In general the rights -of -way have held up satisfactorily. Hawkins R/O Resolution Bass Hoover Elementary School Detention Ponds The Frederick County Board of Supervisors agrees to indemnify, defend and hold harmless the School Board of Frederick County, its officers, employees and all its agents from any and all claims of any nature whatsoever related to the creation, operation and maintenance of two detention ponds on the grounds of the Bass Hoover Elementary School now and forever as identified in the attached plat. All dwelling houses constructed, if said dwelling house has a chimney, and the chimney is flued on the outside of the dwelling house, then all such flues shall be entirely faced with brick. 17. All lots are required to observe any setback lines, and/or side lines and/or rear yard lines as shown on the plat attached hereto in addition to those applicable requirements of the Frederick County Subdivision and Zoning Ordinances. 18. All of the covenants and restrictions herein shall remain in full force and effect for a period of fifteen (15) years from the date of this instrument and shall be renewed automatically for additional successive ten (10) year periods unless the owners of a majority of lots in the Greenbriar Subdivision shall, at least six (6) months prior to any such renewal date, execute and record an agreement amending said covenants and restrictions. 19. In general, the typical section, bituminous surfaces, and culverts were in very good order. The shoulders at that time were of proper width and slope but it was apparent from the ongoing home construction that the shoulders would be subjected to deformation from the development. The special design ditch along Bluebird Drive and Nightingale Avenue should be graded on a mwdm n 1k to 1 slope with Ed <amat installed to a 3' height above flow line. 3. Erosion stone to be installed at the end of the 24" pipe and double line of entrance pipe at the intersection of Bluebird Drive and Nightingale Avenue. 4. An end wall will be required on the inlet end of a double line of 36" pipe under Nightingale Avernze . 5. The 24" pipe under Oriole Drive is to be extended with a flared end section. 6. End walls are to be installed on the double line of pipe under Tanager Drive with paved ditch or Enkamat as shown to divert the roadway ditches Into the drainage channel. 7. Soil will remain stable under extremely adverse conditions if it is covered with a heavy _ growth of plant life having an extensive root system that serves ` as a reinforcing binder. Box 601, 9 Court Square Winchester, VA 22601 Dear John: Ref: Greenbriar Village Subdivision Section I - Frederick County Off Rt. 647 As requested in your memorandum, dated June 30, 1982, a review of the subdivision has been made and our comments, recommendations, and requirements are as followst 1. The intersection of Bluebird Drive with Rt. 647 will require a 150' taper in accordance with our Standard Secondary Road Connection. Also, the existing slopes along Rt. 647 in front of Lots 1, 31, and 32 must be flattened on 2:1 or 3:1 to improve the sight distance. 2. The typical section should be revised to show a minimum 6' fill shoulder and 4' ditch width. Since Bluebird Drive is the main collector street and will ultimately carry traffic volumes well over 400 VPD, we recommend 8' fill shoulders and 6' cut shoulders in accordance with the subdivision standards. 3. Some of the crest vertical curves are to be increased as noted to obtain as close to 240' sight distance as possible with 200' being the absolute minimum. 4. We recommend sod or protective covering Standard EC-2 be used instead of rock in the special design ditch along Bluebird Drive and through the Lots. A minimum 2' depth is required for the 8' flat bottom ditch as noted. 5. Sod or protective covering is to be provided in all roadside ditches where necessary. This would generally be where the grades are 3% or greater. 6. Standard underdrains are to be provided at the approximate locations noted. 7. It appears an additional 10' drainage easement to contain the ditch along Nightingale Avenue will be required between Bluebird and Oriole Drives. I 8. The double line of 36" pipe on Nightingale Avenue should be shifted closer to the sag in grade as noted. 9. A 20' drainage easement to natural or legal watercourse is required from the back of Lots 12 and 66 as marked on the plans. Base depth will be determined by CBR tests conducted by the Virginia Department of Highway and Transportation at the expense of the developer. These tests require approximately two weeks. Therefore, it is suggested you request these tests prior to placing the base stone or after the rough grading has been completed.
