To Whom It May Concern:

We, the residents of Fredericktowne Estates in Stephens City, Virginia are requesting
the placement of signs (or other appropriate means) to restrict the use of Westmoreland
Drive as a thoroughfare for trucks and other construction vehicles and equipment that are
involved with the construction of housing in the phases of Fredericktowne Estates currently
being built upon. With the completion of Fairfax Drive connecting to Wythe Avenue, access
to this area can now be obtained via Wythe Avenue then onto Fairfax Drive. Access to this
construction area can be made easier via this new route.
This request is made due to the heavy volume and speed of construction vehicles
along Westmoreland. This long stretch of straight road creates a means for high speeds
which results in obvious dangers along the road.

Planning Department:
Approved the Final Master Development Plan #007-88 of Fredericktown Estates,
zoned RP 116.45 acres, for single-family traditional housing. A contract
between Shiho, Inc. and the Frederick County Sanitation Authority indicates
i that the Parkins Mill facility must be complete before the subdivision can be
connected to sewer lines. This property is located on the south of Albin Village
and northeast of Fredericktowne at Westmoreland Drive Extended, in the Opequon
Magisterial District.

appears on the site plan, the proposed utilities will be placed beneath the
roadway at several locations. If this is the case, they should be relocated.
Also, land use permits will be required for street connections onto the
Department's right-of-way.
Sanitation Authority - 1. Add three valves (locations marked); 2. Add valve
and extend line; 3. Tap existing line and add section of water line; 4. Can
sewer service be provided to locations marked? (6 each)
Stephens City Fire Company - Shall comply with Chapter 10 of the Frederick
County Code as a minimum.
Parks & Recreation - This plan appears to be in order as it relates to open
space and environmental requirements.
Inspections Department - This revised preliminary master development plan
shall comply to Use Group "R" Residential of the BOCA Basic National Building
Code 1987
Planning and Zoning - No objection. The proposed preliminary master
development plan appears to meet all master development planning standards
for single-family traditional lots with 15% open space.

The referenced subdivision will be served by the Parkins Mill Treatment Plant
and Wright's Run Interceptor. These facilities are currently under
construction with completion projected by June 1, 1989.
The Authority proposes to enter into an agreement with Shiho, Incorporated on
the referenced subdivision. The agreement prevents Shiho from connecting to
the sewer lines until the Parkins Mill Plant and interceptors are complete.
If this arrangement is satisfactory, please let me know and we will finalize
and execute the agreement.
By copy of this letter, I am forwarding the agreement to Shiho, Inc. for their
consideration.

THIS CONTRACT, made this day of July, 1988, by and between the
FREDERICK COUNTY SANITATION AUTHORITY, a Virginia corporation organized and
existing under the provisions of the Virginia Water and Sewer Authorities Act
(Sec. 15.1-1239, et. seq., Code of Virginia, 1950, as amended), of the one
part, hereinafter call the Authority and SHIHO, INC., of the other part,
hereinafter called the Developer.
WHEREAS, the Authority owns and operates a water and sewer system in
the County of Frederick; and
WHEREAS, the Developer desires to obtain water and sewer services from
the Authority for approximately 228 lots in Fredericktowne Estates; located in
the Stephens Run Service Area; and
WHEREAS, the Authority is currently expanding its capacity for service
in the Stephens Run Service Area with the construction of the Parkins Mill
Wastewater Treatment Plant and the Wright's Run and Lakeside Interceptors,)
such projects currently scheduled for completion on June 1, 1989, and will
provide wastewater facilities to serve Fredericktowne Estates.
NOW THEREFORE, in consideration of the following terms, conditions, and
covenants, the parties agree:
(1) That the Developer may connect to the water and sewer facilities
of the Authority. Such connections will not be made before the Parkins
Mill Wastewater Treatment Plant and Wright's Run and Lakeside
Interceptors are completed.
(2) That the Developer will construct at his expense the water and
sewer facilities to serve such lots. Such facilities shall be
constructed in accordance with Authority regulations, standards, and
specifications.
.(3) That the water and sewer facilities and appurtenances thereto so
constructed shall become a part of the water and sewer system of the
Authority upon acceptance by the Authority. Upon completion of
construction, the Developer agrees to execute and deliver to the
Authority a Bill of Sale transferring title to said lines, mains, and
appurtenances to the Authority. The signature of the Authority to said
Bill,', of Sale indicates its acceptance thereof as of the date of the
Authority's signature thereto,.,
(4) That the Developer. shall maintain and repair the said water and
sewer facilities and appurtenances at his expense for the period of one
(1J year commencing With the irate of acceptance by the AutLivrity as
aforesaid and that failure to do so, the Authority shall have the right
to cause such repairs to be made and to recover said costs from the
Developer of his bond.
(5) That the developer will execute and record in the Office of the Clerk
of the Circuit Court of Frederick County, Virginia easements in the
form approved by the Authority necessary to operate, maintain, repair,
replace, or re -construct said facilities.
(6) That the Authority shall have exclusive right to grant permission for
other service connections and extensions to the water and sewer
facilities constructed by the Developer, as well as exclusive right to
fix, rates and to collect all revenues derived from said water and sewer)
facilities.
(7) That the costs incurred for the installation of said water and sewer
facilities shall be not eligible for reimbursement from the Authority.
(8) That this Contract shall continue in full force and effect until one
year from the date the facilities have been accepted by the Authority
and .may be amended only in writing and upon mutual consent of both
Parties.

Development Corporation, owner of Fredericktown Estates, is
willing to Give up lot ##34 Section Il and dedicate this area
to the County of Frederick, that the Golliday Road may be
extended by the Evans Company to and through the Snyder
property to Route 277.
As this dedication and lass to our firm is of no cost to the
County or to Evans; Evans has aureed to purchase an outlot
bordering their Townhouse site of approximately 22,000 square
feet from the Top of Virginia. They are asking that this space
be included in their master Plain for townhouses, adding 4 units
to the plan.
If you see no problem with this , I will immediately sign
whatever documents necessary to execute the right of way
dedication.

above referenced development.
We would like to express our concern over the portion of Golladay Road which
is to remain as a 50' right-of-way. If Golladay Road is to be a connecting
street between Route 277 and Route 522, we recommend the right-of-way width be
increased to 60' and the pavement design increased to provide for at least 3"
B-3 Bituminous Concrete to reflect the anticipated traffic generation through
Section II.
At this time I will require three (3) sets of revised site plans in accordance
with the approved plats for review.

Surry Drive is a duplication of a street name already in existence
and must be changed. We would have no objection to making that
a part of Golladay Road. Please contact us regarding proposed road
names so we can prevent further duplication. We maintain a
"master_" list of all street and road names in the County.
We request you get the plat signed by the owner and approved
by the Sanitation Authority and VDOT prior to final submittal.
When this is completed, we will administratively approve this

the referenced subdivision. The agreement prevents Shiho from connecting to
the sewer lines until the Parkins Mill Plant and interceptors are complete.
If this arrangement is satisfactory, please let me know and we will finalize
and execute the agreement.

part, hereinafter call the Authority and SHIHO, INC., of the other part,
hereinafter called the Developer.
WHEREAS, the Authority owns and operates a water and sewer system in
the County of Frederick; and
WHEREAS, the Developer desires to obtain water and sewer services from
the Authority for approximately 228 lots in Fredericktowne Estates; located in
the Stephens Run Service Area; and
WHEREAS., the Authority is currently expanding its capacity for service
in the Stephens Run Service Area with the construction of the Parkins Mill
Wastewater Treatment Plant and the .Wright's Run and Lakeside Interceptors,,
such projects currently scheduled for completion on June 1, 1989, and will
provide wastewater facilities to serve Fredericktowne Estates.
NOW THEREFORE, in consideration of the following terms, conditions, and
covenants, the parties agree:
(1) That the Developer may connect to the water and sewer facilities
of the Authority. Such connections will not be made before the Parkins
Mill Wastewater Treatment Plant and Wright's Run and Lakeside
Interceptors are completed.
(2) That the Developer will construct at his expense the water and
sewer facilities to serve such lots. Such facilities shall be
constructed in accordance with Authority regulations, standards, and
.specifications.
(3) That the water and sewer facilities and appurtenances thereto so
constructed shall become a part of the water and sewer system of the
Authority upon acceptance by the Authority. Upon completion of
construction, the Developer agrees to execute and deliver to the
Authority a Bill of Sale transferring title to said lines, mains, and
appurtenances to the Authority. The signature of the Authority to said
Bill of Sale indicates its acceptance' thereof as of the date of the
Authority's signature thereto,.
(4) That the Developer shall maintain and repair the said water and
sewer facilities and appurtenances at his expense for the period of one
(1) year commencing with the date of acceptance by the Authority as
aforesaid and that failure to do so, the Authority shall have the right.
to cause such repairs to be made and to recover said costs from the
Developer of his bond.
(5) That the developer will execute and record in the Office of the Clerk
of the Circuit Court of Frederick County, Virginia easements in the
form approved by the Authority necessary to operate, maintain, repair,
replace, or re -construct said facilities.
(6) That the Authority shall have exclusive right to grant permission for
other service connections and extensions to the water and sewer
facilities constructed by the Developer, as well as exclusive right to
fix rates and to collect all revenues derived from said water and sewer
facilities.
(7) That the costs incurred for the installation of said water and sewer
facilities shall be not eligible for reimbursement from the Authority.
(8) That this Contract shall continue in full force and effect until one
year from the date the facilities have been accepted by the Authority
and may be amended only in writing and upon mutual consent of both.

Dear Steve,
My client and Owner of the above referenced tract, Shiho, Inc., has
applied for preliminary master development plan approval in accordance with
your ordinances. It is true that the land involved in this proposal is all
presently zoned RP, however, sanitary sewer facilities are not available at
this time, so the use of the tract for residential purposes is not possible
at this writing. The Owner has been informed that steps have been taken to
increase the sewer capacity of the area through the Parkins Mills
wastewater plant and connecting interceptors. Shiho, Inc. understands that
sewer capacity will not be available to this area prior to Spring of 1989
at the earliest. Shiho, Inc. also understands that the County in no way
guarantees sewer capacity availability at that time or any other time, as a
result of master development action.
Inlight of the above reasons, Shiho, Inc. still desires to proceed
with planning on the referenced tract in order to meet what they believe to

this, Shiho, Inc. requests that the preliminary and final master
development plans for this project be considered under existing County
processes and, if found technically approvable, approved. Shiho, Inc.
accepts full responsibility and liability for any loses which may be
involved with the lack of sewer availability in this regard. Shiho, Inc.
also understands that certificates of occupancy for any completed buildings
will be withheld until adequate sewer is deemed available by the building
official.
