THIS. DEED AND DEED OF PARTIAL RELEASE, made and dated
this 28th day of August, 1979, by and between SENECA HOMES COMPAN
a Virginia Partnership, party of the first part, hereinafter
called the Grantor, and D. EDWARD SULLIVAN and BONNIE SULLIVAN,
his wife, parties of the second part, hereinafter called the
Grantees, and BENJAMIN M. BUTLER, Trustee, party of the third
part, and OLD DOMINION SAVINGS AND LOAN ASSOCIATION, party of the
fourth part, and JAMES H. ROSS and ELAINE S. ROSS, his wife,
parties of the fifth part.
WITNESSETH: That for and in consideration of the sum of
Ten ($10.00) Dollars, cash in hand paid, and other good and valu-
able consideration, the receipt of which is hereby acknowledged,
the Grantor does hereby grant and convey with general warranty of
title unto the Grantees, in fee'simple, as tenants by the entiret
with common law right of survivorship, all of that certain lot or
parcel of land, together with the improvements thereon and the
appurtenances thereunto belonging, lying and being situate in

Shawnee Magisterial District, Frederick County, Virginia, containing
5,443.41 Square Feet, being triangular in shape and lying and
being situate along the Northern boundary of the original Lot 76,
Greenwood Heights Subdivision, No. 4, which parcel of land is
shown by the survey drawn by Lee A. Ebert, C. L. S., dated July
24, 1979, attached hereto and by this reference made a part hereof
as if set out in full, and being a portion of the same land
(Lot 74 Greenwood Heights Subdivision, No. 4) conveyed to the
Grantor herein by deed dated April 19, 1979, from Elizabeth H.
Settle, single, et al, of record in the Clerk's Office of the
Circuit Court of Frederick County, Virginia, in Deed Book 508, at
Page 42. Reference is made to the aforesaid survey and deed for it
more particular description of the property herein conveyed.
The parties of the second part do hereby join in the
execution of this deed for the purpose of agreeing that the
triangular tract of land herein conveyed shall be joined with
their other land and shall be known as Lot 76-A, Greenwood Height
Subdivision, No. 4, and said triangular lot of land shall not be
conveyed out separately, except as the lot known as 76-A, Green-
wood Heights Subdivision, No. 4.
This conveyance is made subject to all easements, rights
of way and restrictions of record affecting the subject property.
The property hereby secured is subject to a deed of trus
dated May 9, 1979, of record in the aforesaid Clerk's Office in
Deed Book 508, at Page 49, to secure Old Dominion Savings and Loa.
Association a certain obligation therein; the property is further
subject to a deed of trust dated May 9, 1979, of record in the
aforesaid Clerk's Office in Deed Book 508, at Page 52, to secure
James H. Ross and Elaine S. Ross, his wife, a certain indebtednes
described therein; wherein all deeds of trust Benjamin M. Butler
is one of the designated Trustees, and either one or all may act
for any purposes, including release purposes. The party of the
third part, as Trustee under the aforesaid deeds of trust and at
the direction of the party of the fourth part and the parties of
the fifth part, and the party of the fourth part and the parties
of the fifth part, as secured parties and present noteholders, do
together join in this deed and deed of release, hereby releasing
the parcel herein conveyed from said deeds of trust, but reservin
the lien of said trusts against any parcel not released hereby or
previously released.
The Grantor does hereby covenant that it has the right t
convey to the Grantees; that the Grantees shall have quiet and
peaceable possession of the said property, free from all liens an
encumbrances; and it will grant such further assurances of title
as may be requisite.

currently exists in Greenwood Heights and along Malloy Drive
in particular.
Following a preliminary drainage evaluation conducted by Frederick
County consulting engineers, Donohue Inc., it was determined that
the existing culverts on Malloy Drive are improperly sized. A copy
of their report is attached.
It is our understanding that these culverts are part of the
state maintained secondary road system and we request that these
culverts be replaced with culverts of proper size.

Dear Wayne:
Pursuant to your request, we were able to dig up enough reference mapping to
perform a preliminary drainage evaluation of ditch/channel along Malloy Drive.
Complaints have been received from residents along Malloy Drive indicating
problems with flooding of the channel section. Over the past year or so it
was noted that the flooding problems have worsened. Our preliminary
evaluation was to uncover possible reasons why complaints are being made.
After a site visit it was observed that driveway crossings over the channel
have been made using a variety of culvert sizes which do not appear to have
any consistency or logic. This has obviously occurred on a random basis
following the development sequence of lots. Although this does not appear to
be the sole reason for the reported flooding, it plays a major role. It
appears that most of the culverts were undersized for the original conditions
(assuming a 10-year design storm). It is acknowledged that when some of these
houses were built, a 2-year design storm was often used for culvert sizing,
which would make the culverts undersized for today's standards.
Runoff will also have increased as a result of the upstream development. Our
preliminary evaluation shows an increase of 30 to 80 percent depending on
where along the channel the calculations are made. The closer to Greenwood
Avenue, the percentage decreases. The attached Drainage Summary Table and the
Drainage Area Map show the various segments looked at.
Stormwater management was provided with the development of Greenwood Heights,
Section 5; however, the stormwater pond was placed in an area draining to the
south. Therefore, the portion of the project draining to Malloy Drive was not
detained. As a result, there is an increase in the runoff to that particular
channel. Although we did not review this plan, it is my assumption that the
channel receiving the flow was determined to be adequate at the point where
the project discharges to it.
In any case, the culverts and channel should have been designed for "ultimate"
design conditions which apparently they were not.

Based on our calculations, the appropriate culvert sizes would be:
at discharge Ql = 27-inch diameter
Q2 = 42-inch diameter
" Qg = 42-inch diameter
These are assuming corrugated metal pipe with an allowable headwater of less
than one -foot above the top of the pipe. It also assumes a design storm of 10
years.
The storm of October 12 was far greater than a 10-year design storm. It is
clear that a storm of that intensity would produce the complaints that came
thereafter even if all the culverts were sized consistently and adequately.
With the culverts being inconsistently sized and, in most cases, too small,
the impacts of the storm were more pronounced.
Please let me know if you want us to look more closely at this particular
problem.
