with similar problems. He said he didn't know how many of these complaints were code violations but added that "I do know that many people there have serious and legitimate complaints." But he continued that he doesn't know where all the responsibility lies for these problems, adding that "the whole thing could turn into a can of worms." He said he didn't know if the county could be held legally responsible if building inspections were not performed by the former building inspector or if the homeowners were in violation of the law for moving in without a certificate of oc- cupancy. Attending were A. W. Loring, M. L. Dailey, R. E. Snow and Steve Hamman, all of the Shenandoah Gas Company; Richard Mason and H. B. Edens of Vista Enterprises; and H. Brathwaite of Buckley Lages, Inc. It was agreed the R/W between Sta. 12+75 and Sta. 23+00+ could be used for a street with the following stipulations: The centerline of the proposed street would be relocated 28 feet east of the existing gas pipeline; that no cuts would be made over the gas pipeline; that no fills would be over 7 feet; that the paved surface of the street would be 22 feet wide with a 5 foot shoulder and that all cuts and fills would be on a 2:1 slope from the edge of the shoulder and that neither cuts or fills would be made that would affect the gas pipeline in its existing location; that the erection of any building, etc., would not be done within 25 feet of the existing gas pipeline on Lots 58 or 59 as shown on a plat of said subdivision. "folded their tent and stole away into the night." Attorneys for the lender:_, were successful in getting them to appoint myself and Mr. Mason officers to try and wind up the affairs of Vista without hurting the lenders and various supplier of Vista. I am happy to say things have worked even better than I had aniticipated but it has been one uphill battle after another. When the developers left Winchester, they were putting overhead wiring on the first street. I went to the lenders and told them I thought it would be better to use underground wiring in the remainder of that street, and out of their pocket this was accomplished. Since February 10, 1975, Mr. Mason and I have so1c: the majority of il all lots. I have talked with most every hone owner and find them gen- erally happy with one exception. I talked with the real estate agent that sold that house and was tcL1 that tho ;:purchaser was advised of the changes going on within the subdivision and thereupon a substantial discount was allowed the purchaser. The road which is of primary concern to us at this point is Village Road as shown on the plat of Heritage Hills. There is a high pressure gas line some five (5) feet on the. right-of-way of this particular road. The gas company does have a fifty (50) foot right-of-wayjpr this particu- lar line which overlaps the road right-of-way and it is their perference to have between three (3) and five (5) feet of cover on this particular line. It is my understanding from discussions with the gas company that your contractor may possibly place as much as eight (8) to ten (10) feet of cover over this line during construction and also may possibly dig very close to this line which presents a safety problem. I have viewed the site and I realize the line is staked in the field and that the gas company has been in touch with your contractor. I would like to remind you that the right-of-way, as shown on the plat of Heritage Hills, Section I, is the property of Frederick County as a result of the plat having been recorded.(See Section 15.1-478, Code of Virginia, 1950 as amended). Should you not make adequate coordination with the gas company to protect the existing high pressure gas line and.their right to utilize their fifty (50) foot easement and to maintain their gas line without undue interference with others, it would be necessary -�r the County to consider stopping construction in the vicinity of the gas line until appropriate coordination and provisions for safety are undertaken inasmuch as the County will not permit practices on rights -of -way which might present a safety hazard. z 703 — 667-2365 Mr. Richard Mason Page (2) June 23, 1975 I would suggest that you be in contact with the Shenandoah Gas Company - at the very earliest time in regard to this matter in order that this' situation might be clarified and a future problem averted. Where will the sewer line for "Heritage Hills" tie into the city system? Will this increased load increase the existing problem where manholes in Winchester Golf Course, Rolling Fields and Country Club Terrace overflow during heavy rains, allowing sewage to flow directly into Abrams Creek?
