side of First Street and extending back Eastward between parallel lines a
distance of 150 feet, and being the same parcels of land that were conveyed
to the party of the first part by Ira T. Haines, by deed bearing date of
September llth, 1972, and of record in the aforesaid Clerk's Office in Deed
Book No. 397, page 66. A reference to said records, and to the references
therein contained, is here made for a further and more particular description
of said land.
It is expressly stipulated that said land is conveyed subject to
all applicable, or legally enforceable easements, if any, of record affecting
same.
Except as noted above the aforesaid grantor covenants that he has
the right to convey the said land to the aforesaid grantee; that the said
grantee shall have quiet possession of the said land, free from all encum-
brances; that he has done no act to encumber the said land; and that he will
execute such further assurances of the said land as may be requisite.

tract or parcel of land which was conveyed to J. H. l"unkhouser by 11.1. E. Edwards, Executor

and of record in the Clerk's Office of the Circuit Court of Frederick County, Virginia,;

of the purchase price of rive hundred and Sixty-five Dollars, of which one-fourth
(1/4) has been ,),,id in cash and the balance is evidenced. by the deferred purchase

following unimproved lots of land, located. in "Funkhouser Addition" in the County of
I+'rederick, Virginia about two (2) miles aouth of the City of `9�inchester and just Nest
of the Front Hoyal Road, known as route f522 and which lots are desir,nated as Nos.
17, 18, 343 35, 36 and 37 and 38 on a Plat of said "runkhouser Addition" hereto
attached and made a part of this Deed of conveyance. This is a Dart of the same lands
bf'which the late F. Vi. 1unkhouser died, seized and possessed.
Of the purchase money one-fourth (1/4) has been raid before the
delivery of this Deed, the receipt of which is liereby acl,r.olrlea °ed, and t.ne balance
is evidenced by the three (3) deferred purchase money bonds in equal amounts, payable
respectively in six (6), twelve (12) and eighteen (16) months from this date, bearing
interest from date at the rate of Six Per Cent (6,j) per annum, payable semi-annually
and their payment secured by a Dead of Trust of even date herewith.
This conveyance is made, however, subject to the following
restrictions, which are constituted covenants real running with the land:
only.
1. This property is sold to be used for residential purposes
2. Tlo buildli.nr-s shall be erected. on any of said lots nearer than
'shirty -five (35) feet to the. Street upon which it fronts nor nearer than Ten (10) feet
to any side Street.
3. 1`io buildings shall be erected on any of said lots to cost less
than Two Thousand Dollars ($2000.00).
4. lio noxious or offensive trade or activity s1_all be carried
on upon any of said lots which may prove to be an annoyance or nuisance to the
neighborhood and the same shall be owned or occupied by none other than the white race.
Said parties of the first part covenant that they have a rimilt
to convey said property; that the same is free from all liens and encumbrances and
that they will forever warrant and defend the title thereto.
