Box 3266 Winchester, Virginia 22604 RE: Property Improvements in Glenmont Village Dear Dick: COUNTY of FREDERICK Department of Planning and Development 540/665-5651 FAX: 540/ 678-0682 I am in receipt of your letter dated September 27, 1999 regarding the intent of your association to notify this office of proposed improvements within the Glenmont Village .Subdivision, as a copy of a letter from yourself to a Ms. Helene McKenty regarding a proposed fence. First, Frederick County does not regulate fences either in terms of their location or construction materials. Second, as I believe you are aware, Frederick County has no authority to enforce private deed covenants. While I appreciate your association's attempt to establish a line of communication with this office, I would ask that you reconsider your approach. As is the case with the proposed fence, it serves little purpose to notify this office of a proposed activity which we have no jurisdiction over or of which your association appears to have little concern. As you may be aware, Frederick County's policy with regard to the investigation and pursuit of zoning violations has always been that we respond to complaints. This policy is based primarily on the fact that in a County of some 56,000 residents, covering over 400 square miles, the Planning staff would be hard pressed to actively patrol in search of zoning violations. In addition, the County's zoning regulations have been adopted over the years in an effort to protect property owners from the encroachment of uses that would devalue their property or otherwise create a nuisance. Given the volume of complaints we receive, there is little value in pursuing potential violations when the activity involved is of no apparent concern to an adjoining land owner. With the above policy in mind, it would be far more efficient and appropriate if you would limit your notifications to this office to those activities which are of enough concern to you, or other members of the association, that you are prepared to file a formal complaint. Merely copying this office on correspondence between you association and its members neither provides us with the information we would need in order to determine if a violation were occurring nor, in and of itself, constitutes a formal complaint. Your submission need not be formal blue prints, but must show the nature, kind, shape, height, materials (including the color of exterior roof and siding), and location of the fence and building. I offer the following comments: • A preconstruction conference be held by the engineer and/or developer with the attendance of the contractor, various County agencies and VDOT shall be conducted prior to initiation of work. • Materials used and method of construction shall apply to current observed VDOT Road and Bridge Specifications applicable during construction of this development. Our review and comments are general in nature. Should conditions in the field exist such that additional measures are warranted, such measures shall be completed to the satisfaction of the Department prior to inclusion into the Secondary Road System. • Attached is a copy of the minimum requirements and data for subdivision streets prior to acceptance into the Secondary System. This is the responsibility of the developer. • All drainage is to be carried within the right-of-way in ditch lines or gutters along the street to a pipe or drainage easement. • The contractor shall notify VDOT when work is to begin or cease for any undetermined length of time. VDOT will also require (forty-eight) 48 hours notice for inspections. • A land use permit shall be obtained before any work is performed on the State's right-of-way. • If mailboxes are to be placed along the roadway fronting lots, a minimum of four (4') feet. shall be between the edge of pavement and the front of mailbox as shown`on the attached sketch. • Private entrances will be installed in accordance to the attached sketch.
