THIS DEED OF DEDICATION AND DECLARATION OF PLAT
1 for Fredericktowne Company, Section I -A, made and dated this 4th day of
1 April, 1974.
WHEREAS, Fredericktowne Company desires to dedicate, plat
and subdivide that certain parcel of land containing 3. 146 acres, more or
j less, which is a portion of the land conveyed to that corporation by Deed
1 dated the Ist day of April, 1969, from George A. Cornwell and Margie
Cornwell, his wife, recorded in Deed Book 351 at Page 630 in the Office of
the Clerk of the Circuit Court of Frederick County, Virginia and a Deed of
Correction from the same parties, dated the 15th day of July, 1969, recorded
in Deed Book 355 at Page 309 in the aforesaid Clerk's Office..
NOW THEREFORE, THIS DECLARATION OF PLAT,
WITN-ESSETH:
The platting and/or dedication of the following described land is
with the free consent and in accordance with the desire of the undersigned
l owner, Fredericktowne Company, a Virginia Corporation, as evidenced by
the signatures of its Vice -President and attestation of its Secretary.
Beginning at an iron pin in the boundary line of
Fredericktowne Drive, a corner to Lot 107 -
Section I of Fredericktowne Subdivision? thence
with the said boundary line of Fredericktowne
Drive for the two following courses: with the
Arc of a curve to the left 79.58' (Radius - 337.97' -
Chord - N56032'31"E - 79,.39') to an iron pin at the

in the South line of the Fredericktowne Company

Company, Inc. and bearing the seal of H. Bruce Edens, Certified Land
Surveyor.
The lots in this subdivision are subject to those covenants,
conditions, reservations and restrictions found in the Deed of Dedication of
Fredericktowne Company, Section I, dated the llth day of March, 1970,
and recorded in the aforesaid Clerk's Office in Deed Book 361 at Page 601
and following, which shall apply to each and every lot shown on the attached
Plat and are incorporated herein by this reference as if fully set forth
herein.
The covenants, reservations and restrictions aforesaid shall
not impose any restraint on any portion of land now owned or hereafter
acquired by Fredericktowne Company, its assigns or successors in title,
or adjoining, adjacent to or otherwise related in any way to Fredericktowne
Company, Section I -A, as shown on the attached Plat.

confirm that I advised you that the above referenced streets had
been constructed according to the approved plans and this depart-
ments minimum standards for subdivision streets. They are eligible
for addition to the Highway System.
It is understood that if these streets are taken into the Highway
System at any time other than July lst, a maintenance fee is required.

we understand is the fee for getting hefore the Planning Commission
final approval of the six lots of "Fredericktowne", Section I -A,
which we have submitted.
The recreation fee of S 100.00 per lot has been paid.
It is our understanding that the Planning Commission
will consider this plat at its meeting of May 9th and assuming
that it is approved by the Planning Commission will be on the
agenda of the next Roard of Supervisors meeting for its approval..

ment across the Orndorff property and so record it on the plat. This ease-
ment can be located adjacent to the utility easement shown.

Be advised that the Board of Supervisors at its Regular
Meeting, held November 14, 1973,.took no action on the Final
Plat of Fredericktowne Subdivision - Section l-A pending
receipt of final approval from the Department of Highways and
Department of Health and submittal of construction plans for
all improvements. In addition to the easement required by the
Department of Highways, the Planning Commission recommended
payment of $600.00 in lieu of the dedication of land for
recreation.
In addition to the approvals mentioned, we must also
have plan and specification approval for water and sewer
construction from the Sanitation, Authority, a performance
bond for the proposed improvements, a deed of dedication,
payment of a subdivision review fee of $31.00 and payment
of the $600.00 mentioned in the first paragraph.
With regard to the approved plat of Fredericktowne
Subdivision - Section 2, be advised that I have directed
the Building Inspector to issue no further building permits
in that Section until such time as the $8,900.00 payment
in lieu of dedication of recreation land is paid.

Gentlemen:
Several days ago a representative of a builder in
Fredericktowne, Section 2 applied for several building
permits in Section 2 of Fredericktowne Subdivision. Although
the plat has been approved no bond to insure the completion
of improvements has been posted with the County. Also, there
is some question as to the amount of recreation impact money
to be paid inasmuch as it is our understanding that a number
of duplex units will be built in Section 2. The recreation
impact fee is assessed at the rate of $100 per unit. This
may therefore effect the amount previously discussed since
in the case of duplexes there will be two units on one lot.
I would also like to address a question regarding
Section 1-A of Fredericktowne Subdivision. Although it is
evident you are proceeding with development of this section
and one house has been completed and another is approaching
completion, I should remind you that the plat of Section 1-A
has not been approved by the Board of Supervisors. This plat
is scheduled to be heard before the F'tederick County Planning
Commission on May 9th, after which time it may be reviewed
for final approval by the Board of Supervisors on May 22, 1974.
There is no problem at this point, but should a transfer in
title of any lot within this tract of land occur,, without
final approval by the Board .of Supervisors., to include posting
a bond and paying recreation impact money,, such transfer would
be in violation of the Frederick County Subdivision Ordinance.
