On January 5, 1993 we conducted a one year follow-up inspection on Condor Court in the
referenced project. Overall the right-of-way has held up well. However, we noticed the
concrete entrance apron to Lot No. 4 is cracked. This damaged entrance gutter will need to be
removed and replaced prior to your surety bond (Letter of Credit No. 03084) expiration date of
March 1, 1993.

This is to follow-up on our telephone conversation of November 30, 1992
concerning the referenced development. We have rechecked the streets and found
all previous punch list items have been addressed. Therefore, the streets may
now be considered eligible for addition into the State's Secondary Road System
if so requested by the Frederick County Board of Supervisors through resolution.
I would like to remind you the rights -of -way will have to be maintained by you
until time of acceptance. Also, as we have discussed on several occasions there
are several areas of pavement deterioration/settlement throughout the
development. Instead of repairing it at this time we will allow you to wait to
correct this, if it does not worsen significantly, and any additional
discrepancies toward the end of the one year guarantee period.

I have enclosed for your use a copy of information needed prior to the acceptance
of subdivision streets into the State's Secondary System. You should also be
aware we have yet to receive the additional plans and typical section of the
Shenandoah Gas Company crossings which were requested in our letter to your of
September 14, 1992. All other quitclaim permits are acceptable.
It appears a practical target date for the addition will be March 1, 1993. In
this case, a maintenance fee in the amount of $1,650.00 will be required. This
fee should be in check form made payable to the Virginia Department of
Transportation. Also, a surety bond to cover workmanship and performance of
materials in the amount of $49,500.00 for a period of one year will be required.
I have also enclosed for your use an example of an irrevocable letter of credit
and insurance bond form.

On Monday, September 28th you advised me of the urgent time frame in connection
with the Greenbriar streets being accepted by January 1, 1993. You advised
that Frederick County must give you notice of the streets to be accepted
into VDOT's system in the next few days if we are to meet the critical
winter deadline of January 1, 1993. Upon that notification you said that
you would complete the legal descriptions and return them to Frederick
County for their resolution preparation.
During a meeting on August 27th between Frederick County officials and
the developers of Greenbriar the indication was given by the County that
all Greenbriar streets would be recommended for VDOT acceptance with the
exception of the cul-de-sac end of Killdeer Road. We hope this is still
the County's intention and that you will be so notified in the next couple
days.
Our contractor spent a week and a half in Greenbriar working your punch
list and you have indicated approval of that work. If we can now complete
the paperwork and administrative function of this process just maybe we
can beat the winter snowstorms for the residents of Greenbriar.
If I can do anything else to speed this process along, please advise.

RE: Staff Meeting of August 27 on Warrior Drive
A staff meeting to discuss Warrior Drive was held on
August 27 to discuss Warrior Drive. Present at the meeting
were John Riley, Ed Strawsynder, Bob Watkins, Kris Tierney,
Wayne Miller, Jim Doran, Bob Sager, Jim Golladay and Roger
Thomas.
The staff met with Jim Bowman, Jim Petry, and Bill
Tisinger to discuss the relocation of Warrior Drive. The
county is requesting from Bowman a land exchange to replace
land taken from Sherando Park on which Warrior Drive would be
constructed. The amount of land requested is approximately 4
acres. The acreage donated would be deducted from required
open space in a future residential development.
While having this discussion, Mr. Bowman raised the
status of Greenbrier subdivision with the writer. He question-
ed why the county was holding acceptance into the Virginia
Department of Transportation Secondary Road System of all
subdivision streets in Greenbrier due to drainage or storm -
water problems that they did not create. He was advised that
no engineer that represents the county's interest ever approved
same, and that the system was not working when it rained. Mr.
Bowman further advised that if the county would not release
the streets in Greenbrier, he would not provide the land
exchange for Warrior Drive.
The writer responded that that was fine. Warrior Drive
and Westmoreland Drive would be cul-de-saced and the county
would solve the drainage problems in Greenbrier.
An alternate plan was offered by Mr. Tisinger in which
certain streets would be taken into the system in Greenbrier,

both parties would continue to work on the drainage problems
in Greenbrier, and Bowman would donate the land for the land
exchange in the park. All parties involved felt this was a
satisfactory solution to the problem.

This is to follow-up our meeting last week to review the referenced development's streets. As
I said, the rights -of -way have held up pretty well. However the following list of items will need
to be completed before the streets can be considered eligible for addition:
1. Several low shoulders were noticed, especially around intersections
and mailboxes. These will need to be repaired with topsoil and
seed/mulch, or filled with 21-A Stone.
2. All street and private entrance pipe will need to be flushed of
sediment, obstructions (sodd) removed to obtain drainage, and
their bent ends straightened.
3. All graffiti is to be removed from the street surfaces.
4. Positive drainage needs to be obtained in the front of Lots #145 &
146 on Tanager Drive.
Also, as we discussed there were several areas of minor pavement settlement. This settlement
will not need to be repaired if it does not worsen; prior to addition, however, this existing and
any additional will need to be patched out by the developer after the ten month follow-up
inspection and prior to his bond expiration.

Dear Mr. Tisinger:
In response to your questions contained in your letter of
November 20, 1991, I offer the following replies:
1. Were your plans approved by the County prior to
construction?
Approval was granted by the County for the subject section
of the Greenbriar Subdivision based on the fact that the
design conformed to the governing ordinance and was
prepared by either a professional engineer or class III-B
surveyor. The adequacy of any stormwater design was the
total responsibility of the designer. The County did not
have the technical capability to review stormwater designs
at the time of this subdivision approval.
2. Were your plans approved by the State Highway Department
prior to construction?
I have contacted Bob Childress, Virginia Department of
Transportation, regarding this issue. His review of their
records revealed that construction of Section II commenced
well in advance of final plan approval.
3. Did the State Highway Department give its approval for the
"as-builts" concerning your drainage easements?
I have contacted Bob Childress, Virginia Department of
Transportation, regarding this issue. He indicated that
the Virginia Department of Transportation has not granted
final approval for the "as-builts" related to drainage
easements in Section II or III. He summarized his review
comments regarding this issue in a letter addressed to Jim
Petry dated January 22, 1990.

4. Doesn't Donohue's drainage requirements require a design
that the State Highway Department does not?
The Donohue drainage analysis was specifically designed to
eliminate the flooding of numerous residential structures
which are currently being inundated during major storm
events (ten (10) to 100 year). A prudent design should
have addressed this issue regardless of the requirements of
the Virginia Department of Transportation. In fact, at the
time this subdivision was designed, the standards of
practice dictated that the design evaluate the impact of
the 100 year flood to avoid the problems that have occurred
in the Greenbriar Subdivision, Section II. The Donohue
study was just following prudent standards of practice.
This design approach should not be confused with the
drainage requirements specified by the Virginia Department
of Transportation.
If the original stormwater management plan had been
correctly designed, it would not have been necessary for
Frederick County to fund the Donohue study.
I trust that my replies will allow you to reach a decision. I
am available to discuss these issues in greater detail if deemed
necessary.

Through Mr. Billy J. Tisinger we are in receipt of a copy of a letter you
wrote him dated November 19, 1991 regarding the referenced development. I am
concerned about a paragraph on Page 2 where you state I indicated VDOT would
accept responsibility for correcting inadequate piping along Tanager Drive.
During a phone conversation concerning this matter a couple of weeks ago I did
indicated we would accept Tanager Drive into the State's Secondary- Road System
with the current private entrance conditions at Lots 150, 151 and 152.
However, I in no way meant to indicate we would be correcting the situation.
I apologize if you misinterpreted our conversation and I hope it does not
cause any problems with your negotiations with the developers. If you would
want to discuss this or any other matter, please give me a call.

The above estimate includes costs related to repaving road
crossings and re -seeding disturbed areas.
I have discussed the inadequate piping along the houses fronting
Tanager Drive with Bob Childress, Virginia Department of
Transportation. He indicated that the Virginia Department of
Transportation will accept responsibility for correcting that
problem.
As I indicated in our meeting, Dave Holliday has indicated that
he will accept responsibility for correcting .the damaged 48" CMP
running under Nightingale Drive. I will coordinate this repair with
him.
Please review our estimate and let me know if the Bowman and
Glaize Development Company is willing to contribute $127,379.00 to
.the remedial drainage improvements in the Greenbriar Subdivision.
Frederick County will assume the responsibility for coordinating
these improvements.

be subject to the following restrictions, which are covenants
real running with the land and shall be binding on all
subsequent owners of said lots and each deed, by recitation or

1. All lots shall be used for single family residential
purposes only. No detached garage nor carport shall be
permitted on any lot. Any utility or other out building on any
lot shall be of the same material and construction as the main
structure on such lot.
2. No signs or advertising of any nature shall be erected
or maintained on any lot except for sale or rental signs for
said lot which signs shall not exceed five (5) square feet in
area.
3. No boats, mobile homes, motor homes, campers,
commercial buses, trailers of any type, tractors, trucks or
other motor vehicles (other than automobiles, motorcycles,
pickup trucks, and 3/4 ton (or less) vans) shall be permitted on
any lot except during the course of construction. No motor
vehicle or material portion thereof, which does not have a
current license and current Virginia inspection sticker shall be
permitted on any lot.
4. No animals of any kind (including livestock, poultry or
birds) shall be permitted on any lot, except that dogs, cats and
other usual household pets may be kept, provided they are not
kept, bred or maintained for commercial or charitable purposes
or in unusual numbers.
5. No fence or hedge shall be constructed or planted in
the front nor along the side (not applicable to corner lots) of
any residence nor within twenty-five (25) feet of any street.
Rear fencing and hedges shall not exceed six (6) feet in height.
All fencing shall be of wood or vinyl covered chain link
construction..
6. No noxious or offensive activities shall be carried on
upon any lot nor shall anything be done thereon which may be, or
may become, an annoyance or nuisance to the neighborhood.

7. In the event that a dwelling is destroyed, the owner of
the dwelling, within thirty (30) days from said destruction,
shall clear away the remaining portion of the dwelling unit and
maintain the lot in a neat and orderly condition.
8. In the event a dwelling unit is damaged, or has
materially deteriorated, the owner of the unit shall immediately
repair the damage or deterioration.
9. No lot shall be used or maintained as a dumping ground
for rubbish. Trash, garbage or other waste shall be in sanitary
containers. No refuse or any container for same shall be placed
or stored in front of any house, except on the date of garbage
pickup.
10. No exterior clothes line, or hanging device, shall be
permitted on any lot, except for an umbrella type with a
diameter not to exceed seven (7) feet, provided, however, that
the same may only be used in the rear of any building
construction of said lot and the clothes line is stored within a
utility building or the equivalent when the clothes line is not
in use.
11. The color of the paint on the exterior of every
building on each lot shall be the same as the original color
unless the new color is a color used in the historic portion of
Williamsburg, Virginia.
12. Every owner shall provide his lot with off-street
parking space of at least 450 square feet, which may include all
area in any,driveway located on the lot itself, to be used by
the inhabitants of the dwelling house located on said lot.
Parking on the street shall be prohibited and it is the intent
of this restriction that parking space for at least two vehicles
be provided.

13. A ten foot (101) easement is reserved along the rear
property line of each lot for the purpose of installing any
utilities including, but not limited to, electrical lines,
telephone lines, water and sewer lines and television cable
lines.
14. There shall be no planting, structure, fences,
shrubbery, or other obstruction to obstruct vision planted or
maintained on any corner lot which rises more than three feet
(31) above ground level within twenty-five feet (251) of the
intersection of any street lines, and no building of any type
within the fifty (50) foot Road Efficiency Buffer as the same
relates to Lots 1, 5, 6, 7 and 8.
15. All split foyer dwelling houses shall have 850 square
feet of living space on each floor, excluding carports, garages
and basements, and rancher style dwelling houses shall have
1,000 square feet of living space on each floor.
16. All dwelling houses constructed, if said dwelling house
has a chimney, and the chimney is flued on the outside of the
dwelling house, then all such flues shall be entirely faced with

19. The Grantor reserves the right alone to impose
additional restrictive covenants and restrictions as to any.lot
or lots owned by them at the time of the imposition and such
imposition shall not affect the binding effect of these
provisions upon any other lots.
20. The invalidation of any one of the covenants or

please find our recommendations on the attached plans marked in red and as
follows:
1. Concrete flumes with erosion control stone are to be constructed where the
curb and gutter ends on Route 647 to discharge water into the roadside
ditches. The existing ditch lines are to be regarded as necessary to
provide for positive drainage.
2. The entrance tapers are to be standard 3:1 or 30' in length as noted.
3. The typical road section is to be revised to show 8" of aggregate base
stone.
4. The existing field entrance onto the property is to be removed and a
Standard PE-1 is to be installed to serve Lots #7 & #8. A Standard PE-1
will also be required to serve Lot #6. 15"x30' C.M.P. culverts will be
required at both entrances as noted.
5. The proposed plantings are to be of a minimum spread variety so maximum
sight distances at the entrances can be maintained at all times.
6. Additional detail on the proposed MH-1 on the Route 1074 right-of-way will
be required as noted.
Please revise and resubmit four (4) copies for final approval. Should any
changes be deemed necessary, please design them to meet or exceed the above
recommendations.

said lot which signs shall not exceed five (5) square feet in
area.
3. No boats, mobile homes, motor homes, campers,
commercial buses, trailers of any type, tractors, trucks or
other motor vehicles (other than automobiles, motorcycles,
pickup trucks, and 3/4 ton (or less) vans) shall be permitted on
any lot except during the course of construction. No motor
vehicle or material portion thereof, which does not have a
current license and current Virginia inspection sticker shall be

7. In the event that a dwelling is destroyed, the owner of
the dwelling, within thirty (30) days from said destruction,
shall clear away the remaining portion of the dwelling unit and
maintain the lot in a neat and orderly condition.
8. In the event a dwelling unit is damaged, or has
materially deteriorated, the owner of the unit shall immediately
repair the damage or deterioration.
9. No lot shall be used or maintained as a dumping ground
for rubbish. Trash, garbage or other waste shall be in sanitary
containers. No refuse or any container for same shall be placed
or stored in front of any house, except on the date of garbage
pickup.
10. No exterior clothes line, or hanging device, shall be
permitted on any lot, except for an umbrella type with a
diameter not to exceed seven (7) feet, provided, however, that
the same may only be used in the rear of any building
construction of said lot and the clothes line is stored within a
utility building or the equivalent when the clothes line is not
in use.
11. The color of the paint on the exterior of every
building on each lot shall be the same as the original color
unless the new color is a color used in the historic portion of
Williamsburg, Virginia.
12. Every owner shall provide his lot with off-street
parking space of at least 450 square feet, which may include all
area in any driveway located on the lot itself, to be used by
the inhabitants of the dwelling house located on said lot.
Parking on the street shall be prohibited and it is the intent
of this restriction that parking space for at least two vehicles

13. A ten foot (101) easement is reserved along the rear
property line of each lot for the purpose of installing any

shrubbery, or other obstruction to obstruct vision planted or
maintained on any corner lot which rises more than three feet
(31) above ground level within twenty-five feet (251) of the
intersection of any street lines, and no building of any type
within the fifty (50) foot Road Efficiency Buffer as the same
relates to Lots 1, 5, 6, 7 and 8.
15. All split foyer dwelling houses shall have 850 square
feet of living space on each floor, excluding carports, garages
band basements, and rancher style dwelling houses shall have
11,000 square feet of living space on each floor.

Originally, I stated that the site plan was in compliance

omitted since Chapter 10 requires a hydrant within 400' of a

This is to acknowledge receipt of your revised plans dated July 16, 1990 to
the above referenced location. The plans appear satisfactory and are
approved. Please advise the developer accordingly.
I offer the following comments:
• A preconstruction conference be held by the engineer and/or developer with
the attendance of the contractor, various County agencies and VDOT shall be
conducted prior to initiation of work.
Materials used and .method of construction shall apply to current observed
VDOT Road and Bridge Specifications applicable during construction of this
development.
Our review. and comments are general in nature. Should conditions in the
field exist such that additional measures are warranted, such measures shall
be completed to the satisfaction of the Department prior to inclusion into
the Secondary Road System.
Attached is a copy of the minimum requirements and information needed prior
to acceptance of subdivision streets into the Secondary System. This is the
responsibility of the developer.
• All drainage is to be carried within the right-of-way in ditch lines or
gutters along the street to a pipe or drainage easement.
The contractor shall notify VDOT when work is to begin or cease for any
undetermined length of time. VDOT will also require (forty-eight) 48 hours
notice for inspections.
The appropriate land use permits shall be obtained before any work is
performed on the State's right-of-way. The proposed private entrances
serving Lots 6, 7, and 8 are to be installed as pant-ef '34

Private entrances will be installed in accordance with our current PE-1 and
CG-9D specifications. This is the developer's responsibility.
Any signs to be installed will be in accordance with attachments.
I suggest any utilities placed within the proposed right-of-way be
backfilled completely with C.R. Type 21-A Stone. This will greatly reduce
the possibility of any pavement settlement.

Project Description
This project involved is being developed by TIBOW. The type of
construction is 8 Single Family dwelling lots. The project will also involve
installation of sewer, water and utilities. The total developed area is 2.92 acres.
Existing Site Conditions
Prior to construction, the site was characterized by rolling terrain,
predominately open with some undergrowth, all typical of undeveloped areas in
the Upper Shenandoah Valley. The site is in the Wiekert-Berks-Blairton Soil
Association. This area is characterized by gently sloping, moderately deep,
somewhat poorly draining soils that have medium to fine textured subsoil; formed
in material weathered from shale.
Adjacent Areas
Most of the areas surrounding the development are residential in nature.
Greenbrier Subdivision lies just west of this development. Albin Village lies to
the east. The areas to the north is zonedRP but undeveloped.
soils
For purposes of design run off conditions, antecedent moisture condition II
(normal consideration for the mid -Atlantic region) is assumed. The soil is
considered to have a moderate rate of water transmission, therefore, CSC Soil
Class "D" is adopted. Soils are, for the most part of the Blairton M) or
Clearbrook (9B) Series. A copy of the respective soil map is enclosed.
Permanent Stabilization
Seeding for permanent stabilization is specified in the V.E.S.C.
Handbook. Any area denuded in which work is not proceeding for a period of 30
days or more will be stabilized by a temporary seeding in accordance with State
guidelines and procedures. All areas to be seeded will receive seed application by
hydroseed methods immediately upon obtaining grades.
Storm Water Management Consideration
Site Plans have been attached.
Greenbriar North is a Single Family Development project just north of
Stephens City. Curb and gutter streets are used throughout. The increase flow from
the site is small. The existing culvert under Oriole Dr. to the west is adequate to
carry the post development drainage. A pre -development C factor of .25 was used.
The post development C factor is .4.
Maintenance
All soil erosion control structures shall be checked weekly by the
contractor during this construction period and after construction is completed until
grass cover is established. Sediment retained by these structures shall be
continuously removed and placed in an area of the site specified, damage to soil
erosion control structures shall immediately be repaired when identified by the
contractor. The contractor shall cooperate with all agents of the County, the
Engineer and others who may identify needed facilities or work in order to protect
the environment within the subject of this report.
